Deliver all bids to the City Engineer's Office, Room 405Q, City Hall , 300 North "D" Street, San Bernardino, California, with the specification title and number clearly marked on the outside of the envelope. Said bids or proposals will be received up to the hour of 2:00 p.m. , December ?_R ' at which time all of said bids or proposals will be pub is y opened, examined and declared in the City Engineer's Conference Room, Room 405Q. No bid will be received unless it is made on a proposal form furnished by the City. All bids or proposals shall be signed, sealed and accompanied by cash, cashier's check, certified check or bid bond made payable to the City of San Bernardino, in the amount of ten per cent (10%) of the bid. Such cash, check or bond shall be given as a guarantee that the bidder will enter into the con- tract if awarded to him. In the event the bidder refuses to execute said con- tract, the use by the public of the improvements will be delayed, and the public will suffer great damage. From the nature of the- case, it would be extremely difficult and impractical to fix said amount of damage. Therefore, the City and the bidder agree that the above sum of 10% shall be paid to the City upon the condition above set forth as liquidated damages and not as a forfeiture. All bonds furnished pursuant to this notice must be underwritten by a surety company having a rating in Best' s most recent Insurance Guide of "A" or better. Pursuant to law, the Mayor and Common Council of the City of San Bernardino, by Resolution No. 5718 and any and all amendments thereto which are hereby referred to and made a part hereof by reference as fully as though set forth at length herein, have ascertained and determined the general prevailing rate of per diem wages, and of per diem wages for legal holidays and overtime work for each craft or type of workman needed in the execution of contracts under jurisdiction of said Mayor and Commoih Council . Said prevailing rates of wages shall conform to "Wage Scales for the Six Basic Trades," filed in the Office of the City Clerk, and "Sub-Trades Hourly Wage- Rates of Building and Construction Trade Council of San Bernardino and Riverside Counties," filed in the Office of the City Clerk, which are made a part of said Resolution No. 5718 and amendments thereto. It shall be mandatory upon the contractor to whom the contract is awarded and upon any sub-contractor under him to pay not less than said specified rates to all laborers, workmen, and mechanics employed by them in the execution of the contract, and to prevent discrimination in the employment of persons because of race, creed, color, or national origin, as set forth in the provisions of Resolution No. 7414 of the Mayor and Common Council of the City of San Bernardino. No bid will be accepted from a contractor who is not licensed in accordance with the provisions of Chapter 9, Division III of the Business and Professional Code. My QrnMission, expires 1 0/14 otary Publ an for sai County -TffiB ED.3/72(CALIF.) o . w 1 t SPECIAL PROVISIONS SECTION I SPECIFICATIONS AND PLANS 1.01 GENERAL -- The work embodied herein shall be done in accordance with the standard specifications for Public Works Construction, 1979 Edition, insofar as the same may apply and in accordance with the following special provisions. 1.02 DEFINITIONS -- Whenever in the Standard Specifications the following terms are used, they shall be understood to mean and refer to the following: Department of Transportation The City of San Bernardino. Agency - The City of San Bernardino. Board - The Mayor and Common Council for the City of San Bernardino. Engineer - The Director of Public Works/City Engineer for the City of San Bernardino. Laboratory The laboratory to be designated by the City of San Bernardino to test materials and work involved in the contract. Notice of Contractors Notice Inviting Bids. State _The City of San Bernardino. Other terms appearing in the Standard Specifications, and these Special Provisions, shall have the intent and meaning specified in Section 1.02, Definit- ions. In case of conflict between the Standard Specifications and these Special Provisions, the Special Provisions shall take precedence over and be used in lieu of such conflicting portions. 1.03 DESCRIPTION OF WORK -- Remove all existing roofing materials and flashings, and install a new roof, and such other items or details not mentioned above, that are required by the plans, these special provisions, and Standard t Specifications shall be performed, placed, constructed or installed. 1.04 GENERAL PROVISIONS -- Bids must be submitted on the proposal form contained herein. All bids or proposals shall be signed, sealed and accompanied by cash, cashier's check, certified check or bid bond made payable to the City of San Bernardino, in the amount of ten percent (10%) of the bid. Such cash, check or bond shall be given as a guarantee that the bidder will enter into the contract, if awarded to him. In the event the bidder, to whom the contract is awarded, refuses to execute said contract, the use by the public of the improve- ments will be delayed, and the public will suffer great damage. From the nature of the case, it would be extremely difficult and impractical to fix said amount of damage. Therefore, the City and the bidder agree that the proposal guarantee of 10% of the bid shall be paid to the City upon the conditions set forth above as liquidated damages and not as a forfeiture. Bid bonds shall be underwritten by a surety company having a rating in Best's most recent Insurance Guide of "A" or better. 1.05 AWARD AND EXECUTION OF CONTRACTc -- Award of the contract will be made by the Mayor and Common Council at the next Council Meeting after opening of the bids. The bidder to whom the contract is awarded shall file with the Engineer all required bonds and insurance policies, and execute the contract, within 10 calendar days after receiving notification of the award. 1 .06 CONSTRUCTION SCHEDULE AND COMMENCEMENT OF WORK, 'TIME OF COMPLETION AND LIQUIDATED DAMAGES -- Attention is directed to the provisions in Section 6-1 , 'Construction Schedule and Commencement of Work," in Section 6-7.1 , "Time or Completion," and in Section 6.9, "Liquidated Damages," of the Standard Specifications for Public Works Construction, 1979 Edition and -these special provisions. The Contractor shall diligently prosecute the work to completion before the expiration of 30 CALENDAR 'DAYS From the date of the "NOTICE TO PROCEED." The Contractor shall pay to the City of San Bernardino the sum of $100. per day, for each and every calendar day's delay in finishing the work in excess of the number of working days prescribed above. 1 .07 CONTRACTiBONDS -- One of the bonds required in Section 2-4 of the Standard Specifications shall be in the amount equal to 100% of the contract price and shall guarantee the "Faithful Performance" of said contract by the Contractor; and the other of said bonds, in the penal sum equal to at least one-half of the contract price for "Material and Labor Bond. All bonds furnished must be underwritten by a Surety Company having a rating in Best's Insurance Guide (Current Issue) of "A" or better. 1 .08 PUBLIC LIABILITY & PROPERTY DAMAGE INSURANCE -- No work shall be done under the contract unless there *is in effect insurance required under this section, and such insurance has been approved by the City of San Bernardino, nor shall the Contractor allow any sub-contractor to commence work on his subcontract until all insurance required of the subcontractor has been so obtained and approved. The Contractor shall take out and shall furnish satisfactory proof by certificate or otherwise as may be required, that he has taken out public liability and property damage insurance with insurance carriers satisfactory to the City of San Bernardino, and in such form as shall be satisfactory to the City of San Bernardino. All said public liability and property damage insurance shall be maintained by the Contractor in full force and effect during the entire period of performance under this contract. Unless otherwise set forth, the amounts of coverage of said insurance shall be not less than the following: Bodily Injury . . . . . . . . . .$250,000 each person $500,000 each occurrence $500,000 aggregate products and completed operations Property Damage . .. . . . . .$100,000 each occurrence $250,000 aggregate A combined single limit policy with aggregate limits in the amount of $1 ,000,000 will be considered .equivalent to the re- quired minimum limits. Said policies shall have a non-cancellation clause providing that ten (10) days written notice shall be given the City of San Bernardino prior to such cancellation. All such notices shall be delivered to the Secretary or Clerk of the City of San Bernardino. The Contractor shall maintain, or cause to be maintained, fire insurance sufficient to protect against such loss or damage in full until the work is fully accepted by the City of San Bernardino. Nothing herein contained shall be construed as limiting in any way the extent to which the Contractor may be held responsible for the payment of damages to persons or property resulting from his operations or the operations of any sub-contractor under him. Proof of all such insurance shall be given by filing certificates of such insurance with the City of San Bernardino prior to execution of the contract by the City of San Bernardino. 1 .09 WORKMEN'S COMPENSATION INSURANCE -- The Contractor's attention is directed to Section 7-4, "Workmen s Compensation Insurance," of the Standard Specifications, providing that the Contractor shall file a signed certification and Certificate of Workmen's Compensation Insurance before execution of the contract. A copy of this certification is included in these special provisions. A twenty-year (20) Surety Bond on this roof is required by roofing Contractor (approved by the manufacturer) with "Flashing Endorsement" included in bond, issued to the City of San Bernardino, San Bernardino, California. 2.08 Clean U -- The outline area shall be cleaned of all debris, due to the roofer's operations, to the satisfaction of the Engineer. All such debris shall be properly disposed off by the Contractor. The Contractor shall maintain, or cause to be maintained, fire insurance sufficient to protect against such loss or damage in full until the work is fully accepted by the City of San Bernardino. Proof of all such insurance shall be given by filing certificates of such insurance with the City of San Bernardino prior to execution of the contract by the City of San Bernardino. 1 .09 WORKMEN'S COMPENSATION INSURANCE -- The Contractor's attention is 11 directed to Section 7-4, "Workmen s Compensation Insurance," of the Standard Specifications, providing that the Contractor shall file a signed certification and Certificate of Workmen's Compensation Insurance before execution of the contract. A copy of this certification is included in these special provisions. SECTION II ROOFING 2.01 Scope of Work -- Furnish all labor, materials, equipment, appliances and services necessary for re-roofing the existing roof as .indicated on the drawings and/or herein specified. All work shall be done in a good workmanlike manner consistent with accepted practice in .the industry. 2.02 Description of the Work -- Remove the existing roofing to the sheathing boards, and thoroughly clean roof surface area and sweep clean all loose sand, nails, etc, and ha6rl away all debris. New roof and flashings to be installed in- cluding all appurtenant facilities. Vent pipes and roof jacks shall be sealed with a collar of black plastic roofing cement and painted with a' suitable color to correspond with the roofing. 2.03 General -- This work shall comply with Johns - Manville Specifications h1o. 406 using J-M 190 asphalt or approved equal , a copy of which is attached as Appendix "A." Follow directions and specifications of manufacturer whos material is being used. This specifications is for use over wood structure deck without insulation which can receive and adequately retain nails or other types of mechan- ical fasteners as may be recommended by the deck manufacturer. 2.04 Flashing_ -- All new flashings and counter flashings shall conform to the section on flashings, specification manual for J-M Built Up Roofs. Flashings and counterflashings shall be equivalent to the existing ones that are to be removed. 2.05 Cant Strip -- New Cant Strips shall be furnished and installed to modify the angle between the roof and any vertical element. New Cant Strips shall be equivalent to the existing ones that are to be removed. 2.06 Special Requirements -- All roofing materials shall be by one manu- facturer. Roofing applicator shall be approved by the same_ manufacturer of materials used. Letter of approval shall be submitted to the Engineer before roofing work is begun. Installation small be inspected and approved by a re- presentative of the materials manufacturer. All roofing shall be installed in a good workmanlike manner consistent with accepted practice in the industry. 2.07 Guarantee -- Before the roof will be accepted, the roofing contractor shall deliver into the hands of the Engineer, a written t%.ro-year guarantee stating (a) that the roof flashing, and counterflashings will be maintained water-tight; (b) that any defective materials and/or workmanship which may become evident within the two-year guarantee period be replaced with the proper new materials or other- wise made good; (c) that the roofing will lay smooth and even; (d) and that any and/or all repairs which may be necessary on account of any of the above-mentioned (a), (b) or (c) causes will be made without any cost to the City.
