HomeMy WebLinkAbout1985-281 L it II I 1 2 RESOLUTION NO . n5-2 8 i 3 4 RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING 5 � THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN THE I CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO. 6 2323 AND REPEALING RESOLUTION NO . 85-148. �I 7 it BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS : S I SECTION 1. Reci tal s. The Mayor and Common Council of 9 the City of San Bernardino hereby find and determine that: 10 A. Pursuant to Section 99 of the Revenue and Taxation i 11 I Code, pri or to the i ssuance of a certi f cate of f 1 i ng by the 12 Local Agency Formation Executive Officer, the governing bodies 13 of all local agencies whose service area or service responsi- i 14 I bi 1 i ti es will be altered by a proposed jurisdictional change 15 will negotiate and determine by resolution the amount of 16 property tax revenues to be exchanged between and among such 17 local agencies. 18 B. Except as provided in Section 99.1 of the Revenue 19 I and Taxation Code , in the event that a jurisdictional change 20 would affect the service area or service responsibility of one 21 or more special districts, the Board of Supervisors of the 22 County of San Bernardino shall , on behalf of the district or 23 districts, negotiate any exchange of property tax revenues. 24 C. The Mayor and Common Council of the City of San 25 II Bernardino and the Board of Supervisors of the County of San 26 lj Bernardino have determined the amount of property tax revenues i 27 to be exchanged as a result of the jurisdictional change des- 28 j 1 �I � it 1 cribed by LAFC No. 2323 which was expanded by the Local Agency Formation Commission . 2 3 SECTION 2. Implementation . 4 A. The negotiated exchange of property tax revenues between the City of San Bernardino and the County of San 5 Bernardino attached hereto as Exhibit "A" and incorporated 6 herein by reference, resulting from the above described 7 8 jurisdictional change , is hereby approved and accepted. The column entitled "Estimated Current Tax Revenue" shall represent 9 the amount of property tax revenues for the current year to be 10 paid to the County of San Bernardino and its affected agencies. 11 B. The annual tax increment generated in the area 12 subject to the jurisdictional change and attributable to the 13 Local Agencies whose service area or service responsibilities 14 will be altered by the proposed jurisdictional change shall be 15 allocated in the future years pursuant to the provisions of 16 �! Section 98 of the Revenue and Taxation Code. 17 SECTION 3. The boundaries of L.A.F.C. 2323 have been 18 expanded ; therefore Resolution No . 85-148 is hereby repealed. 19 SECTION 4.
