HomeMy WebLinkAbout1985-284 I I 1 RESOLUTION NO . 85--281 2 3 A RESOLUTION OF THE CITY OF SAN BERNARDINO FINDING AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY 4 REQUIRE THE PROPOSED MAINTENANCE OF LANDSCAPING IN THE AREA OF CARNEGIE DRIVE , CREATING AN ASSESSMENT DISTRICT TO COVER 5 THE COSTS OF SAID MAINTENANCE , KNOWN AS ASSESSMENT DISTRICT NO . 956 , ORDERING THE WORK AND THAT THE SPECIAL ASSESSMENT, 6 INVESTIGATION AND LIMITATION ACT OF 1931 SHALL NOT APPLY . 7 WHEREAS , the Mayor and Common Council of the City of 8 San Bernardino have preliminarily found that the public 9 interest, convenience and necessity require the maintenance 10 of landscaping in a portion of the City, as more fully here- 11 inafter described, and the appurtenances and appurtenant work 12 and incidental costs and expenses in connection therewith , i 13 that the project is feasible , and that the lands to be 14 j assessed will be able to carry the burden of the proposed i 15 assessments to pay the costs and expenses thereof; and 16 WHEREAS , the Mayor and Common Council of the City of i 17 San Bernardino have , on the 3rd day of June , 1985 , passed and 18 adopted Resolution No. 85-198 entitled: I 19 RESOLUTION OF THE CITY OF SAN BERNARDINO 20 PRELIMINARILY DETERMINING THAT THE PUBLIC i CONVENIENCE AND NECESSITY REQUIRE THE FORMA- 21 TION OF A LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT: DECLARING ITS INTENTION TO PROCEED 22 i) TO ORDER WORK WITHIN THE DISTRICT, TO BE KNOWN AS ASSESSMENT DISTRICT NO . 956 AND 23 11 SETTING AND DIRECTING PUBLICATION OF NOTICE ! OF A TIME AND DATE OF A PUBLIC HEARING . 24 i� 25 which said resolution duly and legally was published and L6 notice of improvement has been given in the manner required by 27 Chapter 12 . 90 of the San Bernardino Municipal Code ; and 28 !i 1 'I I 1 j, written objections and protests to the formation of the pro- 2 posed district, the work to be done or the extent of the 3 , district to be assessed were heard and considered . 4 ii NOW THEREFORE , BE IT RESOLVED BY THE MAYOR AND i r 5 COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS : 6 ICI SECTION 1. That a full and fair public hearing �i 7 having been held , as stated in the recitals herein , and the ii g Mayor and Common Council , having heard and considered any and 9 ! all comments received thereon and being fully advised in the 10 premises , hereby modifies the boundaries of the proposed 11 district to reduce the size of the district by excluding those 12 properties known as Assessor ' s parcel No. s 281-351-03, 281- 13 351-04 and 281-351-05 and hereby overrules any and all it protests received. 14 15 SECTION 2. That the public convenience and 16 necessity require , and the Mayor and Common Council of the 17 City of San Bernardino hereby declares by not less than a 18 4/5th vote as defined in Section 12. 90.040D of the San 19 Bernardino Municipal Code , that the public interest, 20 convenience and necessity requires and hereby orders , the 21 formation of Assessment District No. 956 ; the work described 22 in said Resolution No. 85-198 to be done in portions of the III 23 ;; parkways and relative median strips of Vanderbilt Way between 24 Waterman Avenue and Carnegie Drive ; the entirety of Carnegie 25 Drive ; Harriman Place between Hospitality Lane and its j 26 Easterly terminus ; Hospitality Lane between Waterman Avenue � 27 and Tippecanoe Avenue ; Brier Drive between Carnegie Drive and 28 Tippecanoe Avenue , Waterman Avenue between the San Timoteo II 2 I' I I! I, l ;r I Creek and a point approximately 400 feet North of Vanderbilt 2 I Way; Tippecanoe Avenue between Brier Drive and a point 3 approximately 600 feet South of Hospitality Lane; areas 4 adjacent to the South bank of the Santa Ana River between 5 Waterman Avenue, Northerly to the A.T. & S . F. Railroad right- 6 of-way ; areas on both side of the Gage Canal between the 7 Interstate 10 Freeway and Brier Drive ; areas adjacent to the 8 North right-of-way of Interstate 10 Freeway between the San 9 Timoteo Creek Channel and the Southerly prolongation of 10 Orchard Drive , and the administration thereof, as provided in 11 said Resolution and that the Special Assessment, Investigation 12 and Limitation Act of 1931 shall not apply. 13 SECTION 3. The City Clerk hereby is directed to 14 post a Notice for five days on or near the door of the Council 15 Chambers of the City Hall inviting sealed proposals or bids 16 for doing the work ordered and referring to the specifications 17 r on file and to publish a Notice Inviting such proposals for at i 18 least two days in the San Bernardino Sun , a newspaper pub- 19 ; lished and circulated in said City. 20 ; SECTION 4. The contract will be awarded pursuant 1 to the standard procedures used by the City in the award of 21 i 22 If Public Works contracts and the work ordered hereunder shall be 23 i to the satisfaction of the City Engineer of said City, and all i 24 i! of said work shall be done under his direction and shall 25 comply with the specifications prepared by him, and upon the 26 completion of said work , the City Engineer shall , and he 27 ,I hereby is directed to make the assessment. 28 3 i I I SECTION 5 .
