CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
BACKGROUND
July 15, 1996 Inspection of the subject property was conducted in conjunction with the
Rental Housing Inspection Program.
July 23, 1996 An Inspection Report was issued citing numerous violations.
August 7, 1996 A re-inspection was accomplished and it was noted that the violations
had not been corrected.
September 11, 1996 An inspection of the property was performed and a Notice to Vacate was
posted on the property by the Fire Marshal for conditions within the
building being deemed unsafe. Numerous violations of the City's
Housing, Fire, and Property Maintenance Codes were cited (ref. Notice
of Hearing - Attachment Q.
October 3, 1996 A hearing was held before the Board of Building Commissioners. The
Board issued Order No. 3830 (Attachment B) which requires correction
of the violations within 60 days and confirmed the incurred costs of
abatement.
October 15, 1996 The Owner, Mr. Mohamad Halabi, submitted a Notice of Appeal
(Attachment A) appealing the confirmation of incurred costs. In addition,
the owner has commenced work on the necessary repairs.
APPELLANT'S STATED GROUNDS OF APPEAL
The appellant states that he had paid "inspection fees" in 1995 and that he believes he is being
asked to pay the same fees again.
ACTION SOUGHT BY APPELLANT FROM THE MAYOR AND COMMON COUNCIL
Requests that "fees" be waived.
ANALYSIS
The appellant is apparently confusing the incurred costs for the abatement action (as confirmed
by the BBC) with fees he paid for a building permit (Attachment E) in 1995. The incurred costs
as delineated in the Statement of Costs (Attachment D) represent costs incurred by the City in
undertaking the abatement action. They bear no relationship to the inspection fees associated
with the building permit.
STAFF RECOMMENDATIONS
That the Mayor and Common Council uphold Order No. 3830 of the Board of Building
Commissioners and deny the appeal.

of Building Commissioners' Order, which states the findings of the Board and any required
corrective actions.
As owner and all vested parties of record you were notified in your previous Notice of Hearing
that the Board's findings may be appealed to the Mayor and Common Council within fifteen (15)
days of the date of this notice. This appeal must be filed with the City Clerk's office, 300 North
"D" Street, 2nd Floor, San Bernardino, CA 92418. A fee of $75.00 must accompany your
request. The written appeal should include:

4 WHEREAS, pursuant to the San Bernardino Municipal Code, Title
5 15 , Chapter 15 . 04, 15 . 24 and 15 . 28 , the Building Official has
6 posted a property located at 668 N. "H" Street San Bernardino,
7 California, with a "Notice and Order" and has notified the person
8 having an interest in said property that the said building or
9 premises is in violation of San Bernardino Municipal Code (SBMC)
10 and constitutes a public nuisance .
11 WHEREAS, pursuant to San Bernardino Municipal Code, the
12 Building Official has served a "Notice of Hearing" before the
13 Board of Building Commissioners of the City of San Bernardino,
14 relating to abatement proceeding, to the person having an interest
15 in the above property, and has prepared a declaration of mailing
16 of the notice, a copy of which is on file in these proceedings .
17 WHEREAS, a hearing was held to receive and consider all
18 relevant evidence, objections or protests on October 3 . 1996; and,
19 WHEREAS, there was an appearance by Mohamid Halibi, brother
20 of property owner as having an interest in the above property.

3 NOW THEREFORE, IT IS ORDERED BY THE BOARD OF- , BUI`;DING
4 COMMISSIONERS OF THE CITY OF SAN BERNARDINO AS FOLLOWS :
5 SECTION 1 - FINDINGS :
6 Based upon the evidence submitted, the Board finds that the action
7 taken to summarily abate the nuisance was appropriate and that the
8 violations noted in the Notice of Hearing do in fact exist on the
9 property located at 668 N. "H" Street, San Bernardino, California,
10 and that the property is being maintained in violation of the
11 SBMC, and therefore constitutes a nuisance;
12 SECTION 2 - ORDER:

13 The Board of Building Commissioners adopted staff' s
14 recommendations . That the owner shall obtain all necessary
15 permits as indicated within 14 days from the date of this order,
16 and that all violations as stated in the Notice of Hearing
17 (Summary Action) be corrected within 60 days from the date of this
18 order;
19 SECTION 3 - AUTHORIZATION TO ABATE:
20 If the owner fails to comply with the Board' s order within the
21 time specified, the City may initiate action and abate the
22 nuisance ; and
23 SECTION 4 - CONFIRMATION OF INCURRED COSTS :
24 Due to the owner' s failure to comply within the time frame
2 5 specified in the Notice of Hearing (Summary Action) , the owner
26 shall incur all current costs of abatement in the amount of
27 $755 . 12 in the form of a lien or personal obligation, which if not
28 paid, shall be recorded with the County Tax Assessor as a special

3 assessment on the property.
4 SECTION 5 - RIGHT TO APPEAL:
5 Any person aggrieved by this order, may appeal to the Mayor and
6 Common Council by filing a written statement with the City Clerk.

9 written appeal must be received within fifteen (15) days from the
10 date of this notice dated October 15 1996 .
11 SECTION 6 - EXTENSION:
12 Upon receipt of an application from the person required to conform
13 to the order and by agreement of such person to comply with the
14 order if allowed additional time, the supervising Building
15 Official may grant an extension of time, not to exceed an
16 additional 120 days, within which to complete said repair,
17 rehabilitation or demolition, if the supervising Building Official
18 determines that such an extension of time will not create or
19 perpetuate a situation imminently dangerous to life or property.

THIS NOTICE is hereby served to you as owner or interest holder of the above referenced
property. An inspection of this property on September 11 1996 revealed conditions which
presented a hazard to the health and safety of the public. In order to protect the public, the Fire
Marshal has taken Summary Action to abate the hazardous conditions on 668 N. "H" Street.
The hazardous conditions which required abatement and the actions taken are as follows:
VIOLATIONS:
1. Dangerous Building-Dilapidated Conditions. When a building or structure, because
of obsolescence, dilapidated condition, deterioration, damage, inadequate exits, faulty
electric wiring, gas connections or other cause, is determined by the fire marshal to be
a fire hazard. (SBl1C 15.28.010, UCADB 302.12 and 302.16)
2. Orders, Notices and Tags. Deemed unsafe by reason of inadequate and/or unsafe exits,
substandard gas and plumbing hook-up, no smoke detectors and improper maintenance.

ACTION TAKEN:
On September 11, 1996, inspections of the property were performed and a Notice to
Vacate the building was posted on the property by the fire marshal for condition within
the building being deemed unsafe by reason of inadequate and/or unsafe exits,
substandard gas and plumbing hook-up and no operable smoke detectors and improper
maintenance.
IN ADDITION THE BUILDING OFFICIAL HAS FOUND THE FOLLOWING
VIOLATIONS EXIST ON THE PROPERTY:
3. Lack of Required Landscaping, or Unmaintained Landscaping. The front yard is
lacking landscaping and is barren on some areas. Re-landscape the front yard with trees,
shrubs, ground cover, decorative rock, redwood bark, and/or lawn. Maintain the new
and existing landscaping by including regular irrigation, pruning of trees, trimming of
shrubs, and cutting of lawns. (SBMC 15.24.050A1 & A2)
4. Accumulation of Trash and Debris in Yards. Remove the trash and debris around
Unit 8. (SBMC 15.24.050A4)
5. General Dilapidation or Improper Maintenance. [SBMC 15.04.020, UHC 1001(b)13]
A. The bedroom door to the bedroom of Unit 11 is off its hinges. Install door back
onto the door jamb.
B. The water closet needs to be fasten to the floor in Unit 3.
C. The cover over the shower valve stem is missing. Provide cover over the shower
valve stem in Unit 3.
D. Fill in the opening between the copper water supply line and the masonry wall
unit 7.
E. Security bars in the bedroom of Unit 13 is not lockable. Repair or replace
security bar in Unit 13.
F. The bedroom door is lacking a strike plate (unlockable). Provide strike plate to
lock bedroom door in Unit 13.

6. Substandard or Hazardous Electrical Wiring. [SBMC 15-04.020, UHC'-1001(e)]
A. The ceiling light in the bedroom of Unit 9 is not working. Provide operable
bedroom light.
B. The bathroom light is inoperable in Unit 1. Provide operable bathroom light (the
receptacle on the bathroom light has a open ground).
C. The bathroom light in Unit 7 is inoperable. Repair or replace the bathroom light.
D. Kitchen light in Unit 13 is not mounted flush with the gypsum board. Mount
kitchen light flush with the ceiling (provide electrical box flush with ceiling if the
electrical box is missing or recessed).
E. Provide an additional circuit for the refrigerator, so the other electrical appliance
or light does not dim when the refrigerator starts up in Unit 13.
F. There are open ground receptacles in Units 9, 12, 13 and 14.
G. The hot and neutral conductors are reversed in the receptacles of Units 8, 9 and
14.
H. The receptacle boxes in Units 7, 8, 10, 11 and 13 are not fastened securely to the
wall.
I. Provide electrical cover plate for Unit 8.
J. Reconnect the EMT electrical coupling on the exterior wall facing "H" Street.
K. The electrical junction boxes on the exterior west wall of the building are not
listed electrical boxes for use in wet location.
1. The cover plates for the junction boxes are not listed for wet location.
Provide cover plates listed for use in wet location.
2. The flexible metal conduit and the fittings are not listed for wet location.
Provide EMT or other listed raceways for use in wet location with the appropriate
fittings.
L. The exterior subpanel on the north wall is missing a dead front panel. Provide
a dead front panel.

7. Substandard or Hazardous Plumbing. [SBMC 15.04.020, UHC 1001(f)]
A. The kitchen sink in Unit 10 is missing a P trap. Provide a P-trap for the kitchen
sink in Unit 10.
B. The P trap in the bathroom lavatory is missing. Provide P trap for lavatory sink
in Unit 4.
C. There is no hot water supply to the lavatory in the bathroom of Unit 10.
D. The hot water supply line to Unit 10 is missing a shut off valve. Provide hot
water shut off valve.
E. The drain pipe in the kitchen sink of Unit 8 is leaking. Repair** or replace the
kitchen drain.
F. All the water heaters (14) need some or all of the following corrected:
A. No vent connector, vent connector not connected or not connected in an
approved manner.
B. When 2 dissimilar metals are installed together, A dielectric union is
required to prevent galvanic action. Provide a dielectric union on the
water heater supply line between the galvanized and copper pipe.
C. Provide seismic strappings for the water heater.
D. The plastic and brass slip joint coupling on the water heater and water
supply line are not approved connectors. Provide approved method of
connection on the water supply lines.
E. Provide pressure and temperature relieve valve.
F. Provide a discharge piping from the pressure and temperature relieve
valve 6 to 24 inches from the ground.
G. Water heater enclosure is lacking the minimum combustion air required
for the enclosure. Provide 100 square inches at top and bottom of the
door.
H. Provide the required pipe support for all the water supply line.

S. Substandard or Hazardous Mechanical Equipment. Provide missing bottom grill to
the wall heaters in Units 6, 7, 8, 9, 10, 11 and 13. [SBMC 15.04.020, UHC 1001(8)]
9. Faulty Weather Protection. Replace all broken windows on the southwest wall of Units
8 and 9. [SBMC 15.04.020, UHC 1001(h)]
10. Inadequate or Unsafe E.-dt Facilities. The exit doors on "H" street and Victoria Street
are nailed shut on most of the Units. Provide operable doors and locksets to the exit
doors. [SBMC 15.04.020, UHC 1001(i)]
11. Inadequate Fire-protection or Equipment. Provide exterior fire extinguishers (Type
2AlOBc) with common access within 75 feet of all units, or provide a 1Al0BC fire
extinguisher in each unit. The fire extinguisher is missing from the cabinet in the court
yard. [SBMC 15.04.020, UHC 1001(m) and 901; UFC 1002]
12. Inadequate Emergency Egress From Sleeping Rooms. Security Bars on emergency
escape windows in bedrooms must be openable from the inside by means of approved
release mechanisms which do not require a key, or any special knowledge or effort to
operate (applies to one approved window per bedroom). Obtain approval from the Fire
Department for release mechanisms and obtain building permits and inspection. (SBMC
15.04.020, UHC 801, and UBC 310.4)
A. The security bar in Unit 13 is unlockable. Repair or replace the security bars.
B. The security bars in Units 12 and 13 are blocking the escape windows with a
minimum net clear openable width dimension of 20 inches. Remove or increase
the openable security bars to increase the net clear openable width dimension.
13. Construction Without Required Permits or Inspections. [SBMC 15.04.020, UAC
301(a) and 305]
A. The exterior lights on the exterior of the building was installed without permits.
Obtain permit for the exterior lights.
B. The copper water supply lines running along the exterior of the building is
installed without permits. Obtain permit for the water supply line.
1. The plastic and brass compression coupling are not an listed coupling.
Remove the coupling and use an approved coupling or union. Use a dielectric
union on the water supply line between the galvanized and copper pipe.

2. The copper supply lines have no pipe support. Provide pipe support for the
water supply lines.
C. The gas line running from the water heater enclosure to Unit 14 is installed
without permit and substandard. Remove this gas line.
14. Lack of Adequate Heating Facilities. The wall heater in Unit 14 is missing. Provide
a wall heater in Unit 14. [SBMC 15.04.020, UHC 1001(b)6]
15. Infestation of Insects, Vermin, or Rodents. Fumigate Units 3, 4, 7, 8, 9 and 11.
[SBMC 15.040.020, UHC 1001(b)12] -
16. Inoperable or Missing Smoke Detectors. The smoke detectors are inoperable in Units
3, 4, 7, 8, 10, 11, 13 and 14. Provide operable smoke detector for all Units. (SBMC
15.04.020, UBC Appendix 3411)
A hearing in regards to this abatement action has been scheduled for THURSDAY. OCTOBER
3, 1996 AT 9:00 A N1 before the Board of Building Commissioners, at 300 North "D" Street,
City Council Chambers, San Bernardino, California, 92418. Evidence will be presented by staff
at this hearing pertinent to the summary action and the costs of abatement incurred by the City.
You may be, but need not be, represented by legal counsel. You may present any relevant
evidence or have witnesses testify at this hearing to challenge the abatement.
A "Notice of Pendency/Notice of Substandard or Dangerous Building" has been filed with
the County Recorder to give public notice of the action taken by the City. A processing fee is
automatically assessed at the time of recordation.
The direct costs incurred by the City for this abatement action are attached for your review. If
the abatement action and costs are upheld by the Board of Building Commissioners, the City will
place an assessment lien on the above referenced property for all costs incurred. To avoid the
placement of a lien, the incurred costs must be paid to the City Clerk's Office at 300 North
"D" Street, Second Floor, San Bernardino, California, 92418, within 15 days from the date
of the Board of Building Commissioners ruling.
If you disagree with the decision of the Board, you may appeal your case before the Mayor and
Common Council. Your appeal must be submitted in writing to the City Clerk within 15 days
of the Board's ruling. A fee of$75.00 must accompany your appeal. Your written appeal must
include the case number, property location, the specific items appealed and grounds therefore,
and the relief or action sought from the Mayor and Common Council.
