CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
BACKGROUND
Rental Housing staff inspected the property on March 28, 1996 and issued a Notice and Order
to the owner of record, Mr. T.J. Haga, on April 8, 1996 for numerous violations of the San
Bernardino Municipal Code. A Notice of Pendency (NOP) was prepared the same day and
eventually filed with the County Recorder on April 17, 1996. Concurrently to this action, and
unbeknownst to the inspector, the property was being purchased through a tax sale and being
transfered to a new owner, the appellant Mr. Muhammad Yunis. The appellant purchased the
property from the County Tax Collector at public auction on March 5, 1996, but the Tax Deed
was not recorded until April 9, 1996. Because of this delay in recording, the ownership
information that staff received from the title company did not indicate the change of ownership.
This matter was later set for hearing before the Board of Building Commissioners due to
noncompliance. Again, the appellant was not notified of this action due to the inaccurate title
report. The Board issued Order No. 3755 (Attachment B) and confirmed the costs incurred by
the City (Attachment D).
The appellant has since obtained a building permit to rehabilitate the structure and has
commenced work.
APPELLANT'S STATED GROUNDS OF APPEAL
That the new owner was not provided legal notice of the abatement proceedings.
ACTIONS SOUGHT BY APPELLANT FROM THE MAYOR AND COMMON COUNCIL
1. Revocation of BBC Order No. 3755 and the waiver of the incurred costs ($493.97)
relative to BBC Order No. 3755.
2. Waive any liens and cancel any orders by the City of San Bernardino prior to the
appellant's ownership.
ANALYSIS
The Notice of Pendency relating to the abatement action resulting in BBC Order No. 3755 was
filed after the transfer of the property and recordation of the tax deed. The appellant was not
legally served with notice of the abatement action. Therefore, due process of law has not been
provided and the Order is legally defective.
Further, the appellant asks that all prior liens and orders by the City be cancelled. Prior to the
most recent action, the Code Enforcement Division had undertaken several abatements dating
back to 1992. The appellant has not submitted any evidence questioning the validity of the prior
orders, and therefore they should stand until all violations noted therein are cleared. The City
Clerk's records indicate that 3 prior liens were paid off on April 17, 1996 (Attachments E, F, and
G). The Clerk's records also indicate that $909.65 are still owed to the City for interest on the
prior liens and for one unrecorded lien. Accrued interest is charged on liens in accordance
SBMC 3.68.010. The costs are broken down as follows:

regards to the property located at 147 E. 5th Street. Attached hereto is a copy of the Board of
Building Commissioners' Order, which states the findings of the Board and any required
corrective actions.
As owner and all vested parties of record you were notified in your previous Notice of Hearing
that the Board's findings may be appealed to the Mayor and Common Council within fifteen(15)
days of the date of this notice. This appeal must be filed with the City Clerk's office, 300 North
"D" Street, 2nd Floor, San Bernardino, CA 92418. A fee of $75.00 must accompany your
request. The written appeal should include:
(a) Property location, parcel number, order number, and case number;
(b) Specific grounds for appeal; and

4 WHEREAS, pursuant to the San Bernardino Municipal Code, Title
5 15, Chapter 15 . 04 , 15 . 24 and 15 . 28, the Building Official has
6 posted a property located at 147 E. 5th Street, San Bernardino,
7 California, with a "Notice and Order" and has notified the
8 person (s) having an interest in said property that the said
9 building or premises is in violation of San Bernardino Municipal
10 Code (SBMC) and constitutes a public nuisance;
11 WHEREAS, pursuant to San Bernardino Municipal Code, the
12 Building Official has served a "Notice of Hearing" before the
13 Board of Building Commissioners, of the City of San Bernardino,
14 relating o abatement

3 NOW THEREFORE, IT IS ORDERED BY THE BOARD OF ,BUILDING
4 COMMISSIONERS OF THE CITY OF SAN BERNARDINO AS FOLLOWS :
5 SECTION 1 - FINDINGS :
6 Based upon the evidence submitted, the Board finds that the
7 violations noted in the Notice of Hearing do in fact exist on the
8 property located at 147 E. 5th Street, San Bernardino, California
9 and is being maintained and occupied in violation of SBMC, and
10 therefore constitutes a public nuisance; and
11 SECTION 2 - ORDER:
12 The Board of Building Commissioners' adopted staff' s
13 recommendations . The property owner shall obtain all necessary
14 Permits for the rehabilitation of the structure within 30 days,
15 and correct all other violations prior to reoccupancy, but no
16 later than 30 days from the date of this order, and if the owner
17 elects not to rehabilitate the structure, the owner shall obtain
18 permits and demolish the structure within 30 days; and
19 SECTION 3 - AUTHORIZATION TO ABATE:
20 If the owner fails to start rehabilitation or demolition
21 Proceedings within 30 days from the date of this order, the
22 structure shall be deemed abandoned, and therefore shall
23 constitute a Dangerous Building as defined by SBMC 15 . 28 . 010 ,
24 UCADB 302 . 12 and 302 . 18 , and the City may take action including
25 demolition to abate the nuisance; and
26 SECTION 4 - CONFIRMATION OF INCURRED COSTS :
27 Due to the owner' s failure to comply within the time frame
28 specified in the original Notice of Order, the owner shall incur

3 all current costs of abatement in the amount of $493 . 9.7 in the
4 form of a lien or personal obligation, which if not paid, shall be
5 recorded with the County Tax Assessor as a special assessment on
6 property.
7 SECTION 5 - RIGHT TO APPEAL :
8 An y P erson a gg rieved by this order, may appeal to the Mayor and
9 Common Council by filing a written statement with the City Clerk.
10 The statement must include the order number appealed, the specific
11 rounds of the appeal,ppeal, and the relief or action sought . This
12 written appeal must be received within fifteen (15) days from the
13 date of this notice dated September 13 , 1996 .
14 SECTION 6 - EXTENSION:

17 order if allowed additional time, the supervising building
18 official may grant an extension of time, not to exceed an
19 additional 120 days, within which to complete said repair,

22 perpetuate a situation imminently dangerous to life or property.

The building official' s authority to extend time is limited to the
24
physical repair, rehabilitation or demolition of the premises and
25 will not in any way affect or extend the time to appeal the notice
26 and order.

THIS NOTICE is hereby served to you as owner or interest holder of the above referenced
property. An abatement hearing in regards to outstanding violations of the San Bernardino
Municipal Code located upon the above referenced property has been scheduled for
THURSDAY, SEPTEMBER 5, 1996 AT 9:00 A.M. before the Board of Building
Commissioners, at 300 North "D" Street, City Council Chambers, San Bernardino,
California, 92418. Evidence will be presented by staff at this hearing pertinent to the
outstanding violations and the costs of abatement incurred by the City. You may be, but need
not be, represented by legal counsel. You may present any relevant evidence or have witnesses
testify at this hearing to challenge the abatement.
Based on the property owner's failure to correct the violations, a "Notice of Pendency/Notice
of Substandard or Dangerous Building" is being Filed with the County Recorder to give public
notice of the action taken by the City. A processing fee is automatically assessed at the time of
recordation.
The direct costs incurred by the City for this abatement action are attached for your review. If
the abatement action and costs are upheld by the Board of Building Commissioners, the City will
place an assessment lien on the above referenced property for all costs incurred. To avoid the
placement of the lien, the incurred costs must be paid to the City Clerk's Office at 300 North
"D" Street, Second Floor, San Bernardino, California, 92418, within 15 days from the date
of the Board of Building Commissioners ruling.

If you disagree with the decision of the Board, you may appeal your case before the Mayor and
Common Council. Your appeal must be submitted in writing to the City Clerk within 15 days
of the Board's ruling. A fee of$75.00 must accompany your appeal. Your written appeal must
include the case number, property location, the specific items appealed and grounds therefore,
and the relief or action sought from the Mayor and Common Council.
On July 9, 1996 the property owner of record was notified that violations of the San Bernardino
Municipal Code exists on the property. The owner was requested to correct the violations within
a specified time period. On August 15, 1996 a subsequent inspection revealed that the requested
corrections were not completed. The outstanding violations include the following:
OUTSTANDING VIOLATIONS
1. Lack of Required Landscaping and Unmaintained Landscaping. Landscape the front
and side yards with shrubs, groundcover, decorative rock, redwood bark, and/or lawn.
Maintain the landscaping by including a regular irrigation plan. Plant lawns on all barren
dirt areas in front, rear, and side yard areas. (SBMC 15.24.040 Al & A2).
2. Weeds and Overgrown Vegetation. Maintain the landscaping with weed removal from
the planters, perimeter and cross fencing, and yard areas. Mow and edge the lawn on
a regular schedule. Prune all trees and shrubs in an orderly fashion.
(SBMC 15.24.040 A3).
3. Accumulation of Trash and Debris in Yards. Remove the abnormal amount of trash
and debris that has collected on the premises. (SBMC 15.24.040 A4).
4.* Dangerous Building-Attractive Nuisance. Abandoned and/or unsecured structure which
constitutes an attractive nuisance to children, or a harbor for vagrants or criminal

boarded to FHA standards. The owner must obtain all necessary permits and rehabilitate
the structure, or demolish the same within 30 days. Failure to rehabilitate or demolish
within 30 days may result in action by the City to abate the abandoned building as a
public nuisance. (SBMC 15.28.010, UCADB 302.12 and 302.18).
This structure has been boarded up for over 180 days. "Immediately" obtain all
necessary permits for the rehabilitation of the structure and correct all violations prior
to reoccupancy, but no later than 30 days, or obtain permits and demolish the structure
within 30 days.
