REQUEST/LOCATION: The applicant requests an amendment to Development Code Section
19.06.020, Table 06.01(K) and Table 06.03(M) to permit self - service mini - storage in the CG -I
land use district with approval of a conditional use permit. In addition the applicant requests
approval of a Conditional Use Permit in conjunction with DCA 98 -02 to construct a 60,488
square foot self - service mini - storage facility with a living unit for the hired manager. Also
requested are variances to reduce the rear setback of 10' to 0' and the north and south side
setbacks from 10' to 0' and 6' respectively. The 79,820 square foot property is located at the
intersection of Palm Avenue and Bessant Avenue in the CG -1 land use district. The project will
be constructed in two phases:
Phase I: Construction of six (6), 10' high single story storage buildings around the property
perimeter & one two -story managers unit. A 40 space RV parking area is proposed in Phase 1, to
be removed upon construction of the Phase II building.
Phase II: Construction of a 3 level, 30' high storage building in the interior of the site.
COMMENTS RECEIVED: Mr. Gordon Nelson, a neighbor along the south property line
was concerned about people walking along the 6'easement adjacent to his properties. Condition
of Approval #11 was added which requires that 6' tall fencing be constructed at either end of the
easement to prohibit access to the area. Mr. William Grubbs requested access through the project
to one of two parcels he owns to the north of this project, however his request was not
accommodated because he already has access between his two parcels. Several people at the
hearing were concerned about the height and design of the buildings. The Planning Commission
took these concerns into consideration when evaluating and recommending approval of the
project.
ENVIRONMENTAL DISCUSSION: The ERC reviewed the initial study on July 2, 1998 and
determined that the project could not have a significant effect on the environment and
recommended a Negative Declaration. The public review period was from July 9, 1998 to July
28, 1998 and no comments were received.
PLANNING COMMISSION RECOMMENDATION: The Planning Commission voted 6 to
0 (Durr, Garcia, Hendrix, Lockett, Suarez & Thrasher) to recommend adoption of the Negative
Declaration and approval of Development Code Amendment No. 98 -02, Conditional Use Permit
No. 98 -12 & Variance No. 98 -08 based upon the Findings of Fact, subject to the Conditions of
Approval and Standard Requirements in the September 22, 1998 staff report (Exhibit 2).
RECOMMENDATION: Staff recommends that the Mayor and Common Council adopt the
Negative Declaration and approve Development Code Amendment No. 98 -02, Conditional Use
Permit No. 98 -12 & Variance No. 98 -08, based upon the Findings of Fact, subject to the
Conditions of Approval and Standard Requirements.

REQUEST AND LOCATION

The project will be constructed in two phases:

SETTING /SITE CHARACTERISTICS
This project is on a vacant, relatively flat site, that gradually slopes to the southwest. It is bounded on
3 sides on the north, east and south with residences in the City of Highland. To the west is Cole
Elementary School located within the City.
BACKGROUND
This project was initially reviewed by the Development Review Committee (DRC) on June 11th,
1998. An Initial Study was prepared and presented to the Environmental Review Committee (ERC)
on July 2, 1998. After the required 21 day review period, no comments were received about the
project and at the August 6th ERC /DRC meeting, the project was cleared to Planning Commission.
Because of its proximity to the City of Highland, Staff recommended to the applicant to contact the
City of Highland regarding their views on the project. The applicants met several times with Highland
decision - makers and were able to reach consensus on the project. A letter was received from the City
of Highland outlining their concerns and recommendations and is included as Attachment G. A
discussion of the recommendations is included under CUP Finding of Fact #5.

FINDINGS AND ANALYSIS
DEVELOPMENT CODE AMENDMENT
1. The proposed amendment is consistent with the General Plan.
The use is consistent with General Plan Policy 1.19.10 which states:
"Permit a diversity of community- serving retail and service uses ... in areas designated as Commercial
General. "
The use is a commercial service provided for small businesses, and residents who need additional
space for personal effects.
2. The proposed amendment would not be detrimental to the public interest, health, safety,
convenience, or welfare of the City.
The project as designed is consistent with existing specific standards for self - service mini- storage as
outlined in Development Code Section 19.06.030(2)(M), except as requested under Variance No. 98-
08. All agencies responsible for reviewing access, and providing water, sanitation and other public
services have all had the opportunity to review the proposal, and none have indicated an inability to
serve the project. The proposal will not be detrimental to the public health and safety in that all
applicable Codes will apply to the construction of this project.
CONDITIONAL USE PERMIT
1. The proposed use is conditionally permitted within, and would not impair the integrity and
character of the of the subject land use district and complies with all of the applicable
provisions of this Development Code.
Pursuant to the proposed amendment to Development Code Section 19.06.020, Table 06.01(K) and
Table 06.03(M), self - service mini - storage would be permitted in the CG -1 land use district subject to
the approval of a conditional use permit. The proposed project complies with all applicable
provisions of the Development Code as shown in Attachment C, except for those areas that are
requested to be modified under Variance No. 98 -08.
2. The proposed use is consistent with the General Plan.

3. The approval of the Conditional Use Permit for the proposed use is in compliance with the
requirements of the California Environmental Quality Act and Section 19.20.030(6) of the
Development Code.
A Negative Declaration is proposed for project and no mitigation is required.
4. There will be no potentially significant negative impacts upon environmental quality and
natural resources that could not be properly mitigated and monitored.
As noted on the Summary page and in Finding #3, a Negative Declaration is proposed for this project
and no mitigation is required.
S. The location, size, design, and operating characteristics of the proposed use are compatible
with the existing and future land uses within the general area in which the proposed use is to
be located and will not create significant noise, traffic or other conditions or situations that
may be objectionable or detrimental to other permitted uses in the vicinity or adverse to the
public interest, health, safety, convenience, or welfare of the City.
The proposal is in compliance with all applicable Development Code Standards except where
variances are requested, and is consistent with the General Plan as noted elsewhere in this staff
report. Staff supports this proposal because it is a low intensity use that would generate minimal
traffic, noise and ambient light. The applicant anticipate that 4 to 6 employees will work at the site,
with a resident manager living on the premises. Although the hours of operation are restricted by the
Development Code to lam to 9pm Monday through Saturday and 9am to 9pm Sundays, the applicant
has indicated that it is their intent to operate only during daylight hours.
Staff has reviewed the letter from the City of Highland and based on a meeting between City staff,
City of Highland and the applicant and provides the following resolution to each requested condition:
1 -6. are covered under the Public Works Standard Requirements.
7. landscaping will be consistent with City of San Bernardino landscape design
guidelines and is reflected under the Conditions of Approval. Staff believes the
landscaping will be consistent with City of Highland's standards.

8. The design of the project has been refined to reflect the concerns of the City of
Highland.
9. Allowable project signage must comply with Development Code requirements
which allows a monument sign 32 square feet in size and a maximum of 8' tall.
High profile pole signs are not permitted.
6. The subject site is physically suitable for the type and density /intensity of use being proposed

evidenced by project compliance with all applicable Development Code Standards as noted above.
7. There are adequate provisions for public access, water, sanitation, and public utilities and
services to ensure that the proposed use would not be detrimental to public health and safety.
All agencies responsible for reviewing access, and providing water, sanitation and other public
services have all had the opportunity to review the proposal, and none have indicated an inability to
serve the project. The proposal will not be detrimental to the public health and safety in that all
applicable Codes will apply to the construction of this project.
Staff received a letter from the applicant on September 16th, 1998 (Attachment H) requesting removal
of Public Works Standard Requirement 3(d) which requires the applicant to underground utilities
along the site frontage. However, since it is a Code requirement, it cannot be waived by the Planning
Commission.
VARIANCE
1. That there are special circumstances applicable to the property, including size, shape,
topography, location or surroundings, the strict application of this Development Code deprives
such property of privileges enjoyed by other property in the vicinity and under identical land
use district classification.
The west and north property lines are proposed for reduction from 10' to 0' since, as designed, the
walls of the mini - storage buildings will act as the buffer to existing residences and the school. The
south property line setback is proposed to be reduced to 6' but only along approximately 60' of a
220' distance. There is a 6' wide utility easement that prohibits reduction of the setback any closer to
the property line. Locating the walls on the property line will eliminate places for criminals to hide or
children to get into mischief.
2. That granting the Variance is necessary for the preservation and enjoyment of a substantial

property right possessed by other property in the same vicinity and land use district and denied
to the property for which the Variance is sought.
Eliminating the setbacks will screen the use from the surrounding sensitive uses and will allow
efficient development up to the permitted lot coverage of 50 %.
3. That granting the Variance will not be materially detrimental to the public health, safety, or
welfare, or injurious to the property or improvements in such vicinity and land use district in
which the property is located.
The variance will not allow a use that is not permitted by the Development Code. The proposal will
not be detrimental to the public health and safety in that all applicable Codes will apply to the
construction of this project.
4. That granting the Variance would not constitute a special privilege inconsistent with the
limitations upon other properties in the vicinity and land use district in which such property is
located.
Other properties have been permitted reduced setbacks where it was shown that screening walls were
necessary and landscape setbacks would be ineffective.
S. That granting the Variance would not allow a use or activity which is not otherwise expressly
authorized by the regulations governing the subject parcel.
A self - service mini - storage is allowed with approval of a CUP and no additional unpermitted land
uses will be allowed or are considered as part of this project.
6. That granting the Variance will be consistent with the General Plan.

CONCLUSION
The proposal meets all necessary Findings of Fact for approval of the Development Code
Amendment, Conditional Use Permit and Variance.

RECOMMENDATION
Staff recommends the Planning Commission:
1. Recommend that the Mayor and Common Council adopt the Negative Declaration;
2. Recommend that the Mayor and Common Council approve Development Code Amendment
No. 98002, Conditional Use Permit No. 98012 and Variance No. 98008, based upon the
Findings of Fact contained in this Staff Report and subject to the Conditions of Approval
(Attachment D) and Standard Requirements (Attachment E).

CONDITIONS OF APPROVAL
DCA No. 98 -02, CUP No. 98 -12 & VAR No. 98 -08
1. Within two years of development approval, construction on improvements shall have been
completed or the permit /approval shall become null and void. In addition, if after commencement
of construction, work is discontinued for a period of 6 months, then the permit /approval shall
become null and void. Phasing of project construction/development shall be as follows:

Expiration: September 22, 2000
2. The review authority may, upon application being filed 30 days prior to the expiration date and
for good cause, grant a one time extension not to exceed 12 months. The review authority shall
ensure that the project complies with all current Development Code provisions.
3. In the event that this approval is legally challenged, the City will promptly notify the applicant
of any claim or action and will cooperate fully in the defense of the matter. Once notified, the
applicant agrees to defend, indemnify, and hold harmless the City, its officers, agents and
employees from any claim, action or proceeding against the City of San Bernardino. The
applicant further agrees to reimburse the City of any costs and attorneys' fees which the City may
be required by a court to pay as a result of such action, but such participation shall not relieve
applicant of his or her obligation under this condition.
4. Construction shall be in substantial conformance with the plan(s) approved by the Director,
Development Review Committee, Planning Commission or Mayor and Common Council. Minor
modification to the plan(s) shall be subject to approval by the Director through a minor
modification permit process. Any modification which exceeds 10% of the following allowable
measurable design/site considerations shall require the refiling of the original application and a
subsequent hearing by the appropriate hearing review authority if applicable:
a. On -site circulation and parking, loading and landscaping;
b. Placement and /or height of walls, fences and structures;
C. Reconfiguration of architectural features, including colors, and /or modification of finished
materials that do not alter or compromise the previously approved theme; and,

d. A reduction in density or intensity of a development project.
5. No vacant, relocated, altered, repaired or hereafter erected structure shall be occupied or no
change of use of land or structure(s) shall be inaugurated. or no new business commenced as
authorized by this permit until a Certificate of Occupancy has been issued by the Department.
A temporary Certificate of Occupancy may be issued by the Department subject to the conditions
imposed on the use, provided that a deposit is filed with the Department of Public Works prior
to the issuance of the Certificate, if necessary. The deposit or security shall guarantee the faithful
performance and completion of all terms, conditions and performance standards imposed on the
intended use by this permit.
6. This permit or approval is subject to all the applicable provisions of the Development Code in
effect at the time of approval. This includes Chapter 19.20 - Property Development Standards,
and includes: dust and dirt control during construction and grading activities; emission control
of fumes, vapors, gases and other forms of air pollution; glare control; exterior lighting design
and control; noise control; odor control; screening; signs, off- street parking and off - street loading;
and, vibration control. Screening and sign regulations compliance are important considerations
to the developer because they will delay the issuance of a Certificate of Occupancy until they are
complied with. Any exterior structural equipment, or utility transformers, boxes, ducts or meter
cabinets shall be architecturally screened by wall or structural element, blending with the building
design and include landscaping when on the ground.
7. The developer is to submit a complete landscape and irrigation plan (5 sets) to the Public Works
Department with the required fee for review (Note: issuance of a building permit by the
Department of Planning and Building Services does NOT waive this requirement). No grading
permit will be issued prior to approval of the landscape and irrigation plans. The landscape and

1. Drainage and Flood Control
a) A local drainage study will be required for the project. Any drainage

entitlements: An amendment to the Development Code to permit self - service mini - storage in the
CG -1 land use district with approval of a conditional use permit; Construction of a 60,488 square
foot self - service mini- storage facility consisting of 7 storage buildings and a living unit for an on-
site manager on a 1.83 acre site. The project will be constructed in two phases: Phase I -
construction of six (6), 10' high single story storage units around the property perimeter & one
two -story managers unit. Phase II - construction of a 3 level, 30' high storage building in the
interior of the site. A 40 space RV parking area is proposed in Phase I, to be removed upon
construction of Building #8. Also requested is a variance to permit a reduction of the north side
setback and the rear yard setback from 10' to 0', a reduction of a portion of the south side setback
from 10' to 6' and a variance to allow an increase in the maximum lot coverage from 50% to
75%.

EVALUATION OF ENVIRONMENTAL IMPACTS
I. (a). The Development Code currently does not permit the construction of self - service mini- storage
in the CG -1 land use district. Development Code Amendment No. 98 -02, if approved, would modify
Table 06.01, 19.06.020(x) to add "Self- service mini storage" as a conditionally permitted use. The
requirement for approval of a conditional use permit would allow the City and other agencies to add
conditions of approval to this project and any future project to minimize/mitigate conflicts with
surrounding uses.
III. (c). All grading will be in compliance with Public Works Standard Requi yments for grading and
erosion control.
XIII. (b). This proposed mini- storage is located in a unique location: a parcel of land within the City
of San Bernardino that is surrounded on three sides by property in the City of Highland. There have been
concerns raised about the appropriateness of the use in that area. To minimize its visual impacts on Palm
Avenue, the applicant has designed the site so that the architecture of the managers unit is similar to the
older homes in the area. Further, a front yard setback greater than that of adjacent homes has been
provided so as to blend with the neighborhood and avoid creating a visual block on the street.
XIII. (c). Development Code Section 19.20.030(14) requires that all proposed lighting shall be shielded
and recessed so that all direct glare and reflections are contained within the boundaries of the parcel anc'
shall be directed downward and away from adjoining properties and public rights -of -way. This projec
will comply with this Code requirement.

5. Install an underground drainage pipe or construct a concrete drainage ditch from
the southwest corner of the project westerly to Cole Street, including under the
public sidewalk, to handle the water runoff from the project/property. Construct
grading as necessary along the drainage system to prevent surface runoff from
entering adjoining property.
6. Obtain permission from San Bernardino Unified School District to construct and
maintain the drainage improvements described in item No. 5 above by the
developer.
7. Landscaping along Palm Avenue shall be consistent with the City of Highland
Landscape Design Guidelines regarding type of material, number, and size of
plants (a copy of which has been enclosed for reference).
8. The design of the project shall be commensurate with the building and structures
of the City of Highland's Historic District and plans submitted for review by the
City Council at a Study Session on July 28, 1998.
9. Any proposed building identification and/or freestanding sign shall be
commensurate in design with the buildings of the project. A low profile
monument type of sign would be consistent with the signs of the area and
Highland regulations.

Pursuant to our meeting with the City of Highland we have visited the site with Southern
California Edison Service Planner, Mr. Frank lasso.
Today we found that only one utility pole lands on our site frontage, and south property
line. At our meeting with Mr. lasso it was discussed and agreed that the pole would be
removed and the services existing would be undergrounded along Palm Avenue, thus
satisfying the city's approval condition.
However, Mr. Jam and an affected neighbor were ambivalent about the proposed
removal of the single pole which serves only two homes on the South side. This is due to
the short run of approximately 225' to dig down at the Frazee Center then rise at the
school property. it is our opinion, and possibly theirs, that the service disruption caused
to so many properties by the undergrounding of the two existing utility lines is not
warranted, Also, please note that CATV and telephone lines would be required to be
placed in an Edison easement causing further service disruptions.
We ask that you please remove the requirement of undergrounding the utilities on the
South side, We in turn offer landscape on our side of the screen wall with additional
screening trees which will not conflict with the overhead services.
Please do not continue our hearing on September 22r4 to a later date, and do present the
above alternate condition of approval in lieu of the utility undergrounding on the South
side. We ask this in order that we may then proceed with our project schedule.
