Currently, San Bernardino Municipal Code §5.04.005 makes it unlawful for any person to
commence or carry on business in the City without procuring a registration certificate from the City
or without complying with any or all regulations of such business. The current language implies that
the person must either procure a registration certifi rocure thee regist ation cert ficate and
business. The amendment will require the person to both P
comply with business regulations. The amendment is necessary because in certain types of
businesses, such as soliciting, more than just a registration certificate is necessary to comply with
business regulations.

SECTION I. Section 5.04.005 is hereby amended to read as follows:
5.04.005 Registration Certificate.
It is unlawful for any person, whether as principal or agent, clerk or
employee, either for himself or for any other person, or for any body corporate,
or as an officer of any corporation, or otherwise, to commence or carry on any
business, show, exhibition or game, specified in this Article, in the City, without
first having procured a registration certificate from the City and without complying
with any and all regulations of such business, show, exhibition or game contained
in this Article; and the carrying on of any business, show, exhibition or game
mentioned in this Article without first having procured a registration certificate
from the City, and without complying with any and all regulations of such
business, show, exhibition or game contained in this Article shall constitute a
separate violation of this Article for each and every day that such business, show,
exhibition or game is so carried on."
