STAFF REPORT
SUBJECT:
Public Hearing 10:00 A.M., and Resolution Creating Underground Utility District No. 27, 40n Street.
BACKGROUND:
The proposed formation of Underground Utility District No. 27, located along portions of 40Th Street between
Electric Avenue and Waterman Avenue, was recommended by the Underground Utility District Committee at
the September 3, 1998 meeting.
Southern California Edison Company is required by rule 20 of the Public Utilities Commission to set aside
certain portion of its revenues to finance the cost of undergrounding overhead facilities within districts
established by local agencies. Each agency is allocated a certain amount of funds based upon the total number
of overhead services within the agency's boundaries. The Underground Utility Committee reviews and
designates areas proposed for the establishment of a district.
Underground utilities improve the appearance of a street by removing a clutter of overhead utility poles and
lines. It also eliminates the hazard from lines falling to the ground, which is a result from windstorms and
earthquakes and thunderstorms.
On November 2, 1998, the Mayor and Common Council gave authorization to proceed and Resolution No. 98-
309 was adopted, setting a public hearing for December 21, 1998. All affected property owners and utility
companies were given notice by mail.
Property owners within the district will be required to complete the undergrounding from their property lines to
the service points at their own cost. No City funds will be required for this project. There are approximately 2
parcels that will need to convert their utility services from overhead to underground.

None
RECOMMENDATION:
It is recommended that the hearing be closed and that the attached Resolution Creating Underground District
No. 27 be adopted.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
;AN BERNARDINO CREATING UNDERGROUND UTILITY DISTRICT NO. 271)
3ENERALLY LOCATED ALONG PORTIONS OF 40TH STREET, BETWEEN
ZLECTRIC AVENUE AND WATERMAN AVENUE.
WHEREAS, a public hearing was held on December 21, 1998 at 10:00 a. m. or as soon
6 thereafter, at the Council Chambers, 300 North "D" Street, San Bernardino, Calitorma, to
7
determine whether the public necessity, health, safety or welfare required the formation of an
8
9 Underground Utility District No. 27 located along portions of 40"' between Electric Avenue and
10 Waterman Avenue, San Bernardino, California; and
11 WHEREAS, notice of said hearing has been given to all affected property owners as
12
shown on the last equalized assessment roll and to all utilities concerned in the manner and for
13
the time required by law; and
14
15 WHEREAS, said hearing has been duly and regularly held and all persons interested
16 have been given an opportunity to be heard.
17 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
18 OF SAN BERNARDINO AS FOLLOWS:
19 SECTION 1. It is hereby found and determined pursuant to Chapter 13.36 of the San
20 Bernardino Municipal Code of the City of San Bernardino, and to definitions contained therein
21 that the public necessity, health, safety and welfare require the formation of an underground
22
3 utility district, located along said public streets as described herein, in order to remove utility
2
24 poles, overhead wires and associated structures and to underground utilities along said portions
25 of said streets.

RESOLUTION CREATING UNDERGROUND UTILITY DISTRICT NO. 27 ALONG PORTIONS OF 40T11
STREET BETWEEN ELECTRIC AVENUE AND WATERMAN AVENUE

2 SECTION 2. An underground utility district to be known as Underground Utility
3
District No. 27 is hereby established in that area located along portions of 40Th Street between
4
5 Electric Avenue and Waterman Avenue, and more particularly shown on amended Drawing No.
6 9893 by the Engineering Division, Department of Development Services, City of San
7 Bernardino, on file in the office of the City Clerk's office of the City of San Bernardino.

SECTION 3. All poles, overhead wires and associated overhead structures shall be
9
removed and underground installations made in said underground utility district within the
10
11 following times:
12 a. Underground installation by utility companies and property owners and
13 construct reconnections not later than July 30, 1999.
14 b. Removal of poles, overhead wires and other associated structures not
15
16 later than September 30, 1999
17 SECTION 4. The City Clerk is hereby directed to mail or cause to be mailed a copy
18 hereof and a copy of Chapter 13.36 of the San Bernardino Municipal Code at the City of
19 San Bernardino, to all affected property owners as shown on the last equalized
20
assessment roll and to all affected utilities within ten (10) days after the adoption of this
21
resolution.
