STAFF REPORT
SUBJECT: Resolution awarding a contract to Doug Martin Contracting Company, Inc. for
pavement rehabilitation by slurry seal method Phase V: 27th Street to Edgehill between
Muscupiabe Drive and Little Mountain; and, 5th Street to Baseline between Terrace Road and
Meridian Avenue.
BACKGROUND: An allocation is made each year in the 126 Gas Tax Fund and the 129 1/2-
Cent Sales Tax Fund for the rehabilitation of various streets within the community. In a joint
effort, the Departments of Development Services and Public Services review and recommend
streets for rehabilitation. Factors considered are: traffic volumes; condition of street; method
to be used; service life of pavement; improvements to be realized with the rehabilitation method;
and available funding. The areas selected for the fifth phase of this project are residential
neighborhoods located in the north - central and west sides of the community. It has been many
years since originally paved and will benefit from sealing of cracks and slurry sealing the streets.
The Development Services and Public Services Departments have determined that significant
useful life remains for this pavement, provided restoration and rehabilitation is completed in the
near future; these streets have been rated average (3) under the City rating system. Traffic
volumes, condition of the existing street and life cycle analysis conclude that slurry seal is the
most appropriate and cost effective method to restore these streets and extend their useful life.
The project will consist of grinding those cracks in the street that cause a bump or rough ride,
sealing the cracks with an appropriate sealer, cleaning the street and applying a slurry seal that
is a pavement restorative and weather seal.
Bids for the project were received and opened at 2:00 p.m. on Tuesday, September 22, 1998.
A total of 3 bids were received and ranged from a low of $280,463.00 to a high of $324,939.90.
The low bid is 8.64% over the Engineer's Estimate of $258,150. Bidders indicated that
preparation of the cracks caused the bids to be higher for this project.
The estimated costs based on the Low Bid for Construction Costs are as follows:

FINANCIAL IMPACT: Funding for the cost of this project is in the 1/2 -Cent Sales Tax Fund
(129 -367. -5504 -7101) in a carryover amount of $500,000, and $500,000 in New Allocations.
Additional areas have been identified and will be brought forward after award in order to utilize
remaining funds and carryovers from previous years.
RECOMMENDATION: Staff recommends adoption of the Resolution.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AWARDING A CONTRACT TO DOUG MARTIN CONTRACTING
COMPANY, INC. FOR PAVEMENT REHABILITATION BY SLURRY SEAL METHOD
PHASE V, 27TH STREET TO EDGEHILL BETWEEN MUSCUPLABE DRIVE AND
LITTLE MOUNTAIN; AND 5TH STREET TO BASELINE BETWEEN TERRACE ROAD
AND MERIDIAN AVENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF I
SAN BERNARDINO AS FOLLOWS:
SECTION 1. DOUG MARTIN CONTRACTING COMPANY, INC. is the lowest
responsible bidder for: Pavement rehabilitation by slurry seal method Phase V - -27th Street to
Edgehill between Muscipiabe Drive and Little Mountain; and 5th Street to Baseline between
Terrace Road and Meridian Avenue per Plan No. 9849. A contract is awarded accordingly to
said bidder in a total amount of $280,463, but such award shall be effective only upon being
fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is
hereby authorized and directed to execute said contract on behalf of the City; a copy of the
contract is on file in the office of the City Clerk and incorporated herein by reference as fully
as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of the passage of this resolution.
