Reading of Resolutions and Ordinances Deputy City Clerk Sutherland read into the record the titles of all the resolutions and ordinances on the agenda. Invocation/Pledge of Allegiance The invocation was given by Elder Eddie Kelley of Life Way Church Ministries. The Pledge of Allegiance was led by Jade Thomas, who will be a 6th grade student at Lincoln Elementary School this fall. 2. Closed Session Report Chief Assistant City Attorney Grider advised that the Mayor and Common Council would also be acting as the Joint Powers Financing Authority. She stated that the language was included on the first published agenda, but somehow it got left off the revised agenda. Quality of Life Team Update — City Manager's Office Lt. Rich Lawhead and Interim Public Works Director Chris Alanis gave a PowerPoint presentation to the Mayor and Common Council. 4H. Bankruptcy/Strategic Planning Update -- Management Partners Andrew Belknap, Regional Vice President, Management Partners, Inc., reported that the court hearing regarding the Third Amended Disclosure Statement was held on June 16, 2016, and the,main issue was the dispute between the Big Independent Cities Excess Pool (BICEP) and the City. He stated that Judge Jury approved the Disclosure Statement for submittal; however, she requested that additional language be added that summarized the dispute between BICEP and the City. Mr. Belknap stated that the Disclosure Statement Review Period had begun. He stated that ballots would be mailed to creditors on July 29 and that the deadline for ballots to be received and objections filed was September 2. The City's deadline to respond was September 30, and the first confirmation hearing was going to be held on October 14. Following the confirmation hearing, the next date would be confirmation day—the date the Plan would be confirmed and the City could exit bankruptcy protection, which could be by the end of this calendar year. >ow 41. Council Member Nickel stated that as of July 1, the City would no longer have a Fire Department available for enforcement. He asked what additional resources, if any, would be available and what should the public do in terms of reporting. Police Chief Burguan stated that the San Bernardino Police Department would have additional patrols out as they do every year. In addition to that, San Bernardino County Fire would be assigning some of their Fire Marshalls to participate in the enforcement program. He encouraged people to remember that any fireworks north of the 210 Freeway were illegal, and south of the 210 Freeway the only things that were illegal were things that explode or go up in the sky. Police RES. 2016-127 — Resolution of the Mayor and Common Council of the City of San Bernardino Authorizing the Execution of Amendment Number Two to the Vendor Service Agreement Between the City of San Bernardino and Platinum Security, Inc., for Security Guard Services at Various City Parks. Council Member Nickel asked how the City was obligated to provide security at the Metrolink Station. Chief Assistant City Attorney Grider stated that it was her understanding that there was an agreement with SANBAG and that the City built and owned the parking structure and that's where the security guards were patrolling. Council Member Nickel stated that the City should consider charging people to park in the parking structure to offset the cost of any security services it provides through the General Fund. Council Member Marquez stated that the MOU would have to be reviewed because it may contain a provision that prohibits the City from charging for parking. Council Member Marquez asked if the Park Ranger Program would be implemented. Police Chief Burguan stated that they had run several recruitment processes and they had one candidate. He said that this was a stopgap measure to get the services in place now using the existing set-aside money that they had used for the Park Ranger Program; however, they did eventually expect to hire their own employees to provide the services. Chief Burguan stated that he found out that there were some trademarks attached to the term "park ranger," so he would have to come back to the Council in the near future with a different title for that position. Public Comments on Items Not on the Agenda Scott Herring, San Bernardino, spoke in support of the Quality of Life Program. Darren Espiritu, San Bernardino, spoke in support of the Quality of Life Program. Connie Wheeler, San Bernardino, spoke in support of the Quality of Life Program. Larry Guidry, San Bernardino, spoke in support of the Quality of Life Program. Frederick Douglas Bennett, Sr., homeless veteran, spoke in opposition to the Quality of Life Program. He stated that the Police Department was taking people's personal property, locking people up for speaking up about it, and telling them they couldn't come to a public park. He said he was a victim of unlawful seizures, reprisals and discrimination. Robert Porter, San Bernardino, read from his Native Mega -Art book. Betty Jean Long, San Bernardino, stated that someone stole her money and her credit ® card and she wasn't going to put up with it anymore. Scott Olson, San Bernardino, spoke about the vote the Council made authorizing the transfer of a building to the County Fire Department for free (Agenda Item No. 7A); the parking structure at the Metrolink; and the money savings for the City's Fire and Refuse Departments. Darren Espiritu, San Bernardino, thanked the Mayor and Common Council for the positive things they were doing for the City. He stated that he was looking forward to the increased fire services provided by the County; announced that on June 25 the Quality of Life Team would be cleaning up the Waterman Avenue right-of-way from the 210 Freeway to Wildwood Park; and announced that on July 9 there was going to be a park revitalization project at Perris Hill Park. Shirley Harlan, San Bernardino, representing the League of Women Voters of the San Bernardino Area, spoke about their plan to help educate voters about the importance of the City's Charter. Ron Sellers, San Bernardino, stated that in 1810, a Catholic priest named the area San Bernardino, but the City was actually founded in the early 1850s; was thankful for the founding fathers of this country who made it possible to get rid of slavery, and stated that the Service Employees International Union (SEIU) and the California Public Employees' Retirement System (CalPERS) were two of the most corrupt organizations in the country. Benita Rodriguez, San Bernardino, stated that two weeks ago she told the Council that is the residents would like to enjoy their parks, but she was not happy with the way the City just threw the homeless out of the park instead of offering them some kind of assistance. She said she wished the City would reach out to the homeless people and talk to them and try to find a solution to the homeless issue. Sandra Ibarra, San Bernardino, stated that it was great what the Quality of Life Team was doing, but nobody was recognizing the neighborhood associations. She urged residents living in inactive neighborhood association areas to consider reactivating them. She asked the City to also recognize its volunteers who love the City and do what they can with what they can out of the goodness of their hearts and they do it without pay. William Cioci, San Bernardino, stated that signatures had been turned in for an initiative to regulate cannabis in the City that he did not necessarily agree with and he hoped the City could come up with something to counter what was going to be put in front of voters. Mr. Cioci distributed a flyer to the Mayor and Common Council and announced that on Thursday, June 23, 2016, the High Desert Cannabis Association would be holding its I" Annual High Desert Cannabis Industry Summit. He stated that the event was not open to the public; however, he invited the Mayor, Councilmembers, City Manager, City Clerk, and City Attorney to attend. Al Palazzo, San Bernardino, stated that he listened to the budget presentation but did not hear any discussion about creating the conditions that would bring investment, grow the tax base and create jobs in this community so the City could get the revenues it needed. He said he would be suspending his tours because of the heat, but would start giving them again in the fall. Jay Lindberg, San Bernardino, spoke about bringing new businesses to the City; and climate change. ' Moniko Simmons stated that she was homeless for a while and what the City did to the homeless at Seccombe Lake Park was not cool. She said the City of San Bernardino needed to give people places to go like they do in Los Angeles. She said she's tired of everyone thinking homeless people are on drugs and/or alcohol. Jim Smith, San Bernardino spoke about the City moving out of bankruptcy hopefully before the end of the year; the phenomenal report regarding the City's budget; the Quality of Life Team; the transfer to County Fire; and the possibility of a new City Charter. 9. Items to be Referred to Council Committees Council Member Nickel suggested that the Council reconsider the need to conduct a poll of the citizens of the City of San Bernardino to get an understanding of opinions regarding the medical marijuana initiative, to understand the potential likelihood of passage, and whether or not they should take some type of legislative action in response. He asked the City Manager what the process and timeline would be. City Manager Scott stated that the item would be discussed at the July 5, 2016 Council meeting. Council Member Nickel stated that he heard that there may be some discussion with Omnitrans regarding the yellow poles that have been placed down the center of various commercial streets in the City. He suggested it be referred to the Quality of Life Committee.
