Subject:
Set Public hearing to consider fee schedule for invoicing non - permitted alarm users for the first
and all subsequent false alarms.
Background:
On August 23, 1999 members of the police department met with the Legislative Review
Committee. Committee members suggested amending Resolution 99 -173 to include charging
non - permitted alarm users for false alarm responses beginning at the first and subsequent false
alarms. The committee recommended that the fee resolution amendment be referred to the full
council.
Financial Impact:
None
Recommendation:
Set Public Hearing for September 20, 1999 at 10:00 a.m. to consider changes in alarm fees for
non - permitted uses.

PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Mayor and Common Council of the
City of San Bernardino will conduct a public hearing on Monday, October 4, 1999, at
10:00 a.m., in the Council Chambers of City Hall, 300 North "D" Street, San
Bernardino, California. The purpose of the hearing is to receive comments regarding
changes to the alarm fee for non - permitted uses.

STAFF REPORT
Subject:
Amend Resolution to include invoicing non - permitted alarm users for the first and all subsequent
false alarms.
Background:
On July 12, 1999, Mayor Valles and the Common Council adopted Resolution No. 1999 -173,
which specifics authorized fees to be charged by City departments. Part VIII Sections 3 and 4,
identify the fee schedule for false alarm events.
San Bernardino Municipal Code Section 8.81.070 requires every alarm user within the City to
obtain an annual alarm permit. Currently 5,600 residential and business alarm permits have been
issued. Permit holders are entitled to four free false alarm responses. Fifth and subsequent false
alarm responses are billed at a rate consistent with the Resolution. The police department sends
notice to the permit holder after the third and fourth false event, allowing the alarm user the
opportunity to correct a faulty alarm system.
Approximately 2,000 residential and business locations in the City have failed to comply with
the permit requirement. Several of these locations have had five or more false alarm responses
and some have not paid false alarm fines.
On August 23, 1999, members of the police department met with the Legislative Review
Committee (LRC) to discuss the equal application of the false alarm fees to both permitted and
non - permitted alarm users. A consensus was reached by LRC members, who suggested
amending the false alarm fee schedule to include billing non permitted alarm users for the first
and subsequent false alarm responses. It was felt that this was the most appropriate method of
equally applying the alarm ordinance.
Financial Impact:
False alarm fees have proven to be difficult to collect. It is difficult to ascertain the impact
invoicing non- permitted alarm users for the first and subsequent false alarm will have on
revenues. This table shows budget and actual revenue for the last three fiscal years and projected
revenue for FY" 99/00.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
Part I: Animal Control:
SECTION 1. The license fee for each dog not spayed or neutered shall be $25.00. One y(
after the effective date of this resolution, the fee shall become $50.00 annually.
SECTION 2. The license fee for each spayed or neutered dog shall be as follows:
A. $9.00 for a one year period.
B. $15.00 for a two year period.
C. $23.00 for a three year period.
SECTION 3. The license fee for each spayed or neutered dog belonging to a resident 60
years of age or older shall be as follows:
A. $5.00 for a one year period.
B. $10.00 for a two year period.
C. $15.00 for a three year period.
SECTION 4. Owners who show proof of spaying or neutering their dog within sixty days
purchasing an unaltered license pursuant to Part I, Section 1 above shall receive a refund upon
request in the following amount:
A. $13.00 for licenses purchased for $25.00
B. $25.00 for licensed purchased for $50.00

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 5. The following fees shall also apply:
A. A delinquency penalty of $15.00 shall be added to the license fee for failure to license the
dog as provided by Section 6.24.030 of the San Bernardino Municipal Code.
B. A fee of $3.00 shall be charged for any additional tag issued to replace a lost, stolen,
misplaced, or damaged tag.
C. A fee of $3.00 shall be charged for the transfer of ownership of a licensed dog to a new
owner in lieu of a fee for a new license for the remainder to the licensing year in which the
I transfer occurs.
ID. A fee of $3.00 shall be charged for the transfer of a current license from another jurisdiction
for the remainder of the licensing year.
E. The fee for any license purchased under Part I of this resolution may be prorated so as to
expire during the same month as the month the rabies vaccination was issued.
SECTION 6. Resolution No. 92 -168 is hereby repealed.
Part II: Development Services
SECTION 1. The following fees, which are based on the estimated reasonable costs of the
services provided, are hereby established:
A. Building Permit Issuance: $15.00 per building permit.
B. Combination Building Permit Issuance:
1. $15.00 for the first permit issued as part of a combination building permit.
2. $6.00 for each additional permit type on the application.
SECTION 2. For the purposes of Part II, Section 1 of this resolution, a combination building
permit is defined as a permit which includes two or more permit types (i.e., building,

SECTION 3. Notwithstanding other provisions for the determination of fees established by
resolution or ordinance, the minimum fee for inspection services under any original building,
electrical, plumbing, mechanical, or combination building permit shall be $43.00, or the
calculated fee, whichever is greater.
SECTION 4. A fee of $11.00 shall be charged for the issuance and processing of any
application for inspection. This fee is in addition to the fees charged for inspection services.
SECTION 5. The hourly rates for Plan Check and Inspection Services shall be established

A. Hourly rate for plan check services: $74.36 per hour.
B. Hourly rate for inspection services: $72.80 per hour.
Part IIL Fire Department
SECTION 1. The following schedule fees and rates is hereby established for standby -by
services furnished by the San Bernardino Fire Department:
A. Stand -by fee for a three person engine company: $116.80 per hour
B. Stand -by fee for a four person engine company: $145.06 per hour
C. Stand -by fee for a three person ladder truck: $125.65 per hour
D. Stand -by fee for a three person water tender: $115.69 per hour
E. Stand -by fee for a four person water tender: $143.95 per hour
F. Stand -by fee for a Battalion Chief: $53.11 per hour
G. Stand -by fee for the Deputy Fire Chief: $84.81 per hour
H. Stand -by fee for the Fire Chief. $95.98 per hour

SECTION 2. A fee of $115.69 per hour will be charged for Hazardous Materials Response
Unit services furnished by the San Bernardino Fire Department.
SECTION 3. The fees established in Part III, Sections 1 and 2 above shall be a personal
obligation of the owner or owners of the real or personal property which is subject to such fees.
The fees may be collected by any lawful means available to the City of San Bernardino. The
Fire Chief, in conjunction with the Finance Director, shall administer this part of the resolution
and is authorized to establish procedures for the collection of said fees.
SECTION 4. The terms used in Part III, Sections 1 and 2 of this resolution shall have the
same meanings as defined in the Uniform Fire Code.
Part IV: Police Department
SECTION 1. The following schedule of fees is hereby established for services furnished by
the San Bernardino Police Department:
A. Cassette Tape Reproduction: $8.00 each (blank tape required).
B. Computer Location Activity Printout: $15.00 per ten page increment.
C. Concealed Weapons Permit: $3.00
D. Criminal Police Report: $8.00 for the first 20 pages, and $1.00 per page for each additional
page.
E. Fingerprinting: $15.00 per card.
F. Vehicle Towing Administrative Fee: $70.00 per vehicle.
G. Photographs: $5.00 handling fee in addition to the per photograph fee:
1. Black and White 3" x 5 ": $2.00

B. Robbery or panic alarms received by the San Bernardino Police Department from alarm
systems which prove to be false shall be fined as follows:
1. Fifth false alarm: $100.00
2. Sixth false alarm: $100.00
3. Seventh and subsequent false alarms: $200.00
C. Alarm fines pursuant to Part IV, Sections 3(A) and 3(13) of this resolution will be assessed
follows:
1. On the fifth and subsequent intrusion alarm which proves to be false within a 365 day
period, the subscriber will be fined as defined in Paragraph A of this section.
2. On the fifth and subsequent robbery or panic alarm which proves to be false within a 365
day period the subscriber will be fined as defined in Paragraph B of this section.
3 This 365 day period is defined as being from January 1 through December 31 of the
respective year. On each January 1 all alarm accounts will begin with no false alarms on each
record. This shall not excuse or waive past due fines or permit fees that may be owed and is
strictly for record - keeping_ purposes.
4. A 15% late charge will apply on all permit fees and alarm fines not paid within 30 days frc
the date of issuance or billing. Overdue fees and fines will be referred to the Finance
Department of the City of San Bernardino for collection.
SECTION 4. A separate fee schedule for residential alarm permits and false alarm fines is
hereby established for those citizens with income below $15,000 for a one person household,

D. All other provisions of this resolution shall apply to those citizens qualifying under Part IV,
Section 4 of this ordinance.
SECTION 5 Resolution No 91 -11 and Resolution No. 92 -243 are hereby revealed.
Part V: Public Services Department
SECTION 1. The following fees and charges are hereby established for the services of dye
testing sanitary sewer laterals to determine connection with sanitary sewer main lines:
A. A fee of $100.00 shall be required for the issuance of a permit. Said permit must be
acquired prior to the City scheduling services.

B. The issuance of the permit gives the Department of Public Services the authority to enter
onto the private property of the requesting party to perform the required work.
SECTION 2. The following fees and charges are hereby established for refuse collection
services provided during special events within the City of San Bernardino:
A. A minimum fee of $81.90 per city block shall be charged for the collection of trash and
rubbish as requested for special events.
SECTION 3. The following fees and charges are hereby established for special requests for
street sweeping other than the regular street sweeping schedule:
A. Special requests for service during the regular working hours of the Street Division shall be
charged a minimum fee of $76.57 per hour.
B. Special requests for service during hours other than the regular working hours of the Street
Division shall be charged a minimum fee of $94.10 per hour.
Part VI: Effective Date
SECTION 1. The fees established in Part I, Part III, Part IV, and Part V of this resolution
shall become effective upon adoption of the resolution.
SECTION 2. Pursuant to Government Code Section 66017, the fees established in Part II of
this resolution shall become effective 60 days from the effective date of this resolution.

12 5. As to permitted alarm users, this 365 -day period is defined as being
13 from the renewal date of said permit. On renewal of the annual permit, the
14 alarm account will begin with a zero false alarm count. This shall not
15 excuse or waive past due fines or permit fees owed and is strictly for
16 record - keeping purposes.
17 6. As to non - permitted alarm users, this 365 -day period is defined as
18 beginning at the first false alarm event. It is a "moving" 365 -day period
19 and the alarm account will not have a zero false alarm count until an annual
20 alarm permit is obtained for that account. This shall not excuse or waive
21 past due fines or permit fees owed and is strictly for record - keeping
22 purposes.
23 7 • A 15 % late charge will apply on all permit fees and alarm fines not
24 paid within 30 days from the date of issuance or billing. Overdue fees and
25 fines will be referred to the Finance Department of the City of San
26 Bernardino for collection.

1. First through fourth non - permitted false alarm: $20.00 each
2. Fifth false alarm: $20.00
3. Sixth false alarm: $20.00
4. Seventh and subsequent false alarm/s: $40.00 each
D. All other provisions of this resolution and Resolution No. 1999 -173 shall
apply to those citizens qualifying under Part IV, Section 4 of this resolution. "

Subject:
Amend Resolution to include invoicing non - permitted alarm users for the first and all subsequent
false alarms.
Background:
On July 12, 1999, Mayor Valles and the Common Council adopted Resolution No. 1999 -173,
which specifics authorized fees to be charged by City departments. Part VIII Sections 3 and 4,
identify the fee schedule for false alarm events.
San Bernardino Municipal Code Section 8.81.070 requires every alarm user within the City to
obtain an annual alarm permit. Currently 5,600 residential and business alarm permits have been
issued. Permit holders are entitled to four free false alarm responses. Fifth and subsequent false
alarm responses are billed at a rate consistent with the Resolution. The police department sends
notice to the permit holder after the third and fourth false event, allowing the alarm user the
opportunity to correct a faulty alarm system.
Approximately 2,000 residential and business locations in the City have failed to comply with
the permit requirement. Several of these locations have had five or more false alarm responses
and some have not paid false alarm fines.
On August 23, 1999, members of the police department met with the Legislative Review
Committee (LRC) to discuss the equal application of the false alarm fees to both permitted and
non - permitted alarm users. A consensus was reached by LRC members, who suggested
amending; the false alarm fee schedule to include billing non permitted alarm users for the first
and subsequent false alarm responses. It was felt that this was the most appropriate method of
equally applying the alarm ordinance.
Financial Impact:
False alarm fees have proven to be difficult to collect. It is difficult to ascertain the impact
invoicing non- permitted alarm users for the first and subsequent false alarm will have on
revenues. This table shows budget and actual revenue for the last three fiscal years and projected
revenue for FY 99/00.
