Recommended Motion:
1. That the Director of Development Services and the City Clerk be authorized to proceed
with the vacation of portions of the East /West Alley and the North/South Alley North of
401h Street, East of Sierra Way.
AND
2. Plan No. 10009 showing the proposed vacation of portions of the East /West Alley and the
North/South Alley North of 40th Street, East of Sierra Way, be approved.

Staff Report
SUBJECT:
Authorization to Proceed — proposed vacation of portions of the East /West alley and the
North/South alley north of 40th Street, east of Sierra Way and Plan approval.
BACKGROUND:
A petition to vacate portions of the East/West alley and the north/south alley north of 40th Street,
east of Sierra Way was received by this office from the developer of a proposed Walgreen's to
be located on the northeast corner of 40th Street and Sierra Way. Portions of the two alleys
proposed to be vacated bisect the site.
If the alleys are vacated as proposed, it will create a dead -end for both alleys. To preserve the
circulation presently provided by these alleys, the developer is proposing to dedicate an alternate
access along the northerly and easterly boundaries of the proposed Walgreen site as shown on
attached the attached plan. The proposed vacation can be conditioned on the dedications being
made prior to any final action.
If authorization is given to proceed, all City departments, utilities and affected property owners
will be given mailed notice of the proposal and asked to comment on any conflicts.
The petitioner has paid $500, which represents the first half of the vacation - processing fee. The
second half will be due after the investigative proceedings and prior to the legal proceedings.
FINANCIAL IMPACT:
None, the petitioner has paid the first half of the processing fee and will pay the second half
when it becomes due.
RECOMMENDATION:
Staff recommends that authorization to proceed with the proposed vacation is given and that Plan
No. 10009 is approved.
