Closed Session Public Comment:
Jeff Breiten, representative for the Pension and Retirement Services (PARS)
subcommittee and president of the City of San Bernardino Retired Public Employees
Association, stated that nothing was included in the Amended Disclosure Statement to let
Judge Jury know about their ongoing negotiations. He said they met with the City on
January 21, 2016, and made a formal proposal to resolve the issue, but have not received
a response. He stated that he wanted to make sure the City Council was aware that the
PARS people were ready to settle.
Reading of Resolutions and Ordinances
Deputy City Clerk Sutherland read into the record the titles of all the resolutions and ordinances
on the agenda.
Invocation/Pledge of Allegiance
The invocation was given by Reverend Bronica Martindale Taylor of New Hope Missionary
Baptist Church. The Pledge of Allegiance was led by Council Member Barrios.

4A. Proclamation Designating April 12-18, 2016 as National Library Week — Mayor R.

4B. C -SPAN Cities Tour — Mayor R. Carey Davis
Ashley Hill, Producer and Community Relations Representative, provided a brief history
of the C -SPAN TV Network based in Washington D.C. She stated that during their visit
to San Bernardino they would be focusing their attention on DDT Legislation, the early
Mormon settlers, McDonald's, Route 66, Norton Air Force Base, and the City's rail
history. Additionally, she said they would be conducting interviews with Mayor Davis,
Congressman Aguilar, and several non-fiction authors and would also be speaking with
area schools and local Rotary Clubs. Ms. Hill announced that the program would air on
May 7-8, 2016, and the video would be archived on the C -SPAN Cities Tour website at
http://www.c-span.org/series/?citiesTour and on social media at https://twitter.com/
CSPANCities.

City Attorney Saenz announced that the Second Amended Disclosure Statement with
Respect to the Second Amended Plan of Adjustment was filed with the court on March
30, 2016. He stated that a hearing regarding the City's Motion for Approving that
Disclosure Statement and also for approving the Procedures Regarding Solicitation,
Voting and Confirmation would be held on April 27, 2016, at 1:30 p.m., in Judge Jury's
courtroom, U.S. Bankruptcy Court, Riverside, California.

Public Comment:

Chief Assistant City Attorney Grider stated that she was not present at that meeting, but it

Bernardino Adopting a Transition and Release Agreement Between the City of San
Bernardino and the San Bernardino Fire Management Association.
Council Member Nickel asked for clarification of the savings to the City
Chief Assistant City Attorney Grider stated that the City would save money on PERS
benefits, overhead, and maintenance of facilities and vehicles.
City Attorney Saenz stated that the City would be supplementing the income the
firefighters receive from the County for a five-year period.
City Manager Scott stated that this was a salary agreement only and did not cover
overtime.

Council Member Shorett said that the tow companies needed more than a month-to-
month agreement. He stated that he would support a five-year extension, but if that was
not possible, he wanted to go with at least a two-year extension.
Council Member Valdivia suggested extending the contract for five years at the flat rate
of $79 with no increase in the franchise fees.
Chief Assistant City Attorney Grider advised that this item was an amendment of the
term and fee. She stated that if the City Council wanted to make any other changes, they
should have more discussion, negotiate with the tow service companies, and come up
with a new agreement.

8. Public Comments on Items Not on the Agenda
Margaret Hill, Highland, asked the City Council to re-examine its decision to
discontinue funding of the San Bernardino Employment and Training Agency (SBETA).
Scott Olson, San Bernardino, stated that he had never smoked nor consumed medical
marijuana of any kind and had never advocated for medical marijuana, but that's what he
was accused of in a newspaper article.
Scott Johnson, representative of Metrolink, stated that beginning in December 2015 and
ongoing throughout 2016, Metrolink would be implementing BNSF locomotives into
their operating fleet, which meant better on-time performance and overall cleaner and
safer locomotives operating their trains on both ends. He apologized for the use of the
loud horns, which was required by the Federal Railroad Administration, and wanted to let
residents know that it was a short-term issue.
Robert Porter, San Bernardino, asked Council Member Shorett to try to correct the issue
of unregulated pot shops in the City.
Al Palazzo asked for an internship job with the City to explain his vision to bring
investment from the business community, create jobs, and grow the tax base to generate
the revenues the City desperately needed in order to provide quality services to its
residents.
Alyssa DalSanto announced that the National Orange Show would be celebrating its
101s' Citrus Fair, "Blast from the Past," April 20-24, 2016.
Jay Lindberg, San Bernardino, spoke about the war on drugs and the petition to recall 4th
Ward Council Member Fred Shorett.
Ken Smith, San Bernardino, spoke in support of SBETA. He questioned why the City
audits were not getting done; who was responsible for the audits not getting done; and
why that person had not been held accountable.
Sandra Ibarra, San Bernardino, spoke about SBETA and the City audits; asked
questions about County Fire; asked questions regarding Agenda Item No. 51 pertaining to
the agreement between the City and the San Bernardino Fire Management Association;
and stated that she was in the process of collecting signatures on a petition in opposition
to the parcel tax.
Jim Penman, San Bernardino, spoke about the one person, one vote decision of the
Supreme Court and how it related to Charter Committee discussions.

Karmel Roe, San Bernardino, spoke about the annexation of Fire services and
questioned why Council Members had said it would lead to the hiring of additional police
officers; stated that she supported the regulation and limitation of medical marijuana and
that she believed the medical marijuana industry could save the Fire Department, City
parks, and SBETA. She calculated that the City would spend $1.5-1.8 million more per
year on Fire services by annexing the Fire Department. Ms. Roe announced her intention
to run for Mayor in 2017; invited interested residents in the 4th Ward to sign the petition
to recall Council Member Shorett; and invited interested residents to contact her if they
were interested in signing the petition regarding the parcel tax.
Barbara Babcock, San Bernardino, announced that the first annual "Art Night" would
take place on May 19, 2016; spoke about the Latino Education & Advocacy Days
(LEAD) Summit, held on Wednesday, March 30, 2016, at Cal State University, San
Bernardino; urged the Council to keep SBETA in the City of San Bernardino; and
thanked law enforcement for coming to her aid over the last two months.
Esmeralda Negrete, San Bernardino, spoke about the changes to the citation and
suspension policy in City schools.
Marven Norman, Redlands, stated that the City needed to adopt a complete streets
policy and ways to identify ongoing projects. He said the City was repaving several
streets and was missing opportunities to include infrastructure projects that could benefit
users.
William Cioci, San Bernardino, spoke about using the funds from a marijuana
greenhouse to support City programs.
9. Items to be Referred to Council Committees
Council Member Nickel requested that the medical marijuana issue be referred to the
Legislative Review Committee (LRC) for further study and evaluation. Council Member
Mulvihill requested that recent research on medical marijuana be made available for
Cconsideration.

Council Member Nickel requested that the issue of starting Council meetings at a new
time be referred to LRC.
Council Member Nickel requested a conversation with counterparts from the San
Bernardino County Workforce Development Department regarding the transition of
SBETA.
10. Announcements by Mayor, Council and Executive Staff
Mayor Davis read an award the City received at an event held on Saturday, April 2, 2016,
from the San Bernardino Archdiocese regarding the mass shooting on December 2, 2015.
11. Adjournment
At 9:24 p.m., the meeting adjourned to 1:00 p.m., Friday, April 8, 2016, in the EDA
Boardroom, 201 N. "E" Street, San Bernardino, California. The next joint regular
meeting of the Mayor and Common Council and the Mayor and Common Council Acting
as the Successor Agency to the Redevelopment Agency is scheduled for 2:00 p.m.,
Monday, April 18, 2016.
