Synopsis of Previous Commission/Council/Committee Action(s):
On March 28, 1994,the Redevelopment Committee approved a contract with Larry Jacinto Construction in the amount
of$16,950.00 for the demolition of the remaining southern portion of the Great Western Wall and installation of
handrailing at Court Street Parking Lot.
On March 2, 1994,The Community Development Commission approved a contract in the amount of$271,575
for the reconstruction of Court Street Parking Lot.

MOTION: That the Community Development Commission approve a change order to the current contract with
Larry Jacinto Construction in the amount of $8,466.00 for removal of the southern portion of the Great
Western Wall to a height of 42 inches above grade,and allocate funds for same.

GREAT WESTERN WALL DEMOLITION- COURT STREET PARKING LOT
This staff report seeks approval and funding of a change order to the current contract to remove
the southern portion of the Great Western Wall to a height of 42 inches above finished grade.
BACKGROUND INFORMATION
On March 7, 1994, The Community Development Commission approved the reconstruction of
Court Street Parking Lot. Before awarding the bid for the construction, the Economic
Development Agency proposed to split the cost of wall demolition and stair construction with the
owner of the Great Western Bank building on a 25/75 basis, with the landowner contributing 75%
of the cost for the improvements. Since the landowner owns the wall and will benefit the most
from the construction of the stairs, this proposal seemed reasonable. The landowner did not
accept the Agency's proposal , and the original bid was awarded without the removal of the wall
and construction of the stairs.
Shortly after the beginning of construction, tenants of the 330 N. "D" building(the Great Western
Bank Building) employed a contractor to remove a section of the eastern wall and construct a
stairway with the help of a Main Street grant and $2,200.00 from the owner of the building (the
owner has only recently contributed to the project).
Currently, the wall has an opening in it for the stairway and the tenants have neither plans nor
funding to remove the remaining southern portion of the wall. On March 28, 1994, the
Redevelopment Committee approved a plan in which the Agency would pay the cost to remove
the wall and install the guard rail for a cost of$16,950.00, with the building's tenants repaying the
Agency approximately $4,000.00 (see attached memorandum).
After the Committee Meeting, however, staff received word that the owner was unwilling to
allow installation of the guardrailing(a code requirement) for aesthetic reasons, but would allow
the wall to be cut to a height of 42" (3 1/2 feet), the same height as the guardrailing.
The cost for this change order is $8,466.00. The Agency will incur the full cost of this change
order as the owner will not financially participate in the project.

RECOMMENDATION
The removal of the wall has been a long-held Agency objective. Attempts to remove the
remaining southern portion of the wall at a later date will be very costly. The landowner has
minimally participated in the cost of demolition and stair construction and will not further
contribute to the project. Although the owner will only allow the Agency to remove the southern
portion of the wall to a height of 42 inches above the ground, the removal still provides better
lighting and visual access to the area, thereby enhancing the overall pedestrian environment and
meeting the objectives of the Agency and the Downtown Plan.
Staff recommends adoption of the form motion.

On March 7, 1994, The Community Development Commission approved the reconstruction of
Court Street Parking Lot. Construction has begun, but has been slightly delayed due to
inclement weather. Shortly after the beginning of construction, tenants of the 330 N. "D"
building (the Great Western Bank Building) employed a contractor to remove a section of the
eastern wall and construct a stairway with the help of a $5,000.00 Main Street grant. The
owner of the building did not financially participate in the construction.
Earlier, the Economic Development Agency proposed to split the cost of removing the wall
and constructing the stairs with the landowner on a 25/75 basis, with the landowner
contributing 75% of the cost for the improvements. Since the landowner owns the wall and
will benefit the most from the construction of the stairs, this proposal seemed reasonable.
The landowner did not accept the Agency's proposal , and the bid was awarded without the
removal of the wall and construction of the stairs.
Currently, the wall has an opening in it for the stairway, and the tenants have no plans to
remove the remaining southern portion of the wall without additional financial assistance.
Since the Agency will benefit from the removal of the wall, Staff is proposing that the
Agency split the entire cost of wall demolition, stair and railing construction on a 50150 basis
with the tenants of the building. This 50150 spilt does not include the Main Street grant
already committed to the project.
The numbers are presented below:

Two proposals were received by Staff for the work:
Larry Jacinto Constuction $16,950
Wyatt Construction $24,249
Jacinto is the current contractor working on the Court Street Parking Lot. Wyatt is
demolishing a small portion of the wall and constructing the stairs. It is proposed that Staff
will execute a contract with Larry Jacinto Construction in the amount of $16,950 (6% of the
total bid), with $4,225 reimbursed by the tenants of the Bank building. With reimbursement,
this contract equals only 5% of the base bid, or $12,725.00
The removal of the wall has been a long-held Agency objective. Attempts to remove the
remaining southern portion of the wall at a later date will be very costly. The landowner has
not participated in the cost of demolition and construction and it seems unlikely that he will
do so. It is therefore Staffs recommendation that the Executive Director be authorized to
execute a contract in the amount of $16,950 with Larry Jacinto Construction, provided that
the tenants of the Great Western Bank building commit to reimbursing the Agency $4,225
and the Agency can get approval of the demolition and railing construction from the
landowner.
