CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
The changes in the ordinance MC-726 which is the Mobilehome Park
Rent Stabilization ordinance of the City of San Bernardino was
brought to the Mayor and Common Council on January 24, 1994. The
intent of the changes in the ordinance was to protect those persons
who were moving into mobilehome parks and were not being offered a
short term lease and the opportunity of being protected by the
City's rent stabilization ordinance.
After a lengthy discussion, the motion was tabled for further
review. Councilmen Hernandez and Oberhelman were invited to the
meeting of the Mobilehome Board where the issue was discussed in
length.
At the meeting on February 7, 1994, the Mayor and Council referred
the issue to the Housing Committee. The Housing Committee met with
the Mobilehome Board on February 15 and March 1 to put together the
needed changes in the ordinance that both the Housing Committee and
the Mobilehome Board agreed would meet the needs of the home owners
at the same time not put a burden on the mobilehome park owners.
It is this collective discussion and recommendation that the Mayor
and Council is now being asked to include in the ordinance.

2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING
SUBSECTION E OF SECTION 8.90.050 OF THE SAN BERNARDINO MUNICIPAL
3 CODE RELATING TO THE OFFERING OF LONG TERM OR SHORT TERM LEASES BY
THE OWNERS OR OPERATORS OF MOBILE HOME PARKS.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION 1. Subsection E of Section 8.90.050 of the San
7 Bernardino Municipal Code is hereby amended to read as follows:
8 "E. Before any rental agreement or lease agreement in
9 excess of 12 months is executed by an existing or
10 prospective tenant the landlord must ( 1 ) offer the
11 tenant the option of a rental agreement for a term of
12 12 months or less
(2) provide the tenant with a
13 summary of . the City's Mobile Home Park Rent
14 Stabilization Ordinance in a form approved by the
15 Board, (31 make available for tenant review a copy of
16 the Mobile Home Park Rent Stabilization Ordinance, and
17 (4) provide the tenant with a disclosure statement on
18 the possible effect of long term leases as approved by
19 the Board. The disclosure statement in (4) above and
20 the summary in (2) above may be combined into the same
21 document. A signed copy py of the disclosure statement
22 must be returned to the Director within thirty (30)
23 calendar days of execution.

LAWS PROTECTING THE RIGHTS OF MOBILE HOME PARK TENANTS.

The provisions of the San Bernardino ordinance and the California
laws include the following:
1. You cannot be required to sign a lease in order to rent space
in a mobile home park.
2. The San Bernardino ordinance limits the amount of space rent
that a mobilehome park may charge.
3. If you sign a lease for a period of more than one year, you
are not protected by the San Bernardino ordinance.
4. If you do sign a lease, you have a right to cancel it within
72 hours or convert to a shorter term.
5. If you have any questions about your rights, you may contact
the Mobilehome Board at (909) 384-5081.
