Finance• w ,ouncil Notes: 75-0262 Agenda Item No. ii�N CI'T'Y OF SAN BERN' ';DINO - REQUEST P I COUNCIL ACTION STAFF REPORT Hear protests , if any, and adopt the Resolution Confirming the Amended Assessments in Assessment District No. 961-R for the acquisition of offsite improvements in the Park Centre area. This is a result of parcels which have been split by the property owners in the Park Centre Area , District No . 961-R which splits require reapportionment of the pertinent assessments. No requests for reapportionment of the existing assessments were received from the owners who's parcels were split which requires this City action in order to collect the fees and costs relative to the reapportionment of the assessments. The respective owners have been notified by mail on March 9, 1994 of this hearing and of a time when the costs and fees are to be paid to the City. If the costs are not paid, then they will appear on the next regularly scheduled tax bill for the properties involved. On March 7, 1994, the Resolution Ordering the Making of Amended Assessments and the Resolution Approving Preliminary Amended Assessment and Ordering Hearing were passed, which set up the protest hearing date of April 4, 1994. As required by the California Streets and Highways Code a notice of apportionment was mailed to each of the property owners involved on March 9, 1994 and on March 11, 1994 a Notice of Hearing was published in the Sun Newspaper. All written and oral protests are hereby overruled, and 9 - the Favor- and Common Council has thereby acquired jurisdiction to order said 10 amended reassessments and the confirmation of said amended diagram and 11 reassessment and the costs and expenses thereof. 12 SECTION 2. The amended reassessment and diagram filed with the 13 Director of Public Works/City Engineer pursuant to the Resolution ordering 14 same, be, and same is hereby ratified, approved and confirmed. 15 SECTION 3. The City Clerk shall forthwith deliver the amended 16 reassessment to the Director of Public Works/City Engineer together with the 17 amended Diagram, as approved and confirmed by the "ayor and Common Council, 18 with a certificate of such confirmation and of the date thereof, executed by 19 the City- Clerk thereon. The Director of Public Works/City Engineer shall 20 record the reassessment and Diagram in his office in a suitable book to be 21 kept for that purpose, and append thereto his certificate of the date of such 22 recording, and such recordation shall be and constitutes the amended 23 assessment roll herein. 24 SECTION 4 .
