CITY OF SAN BERN A !RDINO - REQUEST F^R COUNCIL ACTION
STAFF REPORT
The Mayor was authorized by Resolution No. 93-382 to
execute an application to the Economic Development Administration
for a grant, in the amount of $6 , 825, 000 , to finance 75% of the
cost for water, sewer and road improvements within Norton A.F.B.
The 25% local matching share will be financed by the Inland
Valley Development Agency.
Notification has been given by letter of 2-8-94 , from
Steven R. Brennen, Regional Director for Economic Development, of
the Economic Development Administration, that an Economic Adjust-
ment Assistance grant has been approved. This grant will be made
to the Inland Vallev Development Agency and the Cit-,, of San
Bernardino as co-applicants .
In order to receive the grant, the co-applicants must
sign the "Approval and Award of Grant for Sudden and Severe
Economic Dislocation Defense Adjustment Implementation Project
No. 07-49-02680 . " This approval of a grant is subject to the
Special Terms and Conditions, and General Terms and Conditions.
Copies of these conditions a.r_P available for review in the City
Clerk' s office.
An item to authorize execution will be on the Inland
Valley Development Agency' s agenda for their meeting of 2-23-94 .
We recommend that authorization be granted to execute the
Approval and Award of Grant.

ECONOMIC DEVELOPMENT ADMINISTRATION
Approval and Award of Grant for Sudden and Severe Economic
Dislocation Defense Adjustment Implementation Project
No. 07-49-02680
The Regional Director, Denver Regional Office of the Economic
Development Administration, acting pursuant to the authority
provided by Title IX, Section 903 of the amended Public Works and
Economic Development Act of 1965 (Act) , hereby approves and
awards to the City of San Bernardino and the Inland Valley
Development Agency, a grant subject to the terms, conditions, and
limitations as set forth herein and in the attached Special Terms
and Conditions and General Terms and Conditions. This assistance
is approved and awarded to enable the Recipient to carry out the
objectives of the Act by implementing a comprehensive economic
adjustment program to address an actual or threatened economic
dislocation or other adjustment problem for the area(s) . It does
not commit the Economic Development Administration (Grantor) to
approve requests for any additional funds.
The maximum amount of grant assistance hereby awarded is
$6, 825, 000 or seventy-five (75) percent of the total project
cost, whichever is less. Funds will be made available for the
Recipient's eligible expenses in accord with the attached Special
Terms and Conditions and General Terms and Conditions.
This Approval and Award of Grant, subject to the Special Terms
and Conditions and General Terms and Conditions shall constitute
an obligation to make a grant. Such obligation must be
terminated without further cause, if the Recipient fails to sign
and return to the Grantor within forty-five (45) days of approval
by the Regional Director, its affirmation of intent as set forth
below.

Agenda Meeting of March 7, 1994
The Grant contains "standard" provisions which relate to the
contaminated condition of Norton.
The first concern is that the project must comply with ERCLA in
light of the fact that we are aware that Norton is contaminated.
IVDA or the Agency should not be held responsible for the Air
Force' s contamination.
The second concern is that IVDA and City must assure that Norton is
not on the facts list of contaminated sites . It is my
understanding that Norton is on the list.
I have spoken to Tim Sabo who represents IVDA and he agrees that
neither IVDA or City should sign off on the grant until the issue
is resolved. I also spoke to Mr. Pilot who advised that they are
aware of the time restraints of the grant. They are taking the
lead in getting the changes made in the condition.
