Penman, City Attorney FROM: Frank L. Rhemrev, Deputy City Attorney DATE: March 3, 1994 RE: AGENDA ITEM #19 Agenda Meeting of March 7, 1994 The Grant contains "standard" provisions which relate to the contaminated condition of Norton. The first concern is that the project must comply with ERCLA in light of the fact that we are aware that Norton is contaminated. IVDA or the Agency should not be held responsible for the Air Force' s contamination. The second concern is that IVDA and City must assure that Norton is not on the facts list of contaminated sites . It is my understanding that Norton is on the list. I have spoken to Tim Sabo who represents IVDA and he agrees that neither IVDA or City should sign off on the grant until the issue is resolved. I also spoke to Mr. Pilot who advised that they are aware of the time restraints of the grant. They are taking the lead in getting the changes made in the condition. I q11111/- Frank L.
