Recommended motion: 1. That the protests be overruled and the hearing closed, and find and determine that the public convenience and necessity require the proposed construction of a r_ _sewer main and appurtenant facilities in the Quail Canyon Area. That the Special Assessment , Investigation and Limitation Act of 1931 shall not apply. (4/5th vote required) . 2. Description) Sewer Main -- Quail Canyon AD 1011 _ Finance:./ Council Notes: 75-0262 02-21-94 Agenda Item No. C2 CITY OF SAN BERN: ZDINO - REQUEST F( I COUNCIL ACTION STAFF REPORT A petition requesting the formation of an assessment district for the construction of a sewer main in the Quail Canyon Area, was submitted by six (6) property owners. The assessment will include the cost for construction of sewers and appurtenant facilities, administrative costs and the cost for the acquisition of easements. The signatures affixed to the referenced petition have been checked and found to represent the six (6) owners, representing 100 percent of the properties liable to be assessed for the proposed construction. Those properties from which easements will be required, but will be nil assessed, are included in the boundaries of the Assessment District , as• shown on the attached map. It is proposed that the construction costs will be paid for out of the Sewer Line Construction Fund (245) which will then be reimbursed through assessments over a period of 10 years. On November 15, 1993, Resolution of Intention No. 93-417 was adopted, setting a public meeting and a public hearing relative to this proposal. The Engineer's Report was also approved at that Council Meeting. The Public Meeting was held on December 20, 1993. At that meeting, three of the six property owners presented protests. The Public Hearing on January 10, 1994, was continued to February 21, 1994, in order to allow staff time to review the estimate for any possible cost savings. Staff has come up with several alternates that would lower the costs, and thus the assessments. Some of the manholes can be deleted without significantly affecting our maintenance effort. The original estimate was $15,000 for acquisition of the necessary easements. After discussing the matter with property owners, we have determined that this estimate could be reduced to $1,000. It is also proposed that the interest rate be reduced from 10Z to 6%, which will further aid in reducing the annual assessments.
