1. The Mayor and Common Council and Community Development
Commission will recess to closed session for the following:
a. to meet with its designated representatives regarding
labor relations matters pursuant to Government Code
Section 54957 . 6;
b. to confer with the attorney regarding pending
litigation pursuant to Government Code Section
54956. 9 (b) (1) , as there is significant exposure to
litigation;
C. based on existing facts and circumstances, set out
below, the City Council is meeting only to decide
whether a closed session is authorized pursuant to

6. Authorize acceptance of payment of insurance premium in lieu
of rental fees for FDR Bowl by Junior University. (See
Attached)
MOTION: That the acceptance of payment of insurance
premium by Junior University in lieu of rental
fee for FDR Bowl, be authorized.
7 . Authorize acceptance of payment from City of Highland of a
pro-rata share of Highland Little League' s lighting costs at
Patton Park and the waiver of lighting costs through June
30, 1994 . (See Attached) Ward 7
MOTION: That the payment by the City of Highland of a pro-
rata share of Highland Little League' s lighting
costs at Patton Park be accepted, and that the
remainder of fees be waived through June 30, 1994 .
8 . Approval of plans and authorization to advertise for bids--
installation of curbs and gutters on Waterman Avenue (East
Side) from 6th Street to 9th Street. (See Attached) (Cost
to City -- $180,000 from 1/2 Cent Sales Tax - Local Funds. )

#1 129-309-57737 , "Orange Show Road, from Arrowhead
Avenue to Tippecanoe Avenue, " to Account No. 129-

MOTION: That the plans for installation of curbs and
` 12 gutters on Waterman Avenue (East Side) , from 6th
Street to 9th Street, in accordance with Plan No.
9047 , be approved; and that the Director of Public
Works/City Engineer be authorized to advertise for

Examiner dated February 10, 1994 , in accordance
with Civil Service Rules and Regulations and
Personnel Policies adopted by the Mayor and Common
Council, be approved and ratified.

92-466 entitled in part "Resolution . . . amending Conflict
of Interest Codes . . . " , by amending Appendices A and B to

12 . Resolution of the Mayor and Common Council of the City of
San Bernardino acknowledging the receipt and filing of the
Annual Statement of Investment Policy for the Year 1994 .

MOTION: That the protests be overruled and the hearing be
#1 closed, and find and determine that the public
convenience and necessity require the proposed
construction of a sewer main and appurtenant
facilities in the Quail Canyon area. That the
Special Assessment, Investigation and Limitation
Act of 1931 shall not apply. (4/5ths vote
required)

#2 Meeting of March 7 , 1994 ; and that the Director of

MOTION: That the Mayor be authorized to issue letter to
the County of San Bernardino Board of Supervisors
approving the change in the City' s benefit
assessment rate for single family dwellings from
$1. 85 to $2 . 32 .

MOTION: That the meeting be adjourned to 6: 00 p.m. ,
Tuesday, February 22 , 1994 , for a joint meeting
with the San Bernardino City Unified School
District, Board of Education, to be held at the
Board of Education Building, 777 North "F" Street,
San Bernardino, California.

NOTICE: Any member of the public may address this meeting of
the Mayor and Common Council on any item appearing on
the agenda, by approaching the microphone in the
Council Chambers when the item about which the member
desires to speak is called, and by asking to be
recognized.
Any member of the public desiring to speak to the Mayor
and Common Council concerning any matter not on the
agenda but which is within the subject matter
jurisdiction of the Mayor and Common Council, may
address the body at the beginning of the meeting,
during the period reserved for public comment, said
total period for public comment shall not exceed forty-
five (45) minutes, unless such time limit is extended
by the Mayor and Common Council. A five minute
limitation shall apply to each member of the public,
unless such time limit is extended by the Mayor and
Common Council. No member of the public shall be
permitted to "share" his/her five minutes with any
other member of the public.
The Mayor and Common Council may refer any item raised
by the public to staff, or to any commission, board,
bureau or committee for appropriate action or have the
item placed on the next agenda of the Mayor and Common
Council. However, no other action shall be taken nor
discussion held by the Mayor and Common Council on any
item which does not appear on the agenda unless the
action is otherwise authorized in accordance with the
provisions of subdivision (b) of Section 54954 . 2 of the
Government Code.
Public comments will not be received on any item on the
agenda when a public hearing has been conducted and
closed.

of certain Lines of Credit with Wells Fargo Bank and authorize the execution of

11. CENTRAL POLICE STATION CONSTRUCTION CONTRACTS/BIDDING

MOTION: That the Community Development Commission authorize the execution of a
Construction Management contract with Millie and Severson, Incorporated, for
general contracting and construction management services in connection with
the construction of the Central Police Station; further, that the Commission
authorize advertisement for Trade Contractor bids for construction of the
Station; further, that the Commission increase the Agency budget in an amount
of$369,714 for construction management services; and, further, that the
Commission direct staff to prepare financing documents for a Certificates of
Participation issue to yield approximately $5,000,000 in construction funds, and
a Tax Allocation Bond issue in an amount necessary to provide for completion
of construction and furnishing of the Station.

MOTION: That the Community Development Commission authorize the Executive Director
to execute assistance agreements with Camden Development, Ltd., as drafted
by Agency Special Counsel; further that the Executive Director be authorized to
execute such other documents as are required to carry out the terms of the
agreements and be authorized to make such non-substantive corrections in the
agreements as are approved by Agency Counsel; and further, that the
Economic Development Agency budget of 1993-1994 be amended to provide
an additional $1,250,712 to be used for assistance to the University Village
Shopping Center development.
