Synopsis of Previous Council action:
January 21, 1991 - Adopted Resolution 91-35 modifying fees for use of
public parks and recreation facilities.
April 20, 1992 - Adopted Resolution 92-141, amending Resolution 91-35, to
establish a 50% rate for use of parks and recreation
facilities by San Bernardino City Unified School District.
March 22, 1993 - Adopted Resolution 93-75, amending Resolution 91-35, to add
damage bonds and clean-up deposits for use of parks and
recreation facilities and Sturges Auditorium.
June 7, 1994 - Adopted Resolution 93-172, amending Resolution 91-35, to add
and modify fees for use of parks and- recreation facilities
and equipment, and Sturges Auditorium.
Recommended motion:
That the Public Hearing be closed and the resolution be adopted.

STAFF REPORT
RESOLUTION OF THE CITY OF SAN BERNARDINO
ESTABLISHING AND MODIFYING FEES FOR USE
OF PUBLIC FACILITIES, PARRS, RECREATION
BUILDING, EQUIPMENT AND SERVICES UNDER
JURISDICTION OF THE PARRS, RECREATION
AND COMMUNITY SERVICES DEPARTMENT.
The requested resolution is to combine all the previous
amendments and to modify existing fees for use of facilities,
equipment and services provided by the Parks, Recreation and
Community Services Department.
SUMMARY OF CHANGE
SECTION 5. A. Implementation.
Sturges Auditorium
Fee for performances changed from $332.50 to $500.00 for
the first hour and from $60.00 to $82.50 for each additional
hour.
Fee for use of Sturges Piano changed from $40.00 to
$50.00 per occasion and fees for use of the following
equipment have been added:
Sturges Lighting $50.00 per occasion
Sturges Ticket Booth $25.00 per occasion
Sturges Microphone $ 5.00 per occasion
Recreational Swim fees and service charges have changed
as follows:
The $.50 per session for the use of the Water Slide has
been deleted and an all inclusive fee for use of the entire
facility has been added which is $1.00 for youth (17 and
under) and $2.50 for adults.
Non-Resident charges is a change in language only, to
allow for non-resident applications on a team basis rather
than on individual basis.
JUSTIFICATION
The restructuring of fees for the use of Sturges
Auditorium and Sturges equipment will provide a more effective `
fee schedule which includes labor costs for the theater
technicians and use of lights, ticket booth and microphones.

The implementation of fees for these items is consistent with
the practice in the industry and helps to cover the costs of
depreciation of equipment and facilities as well as utility
costs. The $10.00 increase in use of the piano is to cover
the current rates for tuning.
The proposed swim fees for the Perris Hill Park Swim
Center do not increase the rate but do combine admissions and
water slide into one charge. This restructuring of the fee
will reduce the making of change, reduce entry lines and
eliminate hand-stamping for water slide usage, thus allowing
for a more efficient and cost effective operation at the Swim
Center.
The proposed language associated with non-resident
surcharges affects only adult team sports and is recommended
for the sake of efficiency. The current language requires
that each adult sports team submit proof of residency for each
player. Substantial staff time was consumed in validating
this information or simply trying to collect it. The new
language allows residency application on a team basis,
requiring teams to submit proof only to demonstrate 51 percent
(51%) city residency. This language change may result in
additional team registration, potentially increasing revenue
to the City.

MODIFYING FEES FOR USE OF PUBLIC FACILITIES, INCLUDING PUBLIC
3 PARKS, RECREATION BUILDINGS, AND SWIMMING FACILITIES, AND CERTAIN
EQUIPMENT AND SERVICES UNDER THE JURISDICTION OF THE PARKS,
4 RECREATION AND COMMUNITY SERVICES DEPARTMENT, AND REPEALING
RESOLUTIONS 91-35, 92-141, 93-75 AND 93-172.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
6 SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. Findings. The Mayor and Common Council hereby
8 find:
9 A. Hearing has been held by the Mayor and Common Council
10 pursuant to the provisions of Government Code Section 54990, et
11 seq. , to consider the levy of new and additional fees and service
12 charges for various services provided by the Parks, Recreation and
13 Community Services Department, and for uses of certain buildings,
14 facilities and equipment, which hearing was held following public
15 notice published in a newspaper of general circulation in the City
16 of San Bernardino.
17 B. None of the proposed increases exceed the actual costs of
18 providing such services and facilities, and, for those services not
19 completely paid for by the proposed fees, the additional expense to
20 the City of providing services shall be borne by the general fund
21 of the City of San Bernardino.
22 C. The proposed fees and charges are reasonable and
23 necessary to enable the City of San Bernardino to more nearly meet
24 the actual costs of providing such services and facilities.

3 SECTION 2. Policy. Public facilities, including public
4 parks, recreation buildings and swimming pools and certain
5 equipment, under the jurisdiction of the Parks, Recreation an
6 Community Services Department, are public property and as such are
7 available for use by any person or persons in accordance with the
8 following specifications and as deemed appropriate by the Director.
9 SECTION 3. Procedure. The facilities and equipment shall
10 be used only for those meetings and activities pursuant to City
11 Municipal Code 12.80. Any person, persons, or groups of persons
12 desiring the use of any facilities or equipment shall make
13 application on forms provided by the Parks, Recreation and
14 Community Services Department and shall provide such additional
15 information as may be required to assure compliance with City
16 Municipal Code 12.80.
17 SECTION 4. Cancellations. Cancellations of meetings and
18 activities may occur twenty-four (24) hours prior to scheduled use
19 of facilities or equipment without forfeiting any fees and/or
20 deposits collected by the Department. In the event of
21 cancellation by the Department, notice will be given as far in
22 advance of the scheduled use as is possible under the
23 circumstances.
24 SECTION 5. Implementation. The following fees and charges
25 for services and use of equipment and facilities shall be effective
26 within the City of San Bernardino.

3 E. Priority of Use: The priorities of use shall be in the
4 following order:
5 1. Parks, Recreation and Community Services Department
6 sponsored activities.
7 2. Parks, Recreation and Community Services Department
8 co-sponsored activities.
9 3. Non-Profit, youth-service organizations located
10 permanently in and serving the City of San
11 Bernardino and tax supported groups.
12 4. Civic and social groups (resident and non-profit.
13 5. Civic and social groups (non-resident or
14 commercial) .
15 F. Groups in Category 1 and 2 shall pay no fee. The San
16 Bernardino City Unified School District shall pay fifty
17 percent (50%) of the established rates.
18 G. Non-profit, youth-serving organizations located
19 permanently in and serving the City of San Bernardino are those
20 organizations whose principal purpose is to provide a service or
21 program to participants, generally under the age of 18, of which at
22 least fifty-one percent (51%) reside in the City of San Bernardino.
23 Groups in this classification shall pay no fee for use of outdoor
24 athletic facilities.

3 H. Non-Resident Charges.
4 1. For all facility and equipment uses, class
5 registrations and excursions, a non-resident
6 surcharge of ten percent (10%) of the Fee/Service
7 Charge will be assessed (not to exceed $10.00 for
8 excursions) .
9 2. For adult sports team registration, a team
10 consisting of fifty-one percent (51%) or more
11 of San Bernardino residents will pay no non-
12 resident fee. Teams not qualifying under
13 these terms will be classified a "non-resident team"
14 and will be assessed a surcharge of $50.00.
15 3. For adult sports individual registrations and art
16 display programs, a $5.00 non-resident surcharge
17 shall be assessed.
18 I. The Mayor and Common Council may exempt non-profit
19 associations and corporations organized primarily for patriotic,
20 civic betterment or charitable purpose or any local civic or
21 charitable organization from the foregoing rates and fee schedule
22 for the use of park and recreation buildings and facilities upon a
23 finding that the fee would create a financial hardship jeopardizing
24 the activity or event planned for such use and that the activity or
event will be of unusual benefit to the residents of the City and
26 should be supported with public funds. The word 'local' as used

3 herein is defined to mean an organization whose membership is
4 comprised of fifty-one percent (51%) of City residents.
5 J. As a condition of exemption, the Mayor and Common Council
6 may require that the association, corporation, organization or
7 group seeking exemption perform services or provide labor
8 beneficial to the City or its residents.
9 SECTION 6. Refundable Damage Bonds and Clean-Up Deposits
10 A. Refundable damage bonds and clean-up deposits shall be
11 required for all special events, athletic events, fundraisers and
12 other events which warrant such bonds and deposits based on
13 specific numbers of people and uses of facilities and equipment.
14 Minimum bonds and deposits are as follows:

22 B. Refundable deposits held pursuant to this resolution may
23 be refunded in full or in part within fourteen (14) days after
24 completion of the use period. No refund shall be made until the
25 using party or group has secured a signed inspection and release
26 form from the appropriate facility manager, and delivered this

3 executed release form to the Parks, Recreation and Community
4 Services Department. Deductions for any damages to the facility or
5 for clean-up and repairs shall be made from the said deposit by
6 City.
7 SECTION 7. Utilization of City Employees. During any
8 event when a City employee or employees are required to be present
9 for the purposes of clean up, monitoring, etc. , a fee shall be paid
10 equivalent to the total cost of said employees.
11 SECTION 8. Trust Fund Account. There is hereby
12 established a trust fund account to be designated the "Sturges
13 Auditorium Replacement Account." Of the fees established for
14 Sturges Auditorium in SECTION 5 of this resolution, $150.00 of the
15 first hour operational cost, and $28.00 of each additional hour
16 operational cost shall be deposited into the Sturges Auditorium
17 Replacement Account. ,
18 SECTION 9. Reveal and Amendment of Prior Resolution
19 Resolutions 91-35, 92-141, 93-75 and 93-172 are hereby repealed.
20 I HEREBY CERTIFY that the foregoing resolution was duly
21 adopted by the Mayor and Common Council of the City of San
22 Bernardino at a meeting thereof, held on the
23 day of 1994, by the following vote to
