Parking District No. 947 (Roll 1-Bonded portion only), and suspending costs for maintenance, operation
and security, and Roll 2 for 1997/98 Tax Year.

Subject:
Confirmation of 1998/99 Assessment Roll---Downtown Central City Parking District No. 947, Roll I and
Suspension of Roll 2 for the term of the Assessment District.
Background:
The Central City Parking District was formed in 1977 to provide for the acquisition and improvement of the three
downtown City parking Lots #1, #2 and#3, and to provide for the ongoing maintenance, operation and security of
the three lots. Bonds were sold in the amount of$1,950,000 to provide funds for the acquisition and improvement
of the three lots with a 25 year repayment. The revenue source for annual debt service is derived from assessments
on the various parcels within the district.. As initially established, the assessments also included the costs of
maintenance, operation and security, and together with bond repayment have comprised the total of Roll 1. As set
forth in the Engineer's Report for the Parking District, seventy-five percent (75%) of the Area Tax generated by
the Parking and Business Improvement Area, which includes property outside the boundaries of the parking
District, is credited towards Roll 1. Additionally,the Economic Development Agency pays the assessments on
EDA owned parcels directly, pursuant to an agreement between the City and EDA. The remaining net amount is
then spread across the parcels within the boundaries of the District based upon a pre-determined formula.
In 1979, it was determined that additional parking facilities were needed. Funds for the expansion of district lots
#2 and#3 were loaned to the District from the City's General Fund in the amount of$812,763.45, with a 28 year
payback and Roll 2 was established with a fixed annual assessment totaling $30,300.
Proposition 218, approved by the voters in November, 1996, requires that all existing assessment districts that
do not fall into one of the various exemption categories, be approved by a majority of the property owners, using
an assessment ballot procedure. Last year, it was determined that the bond repayment portion of Roll 1 was
exempt from the procedural and approval requirements of Proposition 218. The maintenance operation and
security portion of Roll 1 and all of Roll 2, however, were not exempt and would need approval by a majority of
the property owners within the district. Additionally, the method of assessment would also have to be brought in
compliance with Proposition 218, basically requiring a new Engineer's Report and different method of assessment,
essentially requiring the formation of a new District. It is unlikely that a new district would receive a majority
property owner approval.
Last year,the Economic Development Agency funded the maintenance, operation and security costs for the
District lots, and a portion of Roll 2. However, source of funds for this year have not yet been identified. Also, no
funding source has been identified to replace the $30,300 previously generated by Roll 2.
The total amount proposed to be assessed on Roll 1 is $45,464.14, after credits. A summary of the total roll is
attached, along with a map showing the boundaries of the district.
Financial Impact:
If the assessments are not approved, the proposed assessment roll will have to be funded from the General Fund, or
other source. Funding of the maintenance, operation and security costs for the 3 lots and the amount of Roll 2 for
payback of the City loan has not been identified.
Recommendation:
We recommend that the 1998/99 Assessment Roll for the Parking District be approved and suspension of Roll 2
for the term of the Assessment District.

RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE
3 1998-99 ASSESSMENT ROLL FOR ACQUISITION AND IMPROVEMENTS FOR THE
DOWNTOWN CENTRAL CITY PARKING DISTRICT NO. 947.

5 WHEREAS, by Resolution No. 12613, the Mayor and Common Council found that the
6 public interest, convenience, and necessity required the formation of a parking improvement
7 district; and
8 WHEREAS, by said Resolution No. 12613, the Mayor and Common Council formed a
9 parking improvement district for the purpose of providing public off-street parking facilities in
10
the City of San Bernardino pursuant to the provisions of Ordinance No. 3589 relating to the
11
12 establishment, financing, operation and maintenance of vehicle off-street parking within the
13 City; and
14 WHEREAS, said Resolution No. 12613 declared that all land within the boundaries of
15 said parking improvement district will be benefited by the parking improvements to be
16 constructed; and
17
WHEREAS, by Resolution No. 12613 declared that an annual assessment shall be
18
levied on all land within the district to provide funding for the acquisition and improvement of
19
20 parking spaces the maintenance and operation thereof and the furnishing of security therefore;
21 and
22 WHEREAS, an Assessment Roll has been prepared totaling $45,464.15, which sets
23 forth the individual assessments for acquisition and improvements to be levied on each of the
24 parcels of land within the Central City Parking District No. 947 for the fiscal year 1998-99; and
25
WHEREAS, on May 21, 1998, the Parking Place Commission of the City of San
26
27 Bernardino reviewed and recommended approval of said total assessment amount; and
28 WHEREAS, Article XIII D of the California Constitution requires that any and all
Assessment Districts existing on the effective date of said Article XIII D shall comply with the

1 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set

forth in Section 5 therein.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
4 CITY OF SAN BERNARDINO AS FOLLOWS:
5 SECTION 1. That the Mayor and Common Council do hereby find and determine that
6
the assessments for the costs of maintenance, operation and security for the Central City Parking
7
District No. 947 are not exempt from the procedural and approval requirements of Article XIII
8
9 D of the California Constitution, as provided for under Section 5 of said Article XIII D; and
10 SECTION 2. That the Mayor and Common Council do hereby find and determine that
11 the assessments as set forth on said Assessment Roll No. 947, attached hereto as Exhibit "A",
12 for acquisition and improvements only, exclusive of maintenance, operation and security costs
13 are hereby exempt from the procedural and approval requirements of Article XIII D of the
14
California Constitution, as provided for under Section 5(c) of said Article XIII D.

16 SECTION 3. That the Mayor and Common Council do hereby find and determine
17 that the proportionate costs to be levied against the parcels of land within the Central City
18 parking District No. 947 are correctly set forth on Assessment Roll No. 947, for the fiscal year
19 1998-99, attached hereto as Exhibit"A" and do hereby confirm said assessments.
20 SECTION 4. That the City Clerk is directed to cause a copy of this Resolution to be
21
transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the
22
request that the individual assessments be placed on the subject 1998-99 property tax bills for
23
24 collection together with all other property taxes.
