Authorize transfer of $150,000 from Account No. 126-369-5504-7008 - 40th Street, 3rd to Acre Lane, to Account No. 129-367-5504-7103 and 129-367-5504-7104 - Sierra Way, Mill to Rialto and Mill, "I" to Mt. OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Award of Contract for the rehabilitation on Sierra Way from Mill Street to Rialto Avenue and on Mill Street from Mt. Vernon to "I" Street per Plan No. 9734A. BACKGROUND: Bids for this project were first received and opened on March 11, 1998 at 2:00 pm. A total of 8 bids were received and ranged from $307,485.26 to $453,046.30, but the low bidder withdrew the bid based on clerical errors. The second low bidder also claimed a clerical error and withdrew their bid. The apparent third low bidder also made a clerical error that placed them in the number eight bidders position. Due to the large number of clerical errors related to one specific bid item, staff recommended the rejection of all bids. The Mayor and Council rejected all bids and directed modifications to the project and authorized a re-advertising for bids. The second bid opening was held May 26, 1998 at 2:00 pm. A total of 4 bids were received and ranged from a low of$394,251.00 to a high of$421,956.10. The low bid is 0.82% over the Engineer's Estimate of$391,008.00. The bid is made up of Schedule 1 for Sierra Way, Schedule 2 for Mill St. and Additive Alternate for Handicapped Access. Schedule 1 was 5.32% below the Engineer's Estimate, Schedule 2 was 1.62% over the Engineer's estimate and Additive Alternate was 32.33% over the Engineer's Estimate. Listed below are the estimated contract costs based on the actual low bid: Construction Contract Sierra Way $189,752.00 Mill St. $157,919.00 Alternate $ 46,580.00 $394,251.00 Engineering and Inspection (W.O. 7103 and 7104) $ 11,000.00 subtotal $405,251.00 Contingencies (6.11%) $ 24.749.00 TOTAL $430,000.00 Considering this project has been bid twice and this last bidding represents very close costs among the contractors, it is believed that the bid price represents a fair cost for the improvements needed. FINANCIAL IMPACT: Presently, funding exists for Sierra Way in Mill St. in the following accounts: 129-367-5504-7103 Sierra Way - $125,000; 129-367-5504-7104 Mill St. - $155,000, subtotal $280,000.00; 126-369-5504-7008 (Transfer) - $150,000; 40th Street - 3rd to Acre Lane, TOTAL $430,000. The transfer from 126-369-5504-7008 is recommended as the 40th Street project is complete and there are sufficient funds remaining in the project to fund these improvements. VERNON AND "I'$ STREET. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. VANCE CORPORATION is the lowest responsible bidder 7 for: PAVEMENT REHABILITATION AT SIERRA WAY BETWEEN MILL STREET AND 8 RIALTO AVE AND MILL STREET BETWEEN MT. VERNON AND "I" STREET per 9 Plan No. 9734A . A contract is awarded accordingly to said bidder 10 in a total amount of $394, 251. 00, being comprised of a bid schedule 11 1 in an amount of $189,752 . 00. 00 and bid schedule 2 in an amount of 12 $157,919. 00, and additive alternate in the amount of $46,580. 00 13 but such award shall be effective only upon being fully executed 14 by both parties. All other bids, therefore, are hereby rejected. 15 The Mayor is hereby authorized and directed to execute said 16 contract on behalf of the City; a copy of the contract is on file 17 in the office of the City Clerk and incorporated herein by 18 reference as fully as though set forth at length. 19 SECTION 2 . This contract and any amendment or modifications 20 thereto shall not take effect or become operative until fully 21 signed and executed by the parties and no party shall be obligated 22 hereunder until the time of such full execution. No oral 23 agreements, amendments, modifications or waivers are intended or 24 authorized and shall not be implied from any act or course of 25 conduct of any party. 26 SECTION 3 . This resolution is rescinded if the parties to the 27 contract fail to execute it within sixty (60) days of the passage 28 of this resolution. Vernon and "I" Street. Please obtain necessary signatures on all documents and return the fully executed original to the City Clerk's office for filing with said resolution. Said bound contracts have been executed by the Mayor, City Clerk and City Attorney. Please be advised that said resolution was adopted on June 15, 1998, and will be rescinded if parties fail to execute said documents within sixty (60) days of the passage of this resolution.
