Synopsis of Previous Council action: APR 2 9 1999
Previously,a resolution has been presented to the Common Council for authorization to impose liens on certain
parcels of property for uncollected business registration fees.
Recommended motion:
That the hearing be closed;that the City Clerk be directed to administratively remove any properties from
Exhibit A which have been paid prior to the hearing,and that said resolution be adopted.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO IMPOSING LIENS ON CERTAIN
PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR UNPAID
3 TRANSIENT LODGING TAXES.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
AS FOLLOWS:

6 SECTION 1. The City of San Bernardino, pursuant to its authority under San Bernardino Municipal
7 Code Chapter 3.54.120 does hereby impose liens on the real property described as Exhibit"A", attached hereto
8 and incorporated herein by reference,for unpaid Transient Lodging Taxes and all future fees and penalties.
9 Due notice was given to the person or persons having an interest in said property and a hearing was held
10 by the Mayor and Common Council to hear protests and to assess the fees imposed on said property.
1 I SECTION 2. The matter having now come before the Mayor and Common Council for confirmation
12 of the imposition of the liens imposed, the following fees are found to have been uncollectible after proper
13 notification to the property/business owner pursuant to proceedings under said provisions of the San Bernardino
14 Municipal Code. The statement of fees on file with the City Clerk are hereby confirmed and adopted as special
15 assessments against the properties listed on Exhibit"A"hereto.
16 SECTION 3. The City Clerk is hereby directed to file a certified copy of this resolution with the
17 Auditor of the County of San Bernardino, State of California, direction the said sum be entered as lien charges
18 against said property as it appears on the current assessment rolls, to be collected at the same time and in the
19 same manner, subject to the same penalties and interest upon delinquencies as the general taxes for the City of
20 San Bernardino are collected. The City Clerk shall present for recording appropriate notices of the imposition of
21 these liens with the County Recorder.

In response to your question at Agenda Briefing, the Best Western
Motel at 606 North "H" Street owes $1569 . 64 in overdue transient
occupancy taxes . This account has been delinquent since January
1998 . When you add penalties and interest accruing through May 18,
the amount to be liened totals $3105 . 96 .
As of this morning the amount owed has not been paid; therefore, I
recommend approval of this item.
