Award of Contract - Construction of Storm Drains - Palm Ave from Washington to Irvington & Ohio
Ave from Baily Creek to Olive Ave per Plan No. 9333.
Bonadiman-McCain, Inc.
BACKGROUND:
Plans and specification have been prepared for the construction of a storm drain in Palm Ave. between
Washington and Irvington and in Ohio Ave. from Baily Creek to Olive Ave. The Palm Ave drain was
originally proposed in the 1994/95 fiscal year but had funds transferred to other projects under
construction. The Ohio Ave. drain is part of the Department of Water Resources project on Baily
Creek in that it provides connection to the DWR constructed box culvert at Baily Creek and Ohio Ave.
Bids for this project were opened at 2:00 PM on Tuesday April 21, 1998. A total of 11 bids were
received and ranged from $162,470.00 to $306,299.00. The low bid is 15.42% below the Engineers
Estimate of$192,030.00
Listed below is the estimated construction cost based on the actual low bid for construction:

Palm Ave $ 80,909.00
Ohio Ave $ 81,511.00
Subtotal Construction $162,420.00
Engineering & Inspection $ 12,494.00
Subtotal $174,914.00
Contingencies (15%) $ 26,086.00
TOTAL $201,000.00
FINANCIAL IMPACT:
Funding for the cost of the storm drain construction projects is in the Storm Drain Construction Fund
under Account No. 248-368-5504-1765 and 248-368-5504-7023. The funding is as follows:
248-368-5504-1765 Ohio $116,350.00
248-368-5504-7023 Palm $108,650.00
TOTAL $225,000.00
RECONUVIENDATIONS:
Staff recommends adoption of the resolution awarding the contract.

RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT
3 TO BONADIMAN-MCCAIN INC. FOR INSTALLATION OF STORM DRAIN AT OHIO
AVE BETWEEN OLIVE AND BAILEY CREEK CHANNEL AND PALM AVE BETWEEN
4 WASHINGTON ST AND IRVINGTON AVE.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
6 SAN BERNARDINO AS FOLLOWS: SECTION 1. BONADIMAN-MCCAIN INC. is the
7 lowest responsible bidder for: INSTALLATION OF STORM DRAIN AT OHIO AVE
8 BETWEEN OLIVE AND BAILEY CREEK CHANNEL AND PALM AVE BETWEEN
9
WASHINGTON ST AND IRVINGTON AVE. per Plan No. 9333 . A contract is awarded
10
accordingly to said bidder in the form of schedule 1. Ohio Ave in an amount of$81,511.00 and
11
12 schedule 2 Palm Ave. in an amount of $80,909 for a total amount of $162,420.00 but such
13 award shall be effective only upon being fully executed by both parties. All other bids,
14 therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said
15 contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk
16 and incorporated herein by reference as fully as though set forth at length.

18 SECTION 2. This contract and any amendment or modifications thereto shall not take
19 effect or become operative until fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No oral agreements, amendments,
21 modifications or waivers are intended or authorized and shall not be implied from any act or
22 course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
24
25 within sixty (60) days of the passage of this resolution.

SUBJECT: Transmittal for signatures and return executed documents to City
Clerk for filing with Res. No. 98-121
Attached are the following:
One (1) original bound contract and three (3) duplicate original bound contracts
awarding a contract to Bonadiman-McCain, Inc. for installation of storm drain at
Ohio Avenue between Olive and Bailey Creek Channel and Palm Avenue
between Washington Street and Irvington Avenue.
Please obtain necessary signatures on all documents and return the fully
executed original to the City Clerk's office for filing with said resolution. Said
agreements have been executed by the Mayor, City Clerk and City Attorney.
Please be advised that said resolution was adopted on May 18, 1998, and will be
rescinded if parties fail to execute said documents within sixty (60) days of the
passage of this resolution. The documents must be executed and returned to the
City Clerk's office no later than Friday, July 17, 1998.
