STAFF REPORT
Subject:
Resolution of the City of San Bernardino awarding a purchase order to Heckler & Koch, Inc.
of Sterling, Virginia for the purchase of (410) semi automatic handguns to be utilized by the
Police Department in accordance with Bid Specification #F98-29.
Background:
On July 7, 1997, the Mayor and Common Council ratified Resolution No. #97-210, authorizing
the Police Department to apply for and accept a Local Law Enforcement Block Grant (LLEBG)
Program Award in the amount of $1,076,565 from the U.S. Department of Justice, Bureau of
Justice Assistance for law enforcement support expenditures for equipment, technology, and
overtime. The total project amount will be $1,196,183 which includes a mandatory 10% cash
match of $119,618.
$360,000 in grant funding has been earmarked for a standardized handgun project to replace the
limited number of .38 caliber revolvers in the department's handgun arsenal. The department
will purchase 410 semi-automatic handguns and support items and provide transition firearms
training. 410 handguns will be sufficient for the 380 authorized regular and reserve police officer
positions and 30 spares. Currently, the department's .38 caliber revolvers are issued to police
officers upon request and availability. Most officers have elected to carry their personally owned
handguns resulting in eight different calibers of ammunition being authorized and numerous
different make and model handguns being carried by officers. A department standardized
handgun will improve firearms training, reduce training costs and reduce the city's liability
associated with the use of firearms.
A "Request for Proposals", #F98-29 for semi automatic handguns was released on or before
February 9, 1998, to 25 identified firearms manufacturers and vendors. Appropriate
specifications were prepared and directed to each vendor. Each respondent was required to
propose a "family of handguns" of identical construction and functionality firing 9 mm, .40
S&W and .45 ACP ammunition. The deadline for submitting proposals was February 23, 1998.
Only two vendors submitted proposals with each vendor proposing the Heckler & Koch model
USP family of handguns.
On March 1, 1998, a source selection evaluation committee comprised of Police Department
employees sitting on the Efficiency Initiative met to review the two proposals. The Heckler &
Koch model USP family of semi automatic handguns was determined to meet the minimum
specifications and requirements of the RFP. The committee members recommended that the
contract be awarded to Heckler & Koch, Inc. of Sterling, Virginia as they submitted the low bid.

The bid for each handgun includes factory night sights, three magazines and sales tax. The
selection of Heckler & Koch, Inc. represents a cost savings of $208 per 9 mm and .40 caliber
handgun and $154 per .45 ACP handgun. Additionally Heckler & Koch, Inc. has included five
Universal Tactical Lights valued at $1,000 and the tuition for their Tactical Pistol, Armorer and
Pistol Instructor training valued at $12,000 at no cost to the city.
All current regular and reserve police officers will be given the opportunity to select the caliber
weapon of their choice. The remaining handguns will be .40 caliber. The exact number of each
caliber and total cost will be determined prior to the issuance of the purchase order. The
maximum cost of the purchase will not exceed $221,080 based on the maximum potential cost
of purchasing 410 .45 ACP handguns plus $500 shipping insurance.
Financial Impact:
There will be no financial impact on the city's General Fund. 90% of the funding will be
derived from the department's FY '97 Local Law Enforcement Block Grant award program.
The 10% cash match will be derived from the department's FY 1997/98 COPS Option
expenditure plan ratified by the Mayor and Common Council.
Recommendation:
Having been determined to be most advantageous to the City, it is therefore recommended that
the proposal received from Heckler &Koch, Inc. be accepted and that the City award a purchase
order to Heckler & Koch for (410) model USP semi automatic handguns for an amount not to
exceed $221,080. The exact number of each caliber and total cost will be determined prior to
the issuance of a purchase order.

6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
7 OF SAN BERNARDINO AS FOLLOWS:

9 SECTION 1. That Heckler&Koch, Inc. of Sterling, Virginia, is the best responsible
10 bidder for the purchase of semi automatic handguns for the Police Department in accordance
11 with Bid Specification #F98-29. Therefore, pursuant to this determination, the purchasing
12 manager shall issue a purchase order in the amount not to exceed 5221,080; and all other
13 quotations therefore are hereby- rejected.

SECTION 2. The authorization to execute the above referenced purchase order is
