Synopsis of Previous Commission/Council/Committee Action(s) Continued:
On January 12, 1998, the Mayor and Common Council approved and adopted the Community
Development Citizen Advisory Committee's recommendations for reallocation of 1996/1997
fiscal year funds, with modifications and caveats, and authorized the Mayor to submit these
projects as a part of the amended Third Year Action Plan component of the Consolidated Plan to
the U.S. Department of Housing and Urban Development.
On May 5, 1997, the Mayor and Common Council approved and adopted the Community
Development Citizen Advisory Committee's recommendations for the 1997/1998 Fiscal Year
Federal funds. Included in the action, was the approval of projects for funding during the mid-
year reallocation process (to reprogram certain 1996/1997 FY funds) with amendments.

Consolidated Plan Related Items
The Third Year Action Plan, as amended, was approved by the Mayor and Common Council of
the City of San Bernardino and has been accepted by the U.S. Department of Housing and Urban
Development (HUD).
HUD requires that all environmental reviews be completed prior to any funds being committed, or
agreements executed. Staff has received the completed environmental review on October 24,
1997, for the project listed below and is now requesting authorization to execute a standard
CDBG MOU.

Be it resolved by the Mayor and Common Council of the City of San Bernardino as follows:
9 SECTION I

(a) The Mayor of the City of San Bernardino is hereby authorized and directed to

execute,on behalf of the City, an amendment to the Memorandum of Understanding for
12
Community Development Block Grant, hereinafter CDBG, funding with the Fire Department,
13
which amendment is attached hereto as Exhibit "I", and is incorporated herein by reference as
14
though fully set forth at length. The Amendment provides for the granting of an additional One
15 Hundred Thousand, Nine Hundred Thirty Eight Dollars($100,938).
16 SECTION II

(a) The authorization to execute the above referenced amendment is rescinded if the
18
parties to the agreement shall fail to execute it within sixty(60) days of the passage of the
19
Resolution.

FIRST AMENDMENT
MEMORANDUM OF UNDERSTANDING
CDBG-Funded Capital Improvement/
Rehabilitation Projects
THIS MEMORANDUM OF UNDERSTANDING, hereinafter"Amendment", for project
97-229, is made and entered into this V day of April, 1998 by and between the Development
Department, a department of the Economic Development Agency and the Agency Administrator,
the Community Development Block Grant Program Administrator, hereinafter "Administrator",
and Fire Department , a department or division of the City of San Bernardino, referred to as
"Recipient".
ADMINISTRATOR AND RECIPIENT AGREE AS follows:
WHEREAS, Administrator and Recipient have previously entered into Memorandum of
Understanding 97-229, dated July 1, 1997, hereinafter, "MOU"; and
WHEREAS, Administrator and Recipient desire to amend the MOU to include the
Recipient's completion of the Fire Engine Lease, hereinafter"Project"; and
WHEREAS, Administrator desires to increase the amount of Community Development
Block Grant funding in the amount of One Hundred Thousand,Nine Hundred Thirty Eight
DOLLARS ($100,938), to allow recipient to complete the Project.
NOW, THEREFORE, in consideration of the mutual covenants herein set forth and the
mutual benefits to be derived there from, the parties agree to modify the original MOU as follows:
1. Change the first sentence in Section 2. Payments
"Administrator" shall pay to the "Recipient"the total sum of Two Hundred Thirt y
Thousand, Seven Hundred Sixty One DOLLARS ($230,761) annually, for the term of the MOU.

and year first herein above written, as an internal, "inter-departmental' MOU Amendment.
