Synopsis of Previous Council Action:
June 1997 Allocation of$125,000 approved in FY 1997/98 1/2-Cent Sales Tax Fund for pavement
rehabilitation on Siena Way between Mill Street and Rialto Avenue.
June 1997 Allocation of$155,000 approved in FY 1997/98 1/2-Cent Sales Tax Fund for pavement
rehabilitation on Mill Street between Mt. Vernon Avenue and "I" Street.
December 1997 Plans for pavement rehabilitation on Sierra Way and Mill Street approved and
authorization granted to advertise for bids per Plan No. 9734.

SUBJECT
Rejection of all Bids, and authorization to readvertise for Bids on the pavement rehabilitation
at Sierra Way from Mill Street to Rialto, and at Mill Street from Mt. Vernon Avenue to "I"
Street per Plan No. 9734.
BACKGROUND
Bids for this project were received and opened on March 11, 1998 at 2:00 pm. A total of 8 bids
were received and ranged from $307,485.26 to $453,046.30. The low bid is 23.75% below the
Engineer's Estimate of $403,317.00, however, the low bidder has withdrawn the bid based on
clerical errors. The low bidder will not enter into a contract at the stated price, therefore, the
recommendation was to award the contract to the second low bidder. The second low bid price
was $384,696.28, which is 4.84% below the Engineer's Estimate. However, the second low
bidder has also claimed a clerical error and has withdrawn their bid. The apparent third low
bidder also made a clerical error that placed them in the number eight bidders position. Due
to the large number of clerical errors related to one specific bid item, staff recommends rejection
of all bids.
FINANCIAL IMPACT
None at this time, the project will be readvertised for bids.
RECOMMENDATIONS
Staff recommends that all bids be rejected and the Acting Director of Public Works directed to
readvertise for bids on the project.
