Description) Finance: Council Notes: 75.0262 Agenda Item No 3� CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT The City of San Bernardino Water Reclamation Plant treats wastewater via the sanitary sewers from the cities of San Bernardino, Loma Linda and Highland. During 1995, as part of the City of San Bernardino Municipal Water Department's Primary Hydraulic Reliability Project, a septic receiving station was constructed. This station will allow for the disposal of domestic liquid waste generated within the sphere of influence of the City of San Bernardino. The septic disposal station will alleviate domestic septic waste loading to the Los Angeles County System thereby reducing the financial burden of those haulers that must haul out of the area. Chapter 13 . 32 of the San Bernardino Municipal Code establishes requirements for discharges into the public sewers and/or wastewater facilities of the city. The Ordinance needs to be amended to include the acceptance of domestic liquid waste and to give the Board of Water Commissioners the authority to establish permit and analysis fees for this class of dischargers. The following sections are being amended: 13 . 32 . 050 Insertion of Subsection 4 .5 which defines domestic liquid waste. 13 . 32 . 120 Addition of domestic liquid waste to existing text. 13 . 32 . 140 - 13 .32 . 170 Changes in title and body to include domestic liquid waste. 13 . 32 . 180 Addition of new subparagraph (B) referencing domestic liquid waste fees. 13 . 32 . 215 Addition of new subsection relating to domestic liquid waste fees and giving the Board the authority to collect such fees. 75.0264 ORDINANCE NO. AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING 1 SECTIONS 13.32.050, 13.32.120, 13.32.140, 13.32.150, 13.32.160, 13.32.170, 13.32.180 OF THE SAN BERNARDINO MUNICIPAL CODE, AND ADDING SECTION 13.32.215 2 TO SAID CODE RELATING TO DISCHARGE OF DOMESTIC LIQUID WASTE INTO THE SEWAGE TREATMENT SYSTEM OF THE CITY 3 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 4 DO ORDAIN AS FOLLOWS: 5 SECTION 1. Subsection 4.5 is hereby added to Subsection A of Section 13.32.050 of 6 the San Bernardino Municipal Code to read as follows: 7 "4.5. `Domestic Liquid Waste' is septic or chemical toilet waste which is domestic wastewater confined in a septic tank or 8 other approved detention chamber not connected to the sanitary sewer system." 9 10 SECTION 2. Subsection A of Section 13.32.120 of the San Bernardino Municipal Code is hereby amended to read as follows: 11 "A. Any person desiring to create a new or revised discharge 12 of non-domestic wastewater or domestic liquid waste into the public sewer and/or wastewater treatment facilities 13 shall obtain a wastewater discharge permit from the Director. Permits shall be issued by the Director in 14 accordance with the provisions of this Chapter and such regulations as may be established from time to time by the 15 Director." 16 SECTION 3. Section 13.32.140 of the San Bernardino Municipal Code is hereby 17 amended to read as follows: 18 "13.32.140 Nondomestic wastewater; domestic liquid waste -- 19 Alterations from proposal -- New application required. If a permittee for the discharge of nondomestic wastewater or domestic 20 liquid waste makes substantial alterations in the permitted discharge flow or quantities, he or she shall promptly notify the Director in advance and 21 submit a new application to the Director giving notice of such changes. The Director shall treat the new application in the same manner as an 22 original application, but may, at his or her discretion, modify the existing permit rather than issue a new ]permit. All dischargers shall 23 notify the Director immediately of all discharges which could cause 24 problems to the POTW including slug loadings." 25 SECTION 4. Section 13.32.150 of the San Bernardino Municipal Code is hereby , amended to read as follows: 26 27 "13.32.150 Nondomestic wastewater; -- Permit modification. Within 90 days of the promulgation of any new or changed federal 28 categorical pretreatment standards relating to nondomestic wastewater DAB/js[Waste.Ord] l July 9, 1996 AN ORDINANCE...RELATING TO DISCHARGE OF DOMESTIC LIQUID WASTE INTO THE SEWAGE TREATMENT SYSTEM OF THE CITY 1 which are more restrictive than the limitations established in this Chapter, the wastewater discharge permit of users subject to such 2 standards shall be revised to require compliance with such standards 3 within the time frame prescribed by such standards." 4 SECTION 5. Section 13.32.160 of the San Bernardino Municipal Code is hereby amended to read as follows: 5 "13.32.160 Nondomestic wastewater and domestic liquid waste -- 6 issuance of permit predicated upon compliance with conditions of permit. 7 A. Any permit issued by the Director for the discharge of 8 nondomestic wastewater or domestic liquid waste shall be predicated upon and subject to compliance with 9 conditions of the permit and the provisions of this Chapter. The permit may be suspended or revoked 10 immediately by the Director when it is determined by the Director that the discharge which the permit approves is 11 in violation of the provisions of this Chapter or any 12 conditions or requirements established in the permit. B. Any person notified of a suspension of the wastewater 13 treatment service and/or revocation of the wastewater discharge permit shall immediately stop or eliminate the 14 contribution. In the event of a failure of the person to comply voluntarily with the suspension and/or revocation 15 order, the Director shall take such steps as he or she deems necessary, which may include immediate severance 16 of the sewer connection, to prevent or minimize damage to the wastewater facilities or endangerment to any 17 individuals. The Director shall reinstate the wastewater discharge permit and/or the wastewater treatment service 18 upon proof of the elimination of the noncomplying discharge. A detailed written statement submitted by the 19 user describing the causes of the harmful contribution and the measures taken to prevent an future occurrence shall 20 be submitted to the City within fifteen days of the date of occurrence.." 21 22 SECTION 6. Section 13.32.170 of the San Bernardino Municipal Code is hereby amended to read as follows: 23 "13.32.170 Nondomestic and domestic liquid waste -- Discharge 24 permit required. 25 All nondomestic and domestic liquid waste dischargers proposing to connect to or contribute to the wastewater facilities shall obtain a 26 wastewater discharge permit before connecting to or contributing to the wastewater facilities. All existing nondomestic or domestic liquid 27 waste dischargers shall apply for and obtain a wastewater discharge permit within ninety days after the effective date of this Chapter; 28 however, said permit may not be issued until all conditions and DAB/js[Waste.Ord] 2 July 9, 1996 AN ORDINANCE...RELATING TO DISCHARGE OF DOMESTIC LIQUID WASTE INTO THE SEWAGE TREATMENT SYSTEM OF THE CITY 1 requirements contained in this Chapter are met." 2 SECTION 7. Section 13.32.180 of the San Bernardino Municipal Code is hereby 3 amended to read as follows: 4 "13.32.180 Charges -- Payment of base charges. 5 All premises which are served by a connection to the public sewer and/or wastewater treatment facilities of the City, and all premises, 6 except single family residences, which are situated on real property adjoining an existing public sewer and not connected thereto, shall be 7 charged, and the user thereof shall pay base charges as described in this section. 8 A. Private dwelling units shall be charged a fixed monthly fee for 9 each individual dwelling unit. Such fee shall be established by resolution. The fee shall be adequate to realize from the private 10 residential users so charged an amount sufficient to cover the share of costs of the sewerage facilities attributable to this class 11 of users. The costs shall include all costs of financing, maintaining and operating the system and developing the 12 necessary reserve funds to ensure operation of the system. 13 B. Domestic liquid waste fees shall be billed in an amount determined on the basis of actual flow measurements. The rate for such charges shall 14 be established by resolution. The fees shall be adequate to realize from the class of users so charged an amount sufficient to cover the share of 15 costs of the sewerage facilities attributable to this class of users. The costs shall include all costs of financing, maintaining and operating the 16 system and developing the necessary reserve funds to ensure future 17 operation of the system. C. Commercial residential units, nondomestic users, and all other 18 users except private dwelling units shall be charged on the basis of total water consumption for the comparable water billing 19 period. The rate for such charges shall be established by resolution. The fees shall be adequate to realize from the class of 20 users so charged an amount sufficient to cover the share of costs of the sewerage facilities attributable to this class of users. The 21 costs shall include all costs of financing, maintaining and operating the system and developing the necessary reserve funds 22 to ensure future operation of the system. Industrial premises discharging nondomestic wastewater shall be billed on the basis 23 of the amount of wastewater flow specified in the permit or determined by actual flow measurement. It is recognized that the 24 amount of wastewater generated by a given premises is normally 25 less than the water consumed by that premises. D. The charges provided for in this Chapter are based on the 26 assumption that the percentage of wastewater produced from water consumed is approximately the same for all users included 27 in a given billing category. If the Board determines that for a particular user or group of users the above assumption is not 28 correct and if the percentage of wastewater produced from water DAB/js[Waste.Ord] 3 July 9, 1996 AN ORDINANCE...RELATING TO DISCHARGE OF DOMESTIC LIQUID WASTE INTO THE SEWAGE TREATMENT SYSTEM OF THE CITY 1 consumed is significantly different from the percentage under the existing billing concept, the Board may modify the existing 2 billing concept to invoke an equitable charge to the user. The rate for such amended charges shall be established by resolution. 3 To support such amended charges the user may be required to 4 install facilities as set forth in Section 13.32.130 of this Chapter. E. The Board shall establish a rate of charges for a user when the 5 user's wastewater is derived, either in part or in hull from a source other than the City's potable water supply. A source of 6 supply includes, but is not limited to, any material which is 7 transported onto the user's premises." 8 SECTION 8. Section 13.32.215 is hereby added to the San Bernardino Municipal Code to read as follows: 9 10 13.32.215 Charges -- Domestic liquid waste permit. All domestic liquid waste dischargers shall be required to pay a domestic 11 liquid waste discharge permit fee and a liquid waste analysis fee. Where resampling is required a liquid waste non-compliance resampling fee 12 shall also be paid.
