1 RESOLUTION NO.
2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO RESCINDING AND REPEALING RESOLUTION NOS. 96-240 AND
3 96-241 AND CANCELING THE ELECTION OTHERWISE CALLED THEREIN
4 WHEREAS, SB 2112, which would amend Health and Safety Code §§33200 and 34120
5 to remove the state prohibition on the power of the Mayor to veto actions of the City's
6 Community Development Commission, has been pending in the Legislature, and
7 WHEREAS, since action on SB 2112 was delayed, the Mayor and Common Council, on
8 July 29, 1996, by the adoption of Resolution No. 96-240 and Resolution No. 96-241, called for
9 an election of the voters of the City on the issue of the veto and set the election for Tuesday,
10 November 5, 1996, in conjunction with the Presidential election, and
11 WHEREAS, the cost to the City for such an election is estimated to be approximately
12 $20,000.00 to $25,000.00, and
13 WHEREAS, on Saturday, August 31, 1996, the Legislature did, by majority vote,
14 approve SB 2112, making the scheduled election unnecessary, and
15 WHEREAS, in this difficult economy for the City such a significant expenditure of funds
16 should be made only if absolutely necessary,
17 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
18 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
19 SECTION 1. Resolution No. 96-240 and Resolution No. 96-241 are hereby rescinded and
20 repealed in their entirety, and the election called therein is hereby canceled.
