held.
06-28-96 -- Public hearing, for 8 assessment rolls being increased,
held; and assessment rolls confirmed.
Recommended motion:
That further reading of the ordinance amending Chapter 12 . 90 of
SBMC be waived, and the ordinance be laid over for final
reading.

CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
Twenty-two assessment districts have been established
throughout the City for maintenance of landscaping.
Some of these districts are experiencing high levels of
vandalism, which results in increased costs to the district to
repair or replace the damage.
Certain regulations are set forth in Section 12 . 80 . 130 of
the San Bernardino Municipal Code for the use of public parks and
playgrounds. This proposed ordinance would apply these regula-
tions and penalties to public places within assessment districts.
Applying these regulations to assessment districts would
allow signs to be posted, and violators cited.
We recommend that these regulations be applied to
assessment districts.

12.90 OF THE SAN BERNARDINO MUNICIPAL CODE PERTAINING TO REGULATIONS
3 FOR PUBLIC PROPERTY, PUBLIC PLACES AND PUBLIC IMPROVEMENTS WITHIN
ASSESSMENT DISTRICTS.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO DO ORDAIN AS FOLLOWS:
6 SECTION 1. Section 12.90.015 is hereby added to the San Bernardino Municipal
7 Code to read as follows:
8 1112.90.015 Landscape Maintenance Assessment District Regulations.
9 Within the limits of any City Landscape Maintenance Assessment District (hereinafter
10 "Assessment District") or upon any public improvement, facility, or building located therein and
I 1 owned or controlled by the City, it is unlawful for any person to:
12 A. Play or practice golf or use golf clubs in any area not designated for such use;
13 B. Operate any motor driven model airplane except in areas designated for such use;
14 C. Operate or park any motor vehicle as defined in the California Vehicle Code within
15 any Assessment District except upon areas designated for such use;
16 D. Operate, drive, or ride upon any bicycle,unicycle,tricycle,horse or any other animal
17 in any Assessment District except in areas designated and posted specifically for such
18 use;
19 E. Leave any garbage,trash, cans, bottles, papers or other refuse elsewhere than in the
20 receptacle provided therefor;
21 F. Discharge or shoot any firearm, air gun, slingshot, or bow and arrow except at places
22 designated and posted specifically for such purposes;
23 G. Dig, remove, destroy, injure, mutilate or cut any tree, plant, shrub, bloom or flower,
24 or any portion thereof except a duly authorized City employee in the performance of
25 his duty;

4 H. Remove any wood,turf, grass, soil, rock, sand, gravel or landscape sprinkler system
5 or any part thereof from any Assessment District except a duly authorized City
6 employee in the performance of his duty;
7 I. Cut, break,deface, or disturb any rock, building, cage, pen, monument, sign, fence,
8 structure,apparatus,equipment or property,or landscape sprinkler system or any part
9 thereof except a duly authorized City employee in the performance of his duty;
10 J. Light or maintain any fire unless such fire is lighted and maintained only in a stove
11 or fire circle or place provided for such purpose;
12 K. Throw rocks or waste matter in unauthorized places;
13 L. Camp, lodge or tarry overnight unless there are set aside certain places for this
14 purpose; the provisions of Section 12.68.020 prohibiting any person to be or remain
15 in any public park between the hours of ten p.m. of any day to six a.m. of the next
16 succeeding day is adopted herein by reference and hereby made applicable to
17 Assessment Districts;
18 M. Indulge in riotous, boisterous or indecent conduct; and no noisy, disorderly or
19 offensive person shall be allowed within any Assessment District; the provisions of
20 Chapter 9.32 prohibiting any person from drinking alcoholic beverages in a public
21 place is adopted herein by reference."
22 SECTION 2. Section 12.90.140, "Violation - Penalty," is hereby added to the San
23 Bernardino Municipal Code as follows:
24 "12.90.140 Violation - Penalty.
25 Any person, firm or corporation violating or causing the violation of any provision of
26 Section 12.90.015 is guilty of an infraction or a misdemeanor, which upon conviction, thereof, is
27 punishable in accordance with the provisions of Section 1.12.010 of this Code."
