streets listed below were opened at 2 : 00 p.m. , Tuesday, 7-30-96 .

A total of 5 bids were received, ranging from $606 , 534 . 00
to $783 , 349 . 60 . The low bid of $606 ,534 . 00 is 31 . 1% over the
Engineer ' s Estimate of $462 , 600 . 00 .
Due to the number of bids received, it appears that the
Engineer ' s Estimate did not fully reflect current pricing trends.
Change Order No. One has , therefore, been negotiated with the low
bidder to reduce the contract quantities of pavement area to
receive chip sealing by 66 , 917 sq. yd. , from 249 , 760 sq. yd. to
182 , 843 sq. yd. This reduction will be accomplished by deleting
the streets listed above under Numbers 2 , 7 and 9 . Approval of
Change Order No. One will serve to reduce the contract price from
$606 , 534 to $462 , 662 . 45 .
Below is an estimate of the total project cost, based upon
the low bid price as adjusted by Contract Change Order No. One .

RE: Resolution and Contract with Holland-Lowe Construction, Inc. for Pavement
Rehabilitation for the August 19, 1996 Council Meeting
I recommend that we not approve this Resolution and Contract. Public Works wants to
award the contract and approve a Change Order at the same time. Holland-Lowe's low bid was
31.1% over the Engineer's Estimate so Public Works negotiated a reduction in the job. The 1994
Edition of the Standard Specifications "Greenbook" defines a"Change Order" as "A written order
to the Contractor signed by the Agency directing an addition, deletion, or revision in the Work, or
an adjustment in the Contract Price or the Contract time issued after the effective date of the Contract
. . . ." (emphasis added) Since the Contract is not yet in effect, I think a Change Order cannot be
approved at the same time the Contract is approved by the Council. Dennis A. Barlow thinks the
Contract is in effect after the Council votes (assuming at least five votes for approval), but that this
Change Order cannot be approved because the previous bidders and others (nonbidders) are not
allowed to bid on the revised project.
The better practice is to reject all bids and start again or award the Contract for the entire
(larger) amount and approve the Change Order at a later date.
Public Works responds that the City has done it this way before and the delay will postpone
the project to next year at a higher price.
The cause of this problem is the Engineer's overly-low estimate.
