This expenditure is necessitated by the City of San Bernardino's Development Code conditions which require the undergrounding of utilities in conjunction with,and as a condition of,development project approval for this facility. Due to the fast track development of the project,many design and construction tasks are being completed simultaneously with the knowledge that costs such as this one would need to be integrated into the project as i they occur. At the outset of the project, Southern California Edision was unable to provide their costs for undergrounding utilities on Seventh Street because the civil engineering drawings for the project were not complete and could not be estimated at that time. The breakdown of costs for the undergrounding of utilities by Edison is as follows: The sum of$72,617.00 includes labor and materials to provide transformers,capacitors, switches, wire and installation of these items. The sum of$32,519.64 represents the "Income Tax Component of Contribution" (ITCC)provision as determined by Public Utility Commission regulations. As previously stated, the total expenditure required is$105,136.64. Southern California Edison is the electric utility company that services the Central Police Station site, and as such,is the only company able to provide the work required to complete the conversion from overhead to underground utilities. This project is covered under Public Utility Commission Rule 20B which states that the public Agency that authorizes the work pay for the work from its own resources, as opposed to funds set aside under Rule 20A. This project is not eligible for consideration under Rule 20A. Staff recommends adoption of form motion. BARBARA J. Applicability. The ITCC shall apply to contributions under the tariffs, including but not limited to, street and area lighting rate schedules and Rule Nos . 2, 13, 14, 15, 15. 1 , 15.2, 16, 20 and 21 . 5. State_ Taxes. Under the current California state law, Contributions are not taxable at the time of the Contribution. In the event legislation is enacted to conform state law to federal law, the Company may increase the amount it collects from the Contributor to include its estimate of the tax resulting therefrom. In the event state law is applied retro- actively, the Company may collect such tax for the retroactive period through general rates . 6. Interest Rate. When interest is payable under this Part of the Preliminary Statement by the Contributor to the Company or by the Company to the Contributor, the Interest Rate shall be 1112 of the most recent month' s interest rate on Commercial Paper (prime, three months) , published in the Federal Reserve Statistical Release, G. 13 . Should publication of the interest rate on Commercial Paper (prime, three months) be discontinued, interest will so accrue at the rate of 1112 of the most recent month's interest rate on Commercial Paper, which most clos^� y approximates the rate that was discontinued and which is published in Federal Reserve Statistical Release, G. 13, or its successor publication. All Contributions in Aid of Construction and Advances For Construction (Contributions) made to the Company pursuant to its tariffs shall include a cost component to cover the Company's estimated liability for Federal and State Income Tax resulting therefrom. The Company shall collect the Federal Income Tax on Contributions made on or after February 11 , 1987 for unit costs under Rule 15 and Rule 15. 1 , and January 1 , 1987 for all other Contributions . California Corporate Franchise Tax (CCFT) shall be collected beginning January 1 , 1992 . 2. Definitions . a. Contributions : Contributions shall include, but are not limited to, cash, sr;rvices, facilities , labor, property , and income taxes thereon provided to the Company by a person or agency. The value of all contributions shall be based on the Company' s estimates . Contributions shall consist of U-,'o components as follows : I ( 1 ) Income Tax Component of Contribution ( ITCC) ; and (2) The balance of the Contribution (Balance of Contt-ibution) . b. Government Agency: For purposes of administering this part of the Preliminary Statement, a Government Agency shalI be a California state, county, or local government agency. C. Determination of IiCC. a. The ITCC shall be calculated by multiplying the Balance of the Contribution by the Tax Factor of 0.34 . For contributions received prior to January 1 , 1992, the Tax Factor slr:rll be 0. 28. b. the Tax Factor is established using Method 5 as set forth in and pursuant to the Cor,nission' s Decision tlo. 87-09-026. Should the Internal Revenue Service ( IRS) deers Method 5 to be a violation of the tax normalization rules , any penalties , interest or taxes incurred by the Company shall be recovered through general rates . c.
