Volunteer Citizen-Based Charter Committee

The City of San Bernardino recognizes its obligation to provide equal access to public services to those
individuals with disabilities. Please contact the City Clerk's Office at(909) 384-5102 one working day
prior to the meeting for any requests for reasonable accommodation, to include interpreters.
Anyone who wishes to speak on a numbered agenda item will be required to fill out a speaker slip. Speaker
slips should be turned in to the City Clerk before the item is taken up by the Committee. The Clerk will
relay them to the Committee Chair person. Public comments for agenda items are limited to three minutes
per person, a total of 15 minutes per item, comments to be received from the public before discussion of the
item by Committee members.

ADJOURN
Unless changed at the March 15th meeting, the next meeting of the Volunteer Citizen-Based Charter
Committee will be 5:30 p.m., Tuesday, March 22, 2016, in the EDA Board Room, 201 N. E. Street.
Attendees are encouraged to park on the top floor of the City Hall parking structure and access the EDA
building from there.

Minutes
Committee Members Present: Phil Savage, Hillel Cohn, Casey Dailey, Tom Pierce, Gloria Harrison, and
Vicki Lee(arrived at 5:37 p.m.)
Staff/Committee Consultants Present
City Attorney Gary Saenz, City Clerk Gigi Hanna, Cathy Standiford, of Management Partners, City Manager
Mark Scott.
Chair Savage called the meeting to order at 5:32 p.m.
Following the Pledge of Allegiance, Cohn commended Savage for the committee presentation to the Mayor and
Council on February 29, 2016.
Public Speakers
Jim Smith, of San Bernardino, congratulated the committee for moving the issue along on pace.
Stacey Aldstadt, general manager of the city Water Department, spoke about a letter her board asked her to
author and send to the MCC and her board's desire to work with the Charter Committee.
Gloria Anderson, from the League of Women Voters, spoke about the group being ready to help with
education efforts on the Charter.
Minutes
A motion was made by Dailey, seconded by Cohn, to approve the Minutes of the February 9, 2016 meeting.
The motion passed unanimously.
Action Items
The Committee voted to recommend (In Draft#2 of the Proposed Charter):
• Adoption of Section 401 (Powers and Duties)with the following changes to 401(p): Make business and
policy recommendations based solely on his or her independent professional judgment and best
practices in the interests of the City.,
; and removing the word 'fully"
from 401(d). Motion by Cohn, second by Harrison. Carried unanimously;
• Adoption of Section 501 (General Provisions). Motion by Pierce, second by Harrison. Carried
unanimously;
• Adoption of Section 502 (Direction by City Manager). Motion by Dailey, second by Pierce. Carried
unanimously;
• Adoption of Section 503 (Continuation of Departments). Motion by Cohn, second by Dailey. Carried
unanimously;
• Adoption of Section 504 (City Attorney), striking the last paragraph. Motion by Dailey, second by Lee.
Carried, with Savage abstaining.
• Adoption of Section 505 (City Clerk). Motion by Cohn, second by Dailey. Carried unanimously;
• Adoption of Section 506 (Departmental Administrators; Appointive Powers), with the following change:
Each departmental executive shall have the power to appoint, supervise, suspend, or remove such
assistants, deputies, subordinates and employees as are provided -b„Me "U i for the department,
subject to the approval of the City Manager and subject to the provisions of the personnel rules and
regulations adopted by the Council. Motion by Dailey, second by Lee. Carried unanimously;
• Defer discussion of Section 507 (Water and Sewer) until the committee discusses Section 603 (Water,
Wastewater and Sewer).
• Adoption of Section 508 (Parks and Recreation). Motion by Lee, second by Harrison. Carried, with
Cohn abstaining;
• Adoption of Section 509 (Personnel System), striking the following language: "The Council may
provide for the number, titles, and compensation of all officers and employees." Motion by Dailey,
second by Lee. Carried unanimously
• Adoption of Section 510 (Official Bonds). Motion by Cohn, second by Dailey. Carried unanimously
