DESCRIPTION) Professional /Contractual Finance• ouncii Notes: •0262 Agenda Item No 3a • - CITY OF SAN BERN! ;DINO - REQUEST V -1 COUNCIL ACTION STAFF REPORT During the month of December, we made you aware that effective January 1, 1995 , the City of San Bernardino, under the United States Omnibus Transportation Employee Testing Act of 1991, will be required to random test all employees holding a commercial driver's license for drugs and alcohol. A Random Drug/Alcohol policy was developed by a committee representing Personnel, Civil Service, Public Services, City Attorney's Office, Water Department, and Risk Management. The City Bargaining Team has Met and Conferred with the affected Bargaining Units. The Fire Department participated on a voluntary basis, since they are not required to comply until January 1, 1996. The policy will involve approximately 200 City employees from Public Services, Parks and Recreation, Public Works,and Facilities Management. A summary of the Department of Transportation Requirements for Drug/Alcohol Testing and facilities utilized is as follows: i * The DOT requires the urine sample be analyzed by a laboratory certified by the United States Department of Health and Human Services (DHHS) . They are called NIDA approved labs. Not every drug testing lab is NIDA approved. Our present contract for pre-employement Drug Testing for City employees not possessing a Commerical Drivers Licence does not require a NIDA lab. i * The Department of Transportation (DOT) requires a federally certified MRO (Medical Review Officer) to review ail positive tests. Should an employee test positive, the MRO contacts Zhe employee and conducts an interview to determine if there is an alternative medical expianation for the drugs found in the employees specimen.If the employee provides appropriate documentation and the MRO determines that this is a lealtimate medical use of a prohibited Drug, the Drug Test is reported as a negative to the employer. Not all Drug/Alcohol Testing facilities have a certified MRO available. * Random drug testing will be done annually on 550% :;f -=i- commercial drivers. Random alcohol testing will be done on 25% of all commercial drivers annually. Drug/Alcohol Testing will be done on post accidents involving commerical vehicles. There are time requirements for Drug/Alcohol Testing to be conducted. Not all facilities can provide 24 hour a day 1-65 days a year service. * In addition to Drua Testing, Alcohol testing is required -v certified BAT (Breath Analvzer Technican) . Not ail --abs are can provide this service. * All supervisors will be required to have training In the DOT 75-0264 CITY OF SAN BERNf IDINO - REQUEST Fr l COUNCIL ACTION STAFF REPORT Requirements. The Trainers must be certified in DOT policy and provide a written test to be kept on file for the DOT. Employees will also be trained. * As part of the policy, employees shall have the services of an EAP (Employee Assistance Program) available to them, along with a listing of services available to them, should they test positive for drugs/alcohol. * A trained SAP (Substance Abuse Professional) must be made available to Counsel employees testing positive. Not all Drug /Alcohol Facilities have this available. * All records must be reported to the DOT annually. Names of individuals are treated in a confidential manner and not reported to the DOT. Risk Management has contacted four (4) firms and individuals specifying the procedures outlined by the Department of Transportation and the needs of the City. We requested.a mobile lab for on site drug/alcohol testing. This was requested by Public Services to cut down on the amount of time their drivers were away from the job being tested. Addiction Medicine Consultants was able to provide the' services of a mobile lab, provide round the clock testing for post accident, and meet all the DOT reauirements nor certified personnel in drug/alcohol testing. Several firms were in the process of being certified, could provide off site testing, but could not all the requirements for the City. Exhibit "A" is a proposal from Addiction Medicine Consultants, Inc. The cost of the Program is $32 per drug test. and $20 Der breath alcohol test. They will also train all Supervisors at a cost of h $100 per class. This is the same firm utilized by the County of San Bernardino in the following departments: Agriculture,Weights and Measures,Airports,Department of Information Services,Environmentai Health, Sheriff,Solid Waste,Transportation and Vehicle Services. CALTRANS has signed a contract with AMC and the City_ of Riverside is considering utilizing their services. The total cost of -:,e program will not exceed $12 , 000 annually. Recommendations: 1. Authorize the selection of Addition Medicine Consuitants nor conducting the random drug/alcohol testing. 2 . Penman, City Attorney; Fred Wilson, Assistant City Administrator; Phil Arvizo, Executive Assistant to Council; Victor Lorch, Director of Risk Management; Jan Burch, R.N.; Tom Marek, Safety Officer Back round Per request of Councilmembers attending the January 5, 1995 agenda briefing, this memo summarizes additional information on Agenda Item #32 for the 1/9/95 Council Meeting. According to San Bernardino County staff(Chuck Mader, Personnel Officer, 909-387-2683 and Renee Smith, Personnel Officer, 909-387-5567), the Probation Department of San Bernardino County now contracts with a Smith-Kline laboratory for urinalysis testing for parolees. The cost is $45/test. The urine collection is done for "reasonable suspicion" testing only. County Probation Department employees are not covered under the new Department of Transportation (DOT) regulations. Other County Departments with employees who are covered under DOT regulations will utilize Addiction Medicine Consultants. Chuck Marler told Jan Burch, R.N., that the County changing is chan in to Addiction Medicine Consultants (AMC) for Probation Department testing next month for continuity with the rest of their program. The cost for the Probation Department testing will be up to $45 per test. Costs for Using Addiction Medicine Consultants The City of San Bernardino is proposing an agreement with Addiction Medicine Consultants (AMC) for a cost of$32 per drug test for a Smith-Kline collection facility and $20 per breath alcohol test. The City's program will include both "random testing" and "reasonable suspicion" testing. AMC has a mobile van for on-site collection, saving valuable time. F Memo to the Mayor and Common Council January 6, 1995 Page 2 The City's proposal compares favorably with the County of San Bernardino's cost with AMC for Department of Transportation (DOT) "random testing" and "reasonable suspicion" testing of$35 per drug test for a Smith-Kline collection facility and $20 per breath alcohol test. The City's proposal also compares favorably with the non-DOT testing to be done in the Probation Department at up to $45 per test. Use of Third Partv Mr. Oberhelman had another question when I spoke with him on 1/6/95. He wanted to know why the City had to use a third party for the testing. Attached is a handbook, "What You Need to Know About DOT Drug and Alcohol Rules." Pages 10, 11 and 18 on alcohol and drug testing note the need for "substance abuse professionals" (SAPs), "Breath Alcohol Technicians" (BATs) and "Medical Review Officers" (MROs). These professionals are available through a third party, such as Addiction Medicine Consultants. The City does not have in-house staff for this purpose. Additionally, a third party provides greater faith validity to selecting employee names for the "random testing," which is an extensive portion of the DOT Drug and Alcohol Testing program. Employees who engage in prohibited alcohol conduct must be immediately removed from safety-sensitive functions. Employees who have engaged in alcohol misuse cannot return to safety-sensitive duties until they have been evaluated by a substance abuse profes- sional and have complied with any treatment recommendations to assist them with an alcohol problem. To further safeguard transportation safe- ty, employees who have any alcohol con- centration (defined as 0.02 or greater) in their breath, when tested just before, dur- ing or just after performing safety-sensi- tive functions, must also be removed from performing such duties for 8 hours or until another breath test is administered and the result is less than 0.02. Commercial motor vehicle drivers must be removed from driving for at least 24 hours. If an employee's behavior or appearance suggests alcohol misuse, a reasonable suspicion alcohol test must be conducted. If a breath test cannot be administered, the - employee must be removed from performing safety-sensitive duties for at least 8 hours (24 hours for commercial motor vehicle drivers). DOT Alcohol and Drug Rules r HOW WILL ALCOHOL TESTING BE DONE? The rules require breath testing using evidential breath testing devices (EBT) approved by the l National Highway Traffic Safety Administration (NHTSA). Two breath tests are required to determine if a person has a prohibited alcohol concentration. A screening test is conducted first. Any result less than 0.02 alcohol concentration is considered a "negative" test. If the alcohol concentration is 0.02 or greater, a second or confirmation test must be conducted. The employee and the individual conducting the breath test (called a breath alcohol technician (BAT)) complete the alcohol testing form to ensure that the results are properly recorded.The confirmation test, if required, must be conducted using an EBT that prints out the results, date and time, a sequential test number, and the name and serial number of the EBT to ensure the reliabili- ty of the results. The confirmation test result determines any actions taken. ,a Testing procedures that ensure accuracy, reliabili- ty and confidentiality of test results are outlined j in the Part 40 rule. These procedures include training and proficiency requirements for breath alcohol technicians (BAT), quality assurance plans for the breath testing devices (including - calibration), requirements for a suitable test loca- tion, and protection of employee test records. } BUCKLEY Video Publishing,Inc. C r 3 i WHO REVIEWS & INTERPRETS THE LABORATORY RESULTS? All drug test results are reviewed and interpreted by a physician (Medical Review Officer MRO)) before they are reported to the employer. If the laboratory reports a positive result to the MRO, the MRO contacts the employee (in person or by telephone) and conducts an interview to deter- mine if there is an alternative medical explana- tion for the drugs found in the employee's urine specimen. For all the drugs except PCP, there are some limited, legitimate medical uses for the r` drugs that may explain the positive test result. If the employee provides appropriate documenta- tion and the MRO determines that it is legitimate medical use of the prohibited drug, the drug test result is reported as negative to the employer. WHAT DRUG USE IS n, PROHIBITED? The drug rules prohibit any unauthorized use of the controlled substances. Illicit use of drugs by safety-sensitive employees is prohibited on or off duty. Some of the DOT agencies have additional rules that prohibit the use of legally prescribed con- trolled substances (such as barbituates, ampheta- mines, morphine, etc.) by safety-sensitive employees. Other regulations require certain categories of safety-sensitive employees, such as flight crewmembers, locomotive engineers, or truck dri- vers to report any medical use of controlled sub- stances.
