Mt. Vernon Avenue San Bernardino, CA 92411 (9O9) 888-18()() January 9. 1995 Councilman Ralph Hernandez 3rd Ward City Council Office Cite of San Bernardino 300 N. "D" Street San Bernardino. CA 92-410 Dear Councilman Hernandez: Per our conversation in December. The Coalition Without Borders requested to be placed on the City Council meeting agenda to seek a Cite Council motion to oppose the implementation of Proposition 187. As you knoNN. the majoritN of voters of California approved this anti-immigrant and anti-human proposition. Since 85%,of all immigrants. documented and undocumented are Latinos. we believe Proposition 187 and its negative effects Ayill impact primarily the Mexican American and Mexican community. At this time. Nye as an organization of concerned citizens want to publicly thank the five council members that opposed Proposition 187 prior to the election. We consider Proposition 187 to be inhuman and vulgar towards \yomen. children and senior citizens. We request that the Cite Council discuss and adopt a new motion further opposing Proposition 187. We believe that a new motion is needed to ensure that the city's employees and citizens know exactly the council's opposition in no uncertain terms. Because of a recent state court in the provisions of Proposition 187 cannot be implemented. However citizens and employees need to know that in California and San Bernardino all public business shall be conducted in a manner conducive to the atmosphere prior to voters approval of Proposition 187. Respectfully. Dawson, Acting State Superintendent of Public Instruction. It states that the school districts in California have been ordered not to implement Section 7 of Proposition 187. Stuart Pollak, San Francisco Superior Court Judge, entered this Order, and it will be in effect until a further ruling is issued by the Court. According to the Court's Order, no one can: 1. bar any child from public school attendance based on immigration status; 2. inquire about the immigration status of a child or any child's parents or guardian; 3. provide information about immigration status to state or federal authorities; 'Or 4. otherwise interfere with the school attendance of any child based on the immigration status of the child or his/her parent or guardian. Dr. Dawson's notice instructs our District to comply with the Court's Order, and it also requires that we notify all District personnel and all parents/guardians of our students of the Order.
