REQUEST AND LOCATION
A request to change the General Plan land use designation from CG-2, Commercial
General to CH, Commercial Heavy and to establish a parking lot for fleet vehicles for a
cold storage (ice cream) wholesale warehouse. An existing building on site will be
demolished to accommodate a portion of the parking area. The hours of operation are
from 7 a.m. to 8 p.m., 7 days a week. The site is located at 1180 W. Baseline Street at the
northeast corner of Baseline Street and Garner Avenue. (See Exhibit 1, Site Location)
KEY POINTS
• The current land use district CG-2, Commercial General does not permit warehousing
or outside storage. The existing ice cream warehouse is nonconforming in the CG-2,
Commercial General land use district. Approval of the General Plan Amendment to
CH, Commercial Heavy would allow the business to be a permitted use and would
allow the Development Permit to be approved for the intensification of the use for the
fleet parking area.
• The proposed general plan amendment to change the project site to the CH,
Commercial Heavy land use district is consistent with General Plan Objective 1.30 in
that it is an existing site and will allow for outdoor space to park the delivery trucks.
West Baseline Street is a mix of commercial general and commercial heavy land use
districts. This facility and some of the surrounding facilities are appropriate uses in
the Commercial Heavy land use district.
• The proposed amendment would not be detrimental to the public interest, health,
safety, convenience, or welfare of the City, in that the proposed General Plan
Amendment would allow for commercial development consistent with the existing
facility and the surrounding area. The site will be constructed in conformance with
all City requirements.
ENVIRONMENTAL DETERMINATION
The proposed general plan amendment from commercial general to commercial heavy,
and the truck fleet parking lot will not result in any significant environmental impacts to
the site or surrounding area. Section 15061(b)(3) of the CEQA Guidelines states such
activities are covered by the general rule that CEQA applies only to projects that have the
potential for causing a significant effect on the environment. Where it can be seen with
certainty that there is no possibility that the activity in question may have a significant
effect on the environment, the activities are not subject to CEQA.
FISCAL IMPACTS
Compensation for Planning staff time and materials has been provided by the application
fees paid by the applicant upon submittal of this project.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission voted 7 to 0 (Baeza, Garcia, Hendrix, Lockett, Schuiling,
Suarez, and Thrasher) to recommend approval of the General Plan Amendment No. 98-
02, and Development Permit III No. 98-07, based on the Findings of Fact, subject to the
Conditions of Approval and Standard Requirements.
RECOMMENDATION
Staff recommends that the hearing be closed and the resolution be adopted which
approves General Plan Amendment No. 98-02, and Development Permit III No. 98-07,
based on the Finding of Fact, subject to the Conditions of Approval and Standard
Requirements

REQUEST AND PROJECT DESCRIPTION
The applicant requests approval of a general plan amendment to change the land use district
from CG-2, Commercial General, to CH, Commercial Heavy. Also requested is a
development permit III to add outside truck parking. (Attachment A). The Development
Permit is under the authority of Development Code Section 19.44.030 (5)
The current land use district CG-2, Commercial General does not permit warehousing or
outside storage. The existing ice cream warehouse is nonconforming in the CG-2, Commercial
General land use district. Approval of the General Plan Amendment to CH, Commercial
Heavy would allow the business to be a permitted use and would allow the Development
Permit to be approved for the intensification of the use for the fleet parking area. An existing
building on site will be demolished to accommodate the parking area (Attachment B).
The project is located at 1180 W. Baseline Street, at the northeast corner of Baseline Street and
Garner Avenue. The applicant proposes to park 50 ice cream trucks on the site. The hours of
operation are lam to 8pm, 7 days per week. No vehicle maintenance is to be performed on
site.
SETTING/SITE CHARACTERISTICS
The site is comprised of three parcels totaling .76 acres. The entire site is rectangular in shape
and flat. The lot on the corner, to be developed, as a parking lot is a vacant dirt lot. The area
surrounding the project site is CG-2, Commercial General and CH, Commercial Heavy. To
the south is a mix of residential and retail, to the west is residential, to the north and east is
vacantland.
BACKGROUND
The Development Review Committee (DRC) reviewed the project on January 7, 1999, and at
that meeting the DRC recommended that the project be cleared to the Planning Commission.
CALIFORNIA ENVIRONMENTAL QUALITY ACT STATUS (CEQA)
The proposed general plan amendment from commercial general to commercial heavy, and the
truck fleet parking lot will not result in any significant environmental impacts to the site or
surrounding area. Section 15061(b)(3) of the CEQA Guidelines states such activities are
covered by the general rule that CEQA applies .only to projects that have the potential for

ANALYSIS
GENERAL PLAN AMENDMENT
1. Is the proposed amendment internally consistent with the General Plan?
The proposed general plan amendment to change the project site to the CH, Commercial
Heavy land use district is internally consistent with General Plan Objective 1.30 in that it is an
existing site and will allow for outdoor space to park the delivery trucks. West Baseline Street
is a mix of commercial general and commercial heavy land use districts. This facility and
some of the surrounding facilities are appropriate uses in the Commercial Heavy land use
district.
2. Would the proposed amendment be detrimental to the public interest, health, safety,
convenience, or welfare of the City?
The proposed amendment would not be detrimental to the public interest, health, safety,
convenience, or welfare of the City, in that the proposed General Plan Amendment would
allow for commercial development consistent with the existing facility and the surrounding
area. The site will be constructed in conformance with all City requirements.
3. Would the proposed amendment maintain the appropriate balance of land uses within
the City?

The proposed amendment would not affect the balance of land uses within the City in that the
proposal does not add new areas for commercial development, or change the site to a non-
commercial use.
4. In the case of an amendment to the General Plan Land Use Map, is the subject
parcel(s) physically suitable (including, but not limited to, access, provisions of
utilities, compatibility with adjoining land uses and absence of physical constraints)for
the development(s).

The site is physically suitable for the requested CH land use designation and is compatible with
adjoining land uses. There are adequate transportation routes (Baseline Street) and utilities
(sewer, water, electric, gas, telephone and cable) in place.

DEVELOPMENT PERMIT
1. Is the proposed development permitted within the zoning district and will it comply with
all of the applicable provisions of the Development Code, including prescribed
development/site standards and any/all applicable design guidelines?
The project site is located in the CG-2, Commercial General land use district, which does not
permit storage and outside uses. These uses are permitted in the CH, Commercial Heavy land
use district subject to a Development Permit pursuant to Development Code Section 19.44.030
(5). Approval of the associated General Plan Amendment will alleviate the project's
inconsistency with the General Plan and allow for the fleet parking area. The proposed
parking lot is consistent with the Development Code as shown in Attachment C.
2. Is the design of the proposed project consistent with the General Plan?
The proposal is consistent with General Plan Design and Development Guidelines 1.30.30 in
that the site will have extensive landscaped setbacks and a split face decorative block wall for
screening. When completed the project will compliment and contribute to the neighborhood's
character by improving a vacant lot, with landscaping and screening of the parking lot and the
demolition of a vacant building will allow for better circulation for the truck fleet.
3. Would the proposed development be harmonious and compatible with existing
development within the land use district and general area, as well as the subject
property?
The proposed development is consistent with the character of the surrounding commercial
development in the area. The scale, design, and commercial character of the proposed
development improve on the existing commercial neighborhood as describe in Finding #2.
4. Is the approval of the Development Permit for the proposed development in compliance
with the requirements of the California Environmental Quality Act and §19.20.030(6) of
the Development Code?
Planning staff conducted a preliminary review (pursuant to CEQA Guidelines Section 15060)
to determine the presence and extent of any environmental issues that could result from the
general plan amendment and implementation of the project. The general plan amendment is to
change the land use district from Commercial General to Commercial Heavy. The
development permit is for the intensification of a nonconforming use to allow outside truck
parking for the ice cream trucks. Section 15061(b)(3) of the CEQA Guidelines states that

CEQA applies only to projects that have the potential for causing a significant effect on the
environment. This project is covered by the general rule and, as such, is not subject to CEQA.
5. Will there be potential significant negative impacts upon environmental quality and
natural resources that could not be properly mitigated and monitored?
As noted in Finding #4, the project was found to be exempt from CEQA per Section 15301
Class 1 (a), in that the cold storage warehouse is existing and ancillary fleet parking is
proposed.
6. Is the subject site physically suitable for the type and density/intensity of use being
proposed?
As noted in Attachment C, the fleet parking area meets the requirements of the Development
Code pertaining to commercial development and will comply with all City requirements.
7 Are there adequate provisions for public access, water, sanitation, and public utilities
and services to ensure that the proposed use would not be detrimental to the public
health and safety?
The proposed development meets City and State minimum health and safety requirements and
has adequate provisions for the mentioned services as verified by Staff and the City's
Development Review Committee and as listed in the attached conditions of approval.
8. Will the location, size, design, and operating characteristics of the proposed
development not be detrimental to the public interest, health, safety, convenience, or
welfare of the City?
The project meets the minimum requirements of the Development Code for lot coverage,
setbacks, parking, driveways, landscaping percentage, and building design.

CONCLUSION
The proposal meets all applicable Findings of Fact for approval of the General Plan
Amendment and the Development Permit.
RECOMMENDATION
Staff recommends that the Planning Commission recommend that the Mayor and Common
Council;
1. Approve General Plan Amendment No. 98-02 and Development Permit III No. 98-07 based
upon the Findings of Fact contained in this Staff Report and subject to the Conditions of
Approval (Attachment D) and Standard Requirements (Attachment E).

CONDITIONS OF APPROVAL

1. Construction shall have commenced prior to the expiration date or the permit/approval
shall become null and void. In addition, if after commencement of construction, work
is discontinued for a period of one year, then the permit/approval shall become null and
void. Projects may be built in phases if preapproved by the review authority. If a
project is built in preapproved phases, each subsequent phase shall have one year from
the previous phase's date of construction commencement to occurred or the
permit/approval shall become null and void.

Expiration Date: Two years following the Mayor and Common Council action.
2. The review authority may, upon application being filed 30 days prior to the expiration
date and for good cause, grant one time extension not to exceed 12 months. The
review authority shall ensure project complies with all current Development Code
provisions.
3. In the event that this approval is legally challenged, the City will promptly notify the
applicant of any claim or action and will cooperate fully in the defense of the matter.
Once notified, the applicant agrees to defend, indemnify, and hold harmless the City,
its officers, agents and employees from any claim, action or proceeding against the City
of San Bernardino. The applicant further agrees to reimburse the City of any costs and
attorneys' fees which the City may be required by a court to pay as a result of action.
Such participation shall not relieve applicant of his/her obligation.under this condition.
4. This permit or approval is subject to all the applicable provisions of the Development
Code in effect at the time of approval, including Chapter 19.20 (Property Development
Standards). This also includes the following: dust and dirt control during construction
and grading activities; emission control of fumes, vapors, gases and other forms of air
pollution; glare control; exterior lighting design and control; noise control; odor
control; screening; signs, off-street parking and off-street loading; and vibration
control. Screening and sign regulation compliance is an important consideration to the
developer due to the possibility of having the issuance of a Certificate of Occupancy
delayed until compliance has been met. Any exterior structural equipment, utility
transformers, boxes, ducts or meter cabinets shall be architecturally screened by wall or
structural elements and shall blend with the building design and include landscaping
when on the ground.

5. Construction shall be in substantial conformance with the plan(s) approved by the
Planning Commission. Minor modification to the plan(s) shall be subject to approval
by the Director through a minor modification permit process. Any modification which
exceeds 10% of the following allowable measurable design/site considerations shall
require the refiling of the original application and a subsequent hearing by the
appropriate hearing review authority if applicable:
a. On-site circulation and parking, loading and landscaping;
b. Placement and/or height of walls, fences and structures;
C. Reconfiguration of architectural features, including colors, and/or modification
of finished materials that do not alter or compromise the previously approved
theme; and,
d. A reduction in density or intensity of a development project.
6. Construction plans shall be submitted with 30 days of project approval and construction
shall be started within 90 day of project approval.
7. This permit or approval is subject to the attached conditions or requirements of the
following City Divisions and Departments:
a. Public Works (Engineering) Division
b. Development Services Division
c. Parks, Recreation & Community Services Department
d. Public Services Department

e NOTE TO APPLICANT. Where separate Engineering plans are required, the applicant is
responsible for submitting the Engineering plans directly to the Engineering Division. They
may be submitted prior to submittal of Building Plans.
1. Drainage and Flood Control
a) All drainage from the development shall be directed to an approved public
drainage facility. If not feasible, proper drainage facilities and easements
shall be provided to the satisfaction of the City Engineer.
b) If site drainage is to be outletted into the public street, the drainage shall
be conveyed through a parkway culvert constructed in accordance with
City Standard No. 400. Conveyance of site drainage over the Driveway
approaches will not be permitted.
c) Applicant shall mitigate on-site storm water discharge sufficiently to
maintain compliance with the City's NPDES Storm Water Discharge
Permit Requirements.

d) The City Engineer, prior to grading plan approval, shall approve an
Erosion Control Plan. The plan shall be designed to control erosion due
to water and wind, including blowing dust, during all phases of
construction, including graded areas which are not proposed to be
immediately built upon.

2. Grading and Landscaping
a) If more than 1' of fill or 2' of cut is proposed, the site/plot/grading and
drainage plan shall be signed by a Registered Civil Engineer and a
grading permit will be required. The grading plan shall be prepared in
strict accordance with the City's "Grading Policies and Procedures" and
the City's "Standard Drawings", unless otherwise approved by the City
Engineer.
b) An on-site Improvement Plan is required for this project. Where feasible,
this plan shall be incorporated with the grading plan and shall conform to
all requirements of Section 15.04-167 of the Municipal Code (See
"Grading Policies and Procedures").
c) A refuse enclosure constructed in accordance with City Standard Drawing
No. 508. The minimum size of the refuse enclosure shall be 8 feet x 15
feet, unless the Public Services Department, Refuse Division, approves a
smaller size, in writing.
d) The Refuse Division shall approve the number and aIacement of refuse
enclosures.
e) Retaining walls, block walls and all on-site fencing shall be designed and
detailed on the On-site Improvement Plan. This work shall be part of the
On-site Improvement permit issued by the City Engineer.

f) The on-site improvement plan shall include details of on-site lighting,
including light location, type of poles and fixtures, foundation design,
conduit location and size, and the number and size of conductors.
Photometry calculations shall be provided which show that the proposed
on-site lighting design will provide 1 foot-candle of illumination uniformly
distributed over the surface of the parking lot during hours of operation
and 0.25 foot-candles security lighting during all other hours.
g) The design of on-site improvements shall also comply with all
requirements of The California Building Code, Title 24, relating to
handicap parking and accessibility, including retrofitting of existing
building access points for handicap accessibility, if applicable.
h) A handicap accessible path of travel shall be provided from the public way
to the building entrance. All pathways shall be concrete paved and shall
provide a minimum clear width of 4 feet. Where parking overhangs the
pathway, the minimum paved width shall be 6 feet.

i) Where the handicap accessible path of travel crosses drive aisles, it shall
be delineated by striping or textured/colored concrete pavement.
j) The project Landscape Plan shall be reviewed and approved by the City
Engineer prior to issuance of a grading permit. Submit 5 copies to the
Engineering Division for Checking.
k) The public right-of-way, between the property line and top of curb (also
known as "parkway") along adjoining streets shall be landscaped by the
developer and maintained in perpetuity by the property owner. Details of
the parkway landscaping shall be included in the project's on-site
landscape plan, unless the parkway area is included in a landscape
maintenance district, in which case, a separate landscape plan shall be
provided.

1) An easement and covenant shall be executed on behalf of the City to
allow the City to enter and maintain any required landscaping in case of
owner neglect. The Real Property Section for execution by the property
owner and shall ensure that, if the property owner or subsequent owner(s)
fail to properly maintain the landscaping, the City will be able to file
appropriate liens against the property in order to accomplish the required
landscape maintenance. A document processing fee in the amount of
200.00 shall be paid to the Real Property Section to cover processing
costs. The property owner, prior to plan approval, shall execute this
easement and covenant unless otherwise allowed by the City Engineer.
3. Utilities
a) Design and construct all public utilities to serve the site in accordance with
City Code, City Standards and requirements of the serving utility,
including gas, electric, telephone, water, sewer and cable TV (Cable TV
optional for commercial, industrial, or institutional uses).
b) Sewer main extensions required to serve the site shall be constructed at
the Developer's expense.
c) This project is located in the sewer service area maintained by the City of
San Bernardino therefore, any necessary sewer main extension shall be
designed and constructed in accordance with the City's "Sewer Policy and
Procedures" and City Standard Drawings.
d) Utility services shall be placed underground and easements provided as
required.
e) A street cut permit, from the City Engineer, will be required for utility cuts
into existing streets where the street is not being repaved as part of the
required improvements.

6. Applicable Engineering Fees
a) Plan check and inspection fees for off-site improvements - 4% and 4%,
respectively, of the estimated construction cost' of the off-site

- See Development Services-Building Division) - 2% and 3%, respectively,
of the estimated construction costa of the on-site improvements, including

2. The title sheet of the plans must specify the occupancy classification, type of construction, if
the building has sprinklers, & the current applicable codes.
3. The person who prepares them must sign the plans. Also, provide the address & phone
number of that person. Some types of occupancies require that the plans are prepared,
stamped, and signed by an architect, engineer, or other person licensed by the State of
California.
4. For structures that must include an engineers design, provide 2 sets of stamped/wet signed
calculations prepared by a licensed architect/engineer.
5. Provide 2 sets of Title 24/Energy compliance forms and calculations. Some compliance
forms are required to be printed on the plans.
6. Submit grading, site, and/or landscape plans to Public Works/Engineering for plan check
approval and permits. For more information, phone 909-384-5111.
7. Fire sprinkler plans, fires suppression system plans, etc., shall be submitted to the Fire
Department for plan check approval and permits. For information, phone 909-384-5388.
8. Signs require a separate submittal to the Planning Division for plan check approval and

9. Restaurants, food preparation facilities, and some health related occupancies will require
clearances and approved plans from San Bernardino County Health Department. For
information, phone 909-387-3043.
10. Occupancies that include restaurants, car washes, automotive repair/auto body, dentist
offices, food preparation facilities or processing plants, etc. may require approvals and
permits from San Bernardino Water Reclamation. For information, phone 909-384-5141.
11. An air quality permit may be required. Contact South Coast Air Quality Management
Division for information, phone 909-396-2000.
12. State of California Business & Professions Code/Contractors License Law requires that
permits can be issued to licensed contractors or owner-builders (that are doing the work).
Contractors must provide their State license number, a city business registration, and
workers compensation policy carrier & policy number. Owner-builders must provide
proof of ownership.

residential unit OR one set to every two-unit multiple family unit up to six total units.
�2. Each residential lot shall have a 3'x9'concrete pad located out of view of public right of way for storage of three
automated containers and shall have a concrete path of travel from storage pad to curb. Minimum gate widths
shall be 3 feet.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
7 OF SAN BERNARDINO AS FOLLOWS:
8 SECTION 1. Recitals
9
(a) WHEREAS, the General Plan for the City of San Bernardino was adopted by the
10
11 Mayor and Common Council by Resolution No. 89-159 on June 2, 1989.
12 (b) WHEREAS, General Plan Amendment No. 98-02 to the General Plan of the City of
13 San Bernardino was considered by the Planning Commission on February 16, 1999, after a
14 noticed public hearing, and the Planning Commission's recommendation of approval has been
15
considered by the Mayor and Common Council.

17 (c) WHEREAS, the proposed general plan amendment from commercial general to
18 commercial heavy, and the truck fleet parking lot will not result in any significant
19 environmental impacts to the site or surrounding area. Section 15061(b)(3) of the CEQA
20 Guidelines states such activities are covered by the general rule that CEQA applies only to
21
22 projects that have the potential for causing a significant effect on the environment. Where it
23 can be seen with certainty that there is no possibility that the activity in question may have a
24 significant effect on the environment, the activities are not subject to CEQA.
25 (d) WHEREAS, the Planning Commission conducted a noticed public hearing on
26
February 16, 1999 in order to receive public testimony and written and oral comments on
27

General Plan Amendment No. 98-
02 (a proposal to change the General Plan Land Use

1 Designation from CG-2, Commercial General, to CH, Commercial Heavy, for three parcels
2 totaling .76 acres located at the northeast corner of Baseline Street and Garner Avenue,
3
identified as 1180 W. Baseline Street and fully reviewed and considered the Planning Division
4
5 staff report and the recommendation of the Planning Commission.

6 (e) WHEREAS, the Mayor and Common Council held a noticed public hearing and
7 fully reviewed and considered proposed General Plan Amendment No. 98-02 and the Planning
8 Commission and Development Review Committee recommendations and Planning Division
9
Staff Report on April 5, 1999.

11 (fl WHEREAS, the adoption of General Plan Amendment No. 98-02 is deemed in the
12 interest of the orderly development of the City and is consistent with the goals, objectives and
13 policies of the existing General Plan.
14 SECTION 2. Exemption

NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the
16
17 Mayor and Common Council that the proposed amendment to the General Plan of the City of
18 San Bernardino will have no significant effect on the environment, and the Exemption for the
19 this proposed amendment is hereby ratified, affirmed and adopted.

BE IT FURTHER RESOLVED by the Mayor and Common Council of the City of San
22
23 Bernardino that:
24 A. The proposed amendment is internally consistent with the General Plan in that it meets
25 Objective 1.30 which provides for limited commercial and industrial uses characterized
26
by an extensive use of outdoor or indoor space for their sales, service and or storage.
27
28 B. The proposed amendment would not be detrimental to the public interest, health, safety,
2
1 convenience, or welfare of the City in that any development proposed for the site in the
2 future will be required to meet the extensive development standards that are in place to
3
buffer nearby sensitive uses and that enable commercial projects to blend with adjacent
4
5 neighborhoods.
6 C. The proposed amendment would not impact the balance of land uses within the City in
7 that the addition of commercially designated land will provide additional opportunities
8 for economic development that has been lost during the recession of the last several
9
years.

D. In the case of an amendment to the General Plan Land Use Map, the subject parcels are
11
12 physically suitable (including, but not limited to access, provision of utilities,
13 compatibility with adjoining land uses, and absence of physical constraints) for the
14 requested land use designation(s) and the anticipated land use development(s) in that the
15
amendment area is bounded on two sides by developed, dedicated streets, and existing
16
17 infrastructure suitable for urban development.
18 SECTION 4. Amendment
19 WIT FURTHER RESOLVED by the Mayor and Common Council that:
20 A. The Land Use Plan of the General Plan of the City of San Bernardino is amended by
21
changing the land use designation from CG-2, Commercial General, to CH,
22
23 Commercial Heavy, for three parcels totaling.76 acres located at the northeast corner of
24 Baseline Street and Garner Avenue, identified as 1180 W. Baseline Street. This
25 amendment is designated as General Plan Amendment No. 98-02 and its location is
26
outlined on the map entitled Attachment A, and further described in Attachment B,
27
copies of which are attached and incorporated herein for reference.

1 B. General Plan Amendment No. 98-02 shall become effective immediately upon adoption
2 of this resolution.

SECTION 5. Map Notation

5 This resolution and the amendment affected by it shall be noted on such appropriate
6 General Plan maps as having been previously adopted and approved by the Mayor and
7 Common Council and which are on file in the office of the City Clerk.
8 SECTION 6. Notice of Exemption

The Planning Division is hereby directed to file a Notice of Exemption with the County
10
11 Clerk of the County of San Bernardino certifying the City's compliance with California
12 Environmental Quality Act.
