Clark, CMC, City Clerk SUBJECT: Resolution Requesting that the City's Municipal Election be Consolidated with the November 2, 1999 Consolidated Election Conducted by the County of San Bernardino. BACKGROUND INFORMATION• San Bernardino City Charter Section 10 and Municipal Code Section 2.56.010A provide that a primary election shall be held on the first Tuesday after the first Monday in November 1995, and a like election shall be held every four years thereafter for the nomination of candidates for: 1. Member of the Common Council for the Third Ward; 2. Member of the Common Council from the Fifth Ward; 1 3. Member of the Common Council from the Sixth Ward; 4. Member of the Common Council from the Seventh ward; 5. City Clerk; 6. City Treasurer; and 7. City Attorney The County Registrar of Voters Office will be conducting a UDEL (Uniform District Election Law) election on November 2, 1999 for school districts, college districts, etc. Pursuant to the Elections Code, a request to consolidate an election must be filed at least 88 days prior to the election; therefore, the attached Resolution is presented for the City Council to request the consolidation of our next election with the election being conducted by the County. Nomination papers will be issued by the City Clerk's Office; however, the County Registrar of Voters Office will designate polling places, issue absentee ballots, conduct the election, tally votes and conduct the canvass. The nomination period opens on Monday, July 12, and closes at 5 p.m. on Friday, August 6. If an incumbent officer does not file nomination papers by the 88"' day prior to an election, then the nomination period for that office is extended to the 83`d day before the election. If a runoff election is required in any of the City posts up for election, it will be a stand-alone, City- conducted election, held on February 1, 2000. 1 have submitted, as a cost saving measure, a suggestion that the Mayor and Council consider placing a charter amendment on the November 2, 1999 ballot that, if passed, would allow the February 2000 runoff election (if one is required) to be consolidated with the Presidential primary election. 1 If such an amendment were approved, it would accomplish the following: • Significantly reduce the costs of a general election since the costs of a consolidated election are shared by participating entities. If the City conducts a stand-alone election, the City bears the entire cost of the election. • Significantly increase voter turnout since there is a higher voter turnout for Presidential elections than for stand-alone municipal elections. • Eliminate confusion that might arise having two elections one month apart. • Eliminate problems encountered in trying to recruit election officers/polling places for back-to-back elections. On June 2 , 1992 , the voters of the City of San 10 Bernardino voted to amend City Charter Section 10 to change the dates of the City' s primary election from March of odd-numbered 11 12 years to November of odd-numbered years and the general 13 election dates from May to the following February. 14 B . Section 2 . 56 . 010 A. of the San Bernardino Municipal Code provides that a primary election shall be held on the 15 first Tuesday after the first Monday in November 1995 , and a 16 17 like election shall be held on the first Tuesday after the first Monday in November every four years thereafter, in the 18 19 City for the nomination of candidates for the following offices : 20 1 . It is desirable that the City of San Bernardino' s 5 primary election be consolidated with the consolidated election 6 to be conducted by the County of San Bernardino on Tuesday, 7 November 2 , 1999 ; that within the City of San Bernardino the 8 precincts, polling places and election officers for the two 9 elections be the same; that the Registrar of Voters of the 10 County of San Bernardino canvass the returns of the City 11 election; and that the consolidated election and the City' s 12 primary election be held in all respects as if there were only 13 one election. 14 SECTION 2 . Municipal Primary Election Called. A 15 municipal primary election is called and will be held in the 16 City of San Bernardino on Tuesday, November 2 , 1999, for the 17 purpose of nominating candidates for the following offices : 18 1 . Member of the Common Council from the Third Ward; 19 2 . Member of the Common Council from the Fifth Ward; 20 3 . Member of the Common Council from the Sixth Ward; 21 4 . Member of the Common Council from the Seventh Ward; 22 S . City Clerk; 23 6 . City Treasurer; 24 7 . Request for Consolidation of Elections . 5 Pursuant to Section 10400 of the Elections Code, the Mayor and 6 Common Council of the City of San Bernardino request that the 7 Board of Supervisors of the County of San Bernardino 8 consolidate the City' s municipal primary election with the 9 consolidated election to be held on Tuesday, November 2, 1999 . 10 The polls for said election shall be open at 7 : 00 a.m. of 11 the day of said election and shall remain open continuously 12 from said time until 8 : 00 p.m. of the same day when said polls 13 shall be closed, except as provided in Section 14401 of the 14 California Elections Code . 15 SECTION 4 . Canvass of Returns . The Registrar of Voters 16 of the County of San Bernardino is hereby authorized to canvass 17 the returns of the municipal primary election called by this 18 resolution and to conduct the municipal primary election in all 19 respects as if there were only one election with only one form 20 of ballot . Results of the municipal election shall be 21 certified to the Mayor and Common Council of the City of San 22 Bernardino. 23 SECTION 5 . Notice of Election. The City Clerk is hereby 24 directed to publish a notice of the municipal primary election 25 which shall contain the following: 26 27 3 28 1 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO REQUESTING THAT THE CITY OF SAN BERNARDINO' S ' 2 MUNICIPAL ELECTION BE CONSOLIDATED WITH THE NOVEMBER 2 , 1999, CONSOLIDATED ELECTION CONDUCTED BY THE COUNTY OF SAN 3 BERNARDINO. 4 A. The time of the election. 5 B . The offices to be filled, specifying full term or 6 short term. 7 C. The hours the polls will be open. 8 SECTION 6 . Conduct of Election. The municipal primary 9 election called by this resolution shall be held in such 10 precincts and at such polling places as shall be determined by 11 the Registrar of Voters of the County of San Bernardino. The 12 Board of Supervisors of the County of San Bernardino is hereby 3 13 requested to issue instructions to the Registrar of Voters to 14 take all steps necessary for the holding of the consolidated 15 election. The Mayor is hereby authorized to execute a contract 16 for the services necessary for conducting the municipal primary 17 election. The City of San Bernardino recognizes that 18 additional costs will be incurred by the County by reasons of 19 this consolidation and agrees to reimburse the County for any 20 such costs . 21 SECTION 7 . Filing of Resolution.
