1 STAFF REPORT
Subiect:
Resolution awarding Contract to Malton Construction for the Construction of New Restroom Facilities at
Ninth Street Park located at 1201 W. Ninth Street per Plan No. 9942.
Background:
On September 30, 1998, the Director of the Department of Parks and Recreation executed a Memorandum of
Understanding (MOU), CDBG Project No. 98-229, with the Economic Development Department authorizing
the design and construction of new restroom facilities for Ninth Street Park.
This project consists of demolition of an existing substandard restroom and construction of a new 700 square
foot restroom, including plumbing chase, storage area, hand dryers, vandal resistant partitions, stainless steel
plumbing fixtures, vandal proof lighting, and handicap accessible concrete pathways to the new facilities.
Bids for the project were received on May 11, 1999. The bids ranged from $85,675 to $219,375, with
Malton Construction of Riverside being the lowest bidder.
The estimated total project cost based on the low bid is as follows:
Construction Contract: $85,675
Engineering Staff Costs (W.O. 5041) $ 1,568
Inspection & Contract Administration (10%±) Ll,.432
Subtotal: $ 95,675
Contingencies (Approx. 15%) L11325
Grand Total: $108,000
We estimate that construction can start in July 1999 and be completed by the end of September 1999.
Financial Impact:
Funding for this project is provided in CDBG Project No. 98-229, in the total amount of $135,000.
Therefore, this project will be 100% reimbursable from the CDBG grant and will be accomplished at no cost
to the City.
Recommendation:
That the Mayor and Common Council adopt Resolution awarding a Contract to Malton Construction for the
Construction of New Restroom Facilities at Ninth Street Park located at 1201 W. Ninth Street per Plan No.
9942.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
3 CONTRACT TO MALTON CONSTRUCTION FOR THE REPLACEMENT OF
RESTROOM BUILDING AT 9TH STREET PARK LOCATED AT 1201 W. 9TH STREET
4 PER PLAN 9942.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. MALTON CONSTRUCTION is the lowest responsible bidder for the
8 Replacement of Restroom Building at 9' Street Park per plan no. 9942. A contract is awarded
9 accordingly to said bidder in a total amount of $85,675.00 but such award shall be effective
10
11 only upon being fully executed by both parties. All other bids, therefore, are hereby rejected.
12 The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a
13 copy of the contract is on file in the office of the City Clerk and incorporated herein by
14 reference as fully as though set forth at length.

SECTION 2. This contract and any amendment or modifications thereto shall not take
16
17 effect or become operative until fully signed and executed by the parties and no party shall be
18 obligated hereunder until the time of such full execution. No oral agreements, amendments,
19 modifications or waivers are intended or authorized and shall not be implied from any act or
20 course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
22
23 within sixty (60) days of the passage of the resolution.

Park.
Just checking on the status of this.
Authorization for this contract expires on 8/6/1999.
This was on the agenda 6/7/99 - Item#15 - Res 1999-128.
