09-08-98 - The Mayor and Common Council gave authorization to proceed with a 30-year ground lease
with California Golf Holdings, LLC, 290.00 feet north of the northwest corner of Highland
Avenue and Orange Street.
03-01-99 - Resolution No. 1999-35 was adopted authorizing the execution of a Lease Agreement with
California Golf Holdings, LLC.

SUBJECT:
Resolution authorizing execution of a First Amendment to Lease --- California Golf Holdings, LLC. - 290.00
feet north of the northwest corner of Highland Avenue and Orange Street.
BACKGROUND:
On 09/08/98, authorization was given to proceed with a 30 year ground lease with California Golf Holdings, LLC,
for a portion of City owned property located 290.00 feet north of the northwest corner of Highland Avenue and
Orange Street. The area leased is for a proposed golf cart path relative to the proposed Patton Station Sports
Resort.
It was subsequently noted that an error had been made in the legal description describing the area to be leased.
This action amends the lease to correct the description. The area intended to be leased remains the same and all
other terms of the lease stay in effect and are not amended.
FINANCIAL IMPACT:
None
RECOMMENDATION:
Staff recommends that the attached Resolution amending the lease be adopted.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
3 EXECUTION OF A FIRST AMENDMENT TOA LEASE WITH CALIFORNIA GOLF
4 HOLDINGS, LLC, A CALIFORNIA LIMITED LIABILITY COMPANY, RELATING
TO CERTAIN PROPERTY LOCATED 290.00 FEET NORTH OF THE NORTHWEST
5 CORNER OF HIGHLAND AVENUE AND ORANGE STREET.
6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

8 SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and
9 directed to execute on behalf of said City, a First Amendment to a Lease Agreement with
10 California Golf Holdings, LLC, A California Limited Liability Company, relating to certain
11
real property located 290 feet North of the Northwest corner of Highland Avenue and Orange
12
Street. Said First Amendment is to correct an error in the legal description. A copy of said
13
14 First Amendment is attached as Exhibit "A" and made a part hereof.
15 SECTION 2. The authorization to execute the above referenced agreement is
16 rescinded if the parties to the agreement fail to execute it within sixty (60) days of the passage
17
of this resolution.
