Background: Over the years, the City has formed assessment districts throughout the City for various types of improvements or maintenance. The majority of these are landscape maintenance assessments districts that were formed as a result of a petition from the developers of various tracts . The assessment districts provide a means of funding the maintenance of landscaping that was installed throughout these developments, as a condition of approval. The annual assessments include the contract costs for maintenance, water and energy, inspection and administration. The landscape maintenance districts are AD 951 (Zones 1 and 2), 952 (Zones 1, 2, 2A, and 3), 953, 956, 959, 968, 974, 975, 976, 981, 982, 986, 989, 991, 993, 997, 1001, 1002, 1005, 1007,1016, 1017, 1020, 1023 and 1024. The 1999/2000 Assessment Roll for AD 1024 was previously approved on December 8, 1998 and is not a part of this action but only referenced for information and will be included in the rolls being transmitted to the County. There are also 4 Assessment Districts for the maintenance of a sewer lift station. These districts are AD 962, 963, 989 and 1024 (the latter two also includes landscape maintenance). Since all of these districts are for maintenance, the assessments are collected in perpetuity or until termination of the assessment district. Additionally, there are presently 2 assessment districts that were formed for construction. These districts are AD 973 and 1004, which are for traffic signal construction. AD 973 will terminate in 2000, and AD 1004 will terminate in 2002. With the passage of Proposition 218 in November of 1996, new procedures and requirements became necessary not only for the formation of assessments districts but also for the annual levies. However, certain types of districts are "exempt" from the procedural requirements of Proposition 218. The exemptions can be based on, but not limited to, a district being formed by 100% approval of the property owners at the time the district was formed. This is the case with a large portion of the districts since these were formed when they were still under one ownership. Exemptions are also allowed for districts that were formed for construction or maintenance of streets and street improvements, including traffic signals and landscaping within the street right of way. Assessments for districts that are found to be exempt do not need to go through the property owner ballot approval process that is now required by Proposition 218, unless there is an increase in the assessment amount. Even in the case of an increase, if the methodology or the rate of assessment remains the same, the exemption may still apply. None of the Assessment Rolls presented here are an increase over any prior approved assessment. Although AD 973 shows an increase from last years assessment of $5,597.30 to this years assessment of $6,615.08, the assessment amount was set by a pre-determined rate when the district was formed and is not subject to proposition 218 ballot requirements. The attached summary lists the various districts being submitted, and the present and prior year's assessment amounts. Maps have also been attached showing the boundaries of the various assessment districts. Financial Impact: The assessments pay the City's maintenance and or construction costs for the various Districts. If the assessments are not approved, the City will have to bear these costs, or discontinue maintenance, which could Rely leave these areas in a blighted condition. Resolutions confirming the 1999/2000 Assessments will be on the June 7, 1999 Council agenda. After confirmation of the assessment rolls by the Mayor and Common Council,please indicate the various resolution numbers and adoption dates as appropriate, and complete the certification of adoption and return one executed set to this office. We will also need one regular and one certified copy of each resolution, after adoption. Please note that, as last year, the rolls will be filed with the County via floppy disk, for placement on the 1999/2000 property tax bills. Please also note, there will not be a need to have the special Public Meeting and Public Hearing on the last Monday of May and June , respectively,this year, since none of the districts are increasing and no Proposition 218 ballot procedures will need to be implemented. COPY 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 3 1999/2000 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 951, ZONE 1 AND ZONE 2, LANDSCAPING CONSTRUCTION AND MAINTENANCE DISTRICT, 4 WAGONWHEEL ROAD AREA. 5 WHEREAS, by Resolution No. 81-482, the Mayor and Common Council found that the 6 public interest, convenience, and necessity required the formation of a landscaping construction 7 8 and maintenance district; and 9 WHEREAS, by said Resolution No. 81-482, the Mayor and Common Council formed 10 an assessment district known as Assessment District No. 951 for the purpose of providing 11 landscaping construction and maintenance in the Wagonwheel Road area pursuant to the 12 provisions of Chapter 12.90 of the San Bernardino Municipal Code; and 13 WHEREAS, by Resolution No. 81-360, the Mayor and Common Council declared that 14 all the land included within the boundaries of said district receive a special benefit by the 15 16 construction and maintenance of said landscaping; and 17 WHEREAS, said Resolution No. 81-360 declared that an annual assessment shall be 18 levied on all land within the district to provide funding for said landscaping construction and 19 maintenance and the administration thereof; and 20 WHEREAS, the payments on the construction portion of the district were spread over a 21 five (5) year period and the last assessment levied thereon was on the 1987-88 Assessment Roll 22 23 and subsequent assessments are only for the maintenance and administration of the landscaping; 24 and 25 WHEREAS, an Assessment Roll has been prepared totaling $5,251.40 for Zone 1, 26 6,822.20 for Zone 2, which sets forth the individual assessments to be levied on each of the 27 parcels of land within Assessment District No. 951 for the fiscal year 1999/2000; and 28 WHEREAS, Article XIII D of the California Constitution requires that any and all 05/10/99 1 RESOLUTION CONFIRMING 1999/2000 ASSESSMENT ROLL NO.951, ZONE 1 AND ZONE 2 1 (WAGONWHEEL ROAD AREA LANDSCAPING MAINTENANCE) 2 3 Assessment Districts existing on the effective date of said Article XIII D shall comply with the 4 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set 5 forth in Section 5 therein. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 7 CITY OF SAN BERNARDINO AS FOLLOWS: 8 SECTION 1.
