Extension of Orange Show Road, between Arrowhead Avenue
and Tippecanoe Avenue, will entail construction of a new grade
crossing at the Santa Fe Railway. The existing minor grade
crossing on Ennis Street will be closed as a part of the project
for extension of Orange Show Road.
It was felt that the new grade crossing would be safer
than the existing, since it will be protected by flashing lights
and automatic gates . An application was submitted to the Public
Utilities Commission for an ' order to authorize construction of
the new grade crossing, contingent upon closing the existing one
on Ennis Street.
A protest was filed by the Santa Fe Railway Company on
the new crossing. Negotiations were conducted with Santa Fe in
an attempt to convince them to withdraw their protest.
In the event that Santa Fe would not withdraw their
protest, a public hearing would have to be held by the Public
Utilities Commission. This hearing would result in a year' s
delay, with an unknown outcome.
The Santa Fe representative stated that he would be
willing to withdraw his protest if the crossing were at right
angles with the railway. This would result in having to acquire
additional rights-of-way, creating more unusable parcels , intro-
ducing undesirable reversing curves in the road alignments , and
lengthening the bridge over the East Twin Creek Channel. After
extensive negotiations, the Santa Fe representative agreed to
withdraw his protest if the Broadway Street and Main Street Grade
Crossings could also be closed.
Extension of "F" Street, south of Rialto Avenue, was en-
visioned by the Central City South Redevelopment Plan. This
extension would necessitate a new public grade crossing over the
Santa Fe Railway. The Santa Fe Railway Company agreed to the
construction of this new grade crossing, contingent upon the
Broadway Street and Main Street crossings being closed.
Authorization to proceed with the vacation of Broadway
Street and Main Street was granted at the Council Meeting of 2-1-
88. After extensive public hearings, Resolution No. 89-378 was
adopted at the Council Meeting of 9-22-89 , to order the vacation
of these streets. Section 5 of this resolution states that it
will not be in effect until such time as the Public Utilities °
Commission has granted an order to authorize construction of the
new grade crossing on "F" Street, in connection with the Central
City South Redevelopment Project.

The Central City South Project has not proceeded. There
is a question if the "F" Street extension is really needed, and
would a.ctuall-v be built as a part of the Central City Project.
Development of the Central City South Project could occur without
the "F" Street crossing.
Therefore, we recommend that Section 5 of Resolution No.
89-378 be amended to refer to the Orange Shaw Road Crossing in
lieu of the "F" Street crossing. Approval of this substitution
will allow the Orange Show Road extension to proceed without
having to incur the extra costs and delays that would result in
revising the alignment to achieve a right angle intersection with
the Santa Fe Railway.

8 hereby amended to read as follows :
9 "This resolution shall have no effect until such time as
10 the California Public Utilities Commission has issued an order
11 authorizing construction of a new grade crossing for the
12 extension of Orange Show Road with the Southern California
13 Regional Rail Authority railway, west of Waterman Avenue. "

2 A RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE VACATION
OF PORTIONS OF MAIN STREET AND BROADWAY STREET BETWEEN "I" AND "J" STREETS
3 IN THE CITY OF SAN BERNARDINO AND RESERVING AN EASEMENT FOR SANITARY SEWER
AND APPURTENANT FACILITIES, WATER LINES AND PUBLIC UTILITIES THEREIN.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO AS FOLLOWS:
6 SECTION 1: The Mayor and Common Council of the City of San
7 Bernardino, having heard the evidence offered in relation to the proposed
8 vacation of portions of "lain Street and Broadway Street between "I" and
9 "J" Streets in the Citv of San Bernardino and described in City Resolution
10 of Intention No. 88-344, hereby find from all of the evidence submitted
11 that such street proposed to be vacated by said Resolution is unnecessary
12 for present or prospective street purposes.
13 SECTION 2. The Mayor and Common Council of said City do hereby
14 vacate portions of Main Street and Broadway Street between "I" and "J"
15 Streets, San Bernardino, California, more particularly described as
16 follows:
17 Those portions of `fain Street and Broadway in the City
of San bernardino, County of San Bernardino, State of
18 California, described as follows:
19 PARCEL ONE: That portion of Broadway Street, delineated
as that certain unnamed East/West Street on the Map of
20 Carter's Subdivision, as per plat recorded in Book 3 of
Maps, page 79, records of said County, described as
21 follows:
22 Commencing at the Northeast corner of Lot 11 of said
subdivision, said point also being on the South line of
23 said Broadway Street; thence East, along said South line
to the West line of the A. T. & S. F. Railroad Right of
24 Way, and the true point of Beginning; thence East, along
the South line of said Broadway Street, to the East line
25 of said Railroad Right of Way, said point also being on
the South line of Lot 6 of said subdivision; thence West
26 along the North line of said Broadway Street, to the
West line of said Railroad Right of Way; thence
27 Northeasterly, along a straight line, to the True Point
28 of Beginning.

I PARCEL TWO: That portion of Main Street, delineated as
2 that certain unnamed East/West Street on the Map of
Carter's Subdivision, as per plat recorded in Book 3 of
3 Maps, page 79, records of said County, described as
follows:
4 Commencing at the Northwest corner of Lot 20 of said
5 subdivision, said point also being on the South line of
said main Street; thence East, along said South line to
6 the West line of the A. T. & S. F. Railroad Right of Way
and the True Point of Beginning; thence East, along the
South line of said Main Street, to the east line of said
Railroad Right of Way ; thence North, along a straight
8 line, to the intersection of the North line of said Main
Street and the East line of said Railroad Right of Way
9 said point also being on the South line of Lot 1 of said
subdivision; thence West along said South line, to the
10 West line of said Railroad Right of Way ; thence South,
along a straight line, to the True Point of Beginning.
11 and is also described in said Resolution of Intention No. 88-344.
12 SECTION 3. Nothing in this Resolution shall in any way
13 affect or disturb any existing easements for sanitary sewer and
14 appurtenent facilities or for public utility purposes belonging
15 either to the City of San Bernardino or to any public utility and
16 there is hereby reserved an easement for future utility purposes for
17 this City and for public utility purposes, more particularly an
18 easement for sanitary sewer and appurtenant facilities for the City of
19 San bernardino, in over, under and across the portion of real property
20 hereinabove described as Parcel One, and for water lines and
21 appurtenant facilities to the City of San Bernardino over the entire
22 portion of the real property hereinabove described, and for Southern
23 California Gas Company Company, an easement and right at any time, or
24 from time to time to construct, maintain, operate, replace and renew
25 appurtenances thereto for the transportation of natural gas, in, over,
26 under and across the entire portion of real property described as
27 Parcel One hereinabove and for GTE California Inc. , an easement and
28 right at any time, or from time to time to construct, maintain,

1 operate, replace and renew appurtenances thereto for the transmission
2 of communication signals, in, over, under and across the entire
3 portion of real property hereinabove described.
4 SECTION 5. This Resolution shall have no effect until the
5 Public Utilities Commission has given approval for the grade crossing
6 at "F" Street, South of Rialto Avenue, across the A.T. & S.F. Railroad
7 Right of Way, in the City of San Bernardino.
8 SECTION 4. The City Clerk of the City of San Bernardino
9 shall cause a certified copy of this resolution to be recorded in the
10 office of the County Recorder of the County of San Bernardino only
11 when the conditions set forth in Section 5 hereinabove, have been
12 fulfilled.
