Vernon Ave. Finance: Council Notes: 75-0262 Agenda Item No. CITY OF SAN BERN' ­`1DINO - REQUEST K Z COUNCIL ACTION STAFF REPORT Conditional Use Permit No. 93-17 was approved to authorize the Transdevelopment Corporation to develop a GM vehicle distribution center. A Traffic Study was submitted by Transdevelopment to assess the impact of trucks that would be transporting the new vehicles from this site. This study indicated that the main access route would be Rialto Avenue, "I" Street and Second Street. After the facility was opened, the access route was re- evaluated. It was determined that Mt. Vernon Avenue would be a better link than "I" Street. An addendum to the Traffic Study was prepared to assess the impacts of the vehicle hauling trucks using Mt. Vernon Avenue, in lieu of "I" Street. This addendum has been reviewed by the City' s Traffic Engineer and found to be acceptable. The addendum was conditioned upon the reconstruction of the northwest curb return, at the intersection of Rialto Avenue and Mt. Vernon Avenue, in order to allow the southbound trucks to turn without swinging over the centerline on Rialto Avenue. Approximately 300 square feet of additional right-of-way will be needed to accommodate reconstructing the curb return with a 35-foot radius. Transdevelopment has attempted to acquire this additional right-of-way from the owner of the parcel on the northwest corner, but has been unsuccessful. Transdevelopment has requested that the City acquire the additional 300 square feet of right-of-way by eminent domain. All costs incurred by the City will be reimbursed by Transde- velopment. Acquisition of this small amount of right-of-way will not adversely impact the tire shop in business on this parcel. We recommend that authorization be granted to proceed to acquire an immediate right-of-possession for the required addi- tional right-of-way. 1-27-94 5-0264
