HOMEOWNERS' COST IN UNDERGROUNDING (UTILITY DISTRICT No. 23) - The Committee received a report from the City Engineer regarding general procedures for undergrounding from the home owners' property line to their house. Other than normal senior or low income assistance,there were no other recommendations presented. The report was received and filed with the caveat that the City Engineer would advise of EDA's responses when they became available. 2. 9/80 WORK WEEK PLAN - The Committee, on a 1-1 vote, recommended this item back to the Council for December 20 recognizing that Councilman Oberhelman, who was not present, supported the program. 3. TAXING SINGLE FAMILY RENTAL UNITS - The Committee received a report from Mr. Ott. After extensive discussion, the Committee recommended billing be changed from two years to one. Any other changes were considered to be a matter for individual Councilmembers to introduce to the full Council. December 9, 1993 Page -2- 4. PUBLIC COMMENTS - A review of Attorney Barlow's August 9 submission revealed that the public speaker need not give street name in their address; therefore, the use of a P. O. Box number was adequate. Consideration will be given to placing Public Comments at the end of the agenda and reducing the amount of comment time to three minutes. City Attorney DATE: August 9, 1993 RE: Public Comments COPY TO: Tom Minor, Mayor All Council Members Shauna Clark, City Administrator Questions have arisen as to how the Mayor and Council can allow adequate and meaningful public comments and testimony on agenda items and still accomplish the people's business in light of the recent practice of a few individuals in commenting at length on almost every item on the agenda, as well as addressing the council under the public comments section. Since 1953, local agencies in California have been governed by the provisions of the Ralph M. Brown Act (Government Code 554950, et seq. ), one of the earliest open meeting laws in the country. The declaration of guiding policy is found in the very first section of this Act: "In enacting this chapter, the legislature finds and declares that the public corrurtissions, boards and councils and the other public agencies in this state exist to aid in the conduct of the people 's business. It is the intent of the law that their actions be taken openly and that their deliberations be conducted openly. "The people of this state do not yield their sovereignty ro the agencies which serve them. The people, in delegating authority, do not give their public servants the right to decide what is good for the people to know and what is not good for them to know. The people insist on remaining informed so that they may ret=ain control over the instruments they have created. " Government Code §54950. In the 1990 federal case of White v. City of Norwalk (9th Cir. 1990), 900 F.2d 1421, the court considered an issue where an individual was prevented from continuing to speak because of being "unduly repetitive. " The court stated: DAB/bq [LRC.Mem] �� Memo to Legislative Review Committee August 9, 1993 Page 2 "City council meetings like Norwalk's, where the public is afforded the opportunity to address the council, are the focus of highly important individual and governmental interests. Citizens have an enormous first amendment interest in directing speech about public issues to those who govern their city. It is doubtless partly for this reason that such meetings, once opened, have been regarded as public forums, albeit limited ones. [Citations omitted] . "On the other hand, a city council meeting is still just that, a governmental process with a governmental purpose. The council has an agenda to be addressed and dealt with. Public forum or not, the usual first amendment antipathy to content-oriented control of speech cannot be imported into the council chambers intact. In the first place, in dealing with agenda items, the council does not violate the first amendment when it restricts public speakers to the subject at hand. [Citations omitted] . While a speaker may not be stopped from speaking because the moderator disagrees with the viewpoint he is expressing [Citations omitted] , it certainly may stop him if his speech becomes irrelevant or repetitious. "Similarly, the nature of a council meeting means that a speaker can become 'disruptive' in ways that would not meet the test of actual breach of the peace [Citation omitted] , or of ' fighting words' likely to provoke immediate combat. [Citation Omitted] . A speaker may disrupt a council meeting by speaking too long, by being unduly repetitious, or by extended discussion of irrelevancies. The meeting is disrupted because the council is prevented from accomplishing its business in a reasonably efficient manner. Indeed, such conduct may interfere with the rights of other speakers. " Id. at 1425-1426, footnotes omitted. In recognizing these two competing interests, the right of the public to address their governing bodies and the necessity of the governing bodies to consider and take action on the items before them, the legislature has adopted Government Code §54954.3 which provides: "(a) Every agenda for regular meetings shall provide an opportunity for members of the public to address the legislative body on any item of interest to the public, before or during the legislative body's consideration of the item, that is within the subject DAB/bg [LRC.Mem) Memo to Legislative Review Committee August 9, 1993 Page 3 matter jurisdiction of the legislative body, provided that no action shall be taken on any item not appearing on the agenda unless the action is otherwise authorized by subdivision (b) of Section 54954.2. However, in the case of a meeting of a city council in a city. . the agenda need not provide an opportunity for members of the public to address the council. . . on any item that has already been considered by a committee, composed exclusively of members of the council. . . , at a public meeting wherein all interested members of the public were afforded the opportunity to address the committee on the item, before or during the committee's consideration of the item, unless the item has been substantially changed since the committee heard the item, as determined by the council. . . "(b) The legislative body of a local agency may adopt reasonable regulations to ensure that the intent of subdivision (a) is carried out, including, but not limited to, regulations limiting the total amount of time allocated for public testimony on particular issues and for each individual speaker. " Pursuant to the invitation in Section 54954.3(b) quoted above, the Mayor and Council have adopted Resolution No. 87-1 as amended by Resolution No. 87-60 and Resolution No. 88-280. As to public comments, Resolution 87-1 provides that the opportunity for public comments shall be on the agenda as the first item. Resolution No. 87-60 imposes a five ( 5) minute time limit on public comments (subject to amendment by the Council ) and grants the Mayor the power to impose a similar time limit on speakers on agenda items. It also provides that repetitive comments may be limited. Resolution No. 88-280 also adds a total forty-five (45) minute limitation on public comments (unless extended) and prohibits the sharing of the allotted five ( 5) minutes. In determining what, if any, further controls the Mayor and Council may desire to place on either the public comments portion of the meeting or the comments directed to particular agenda items, the need to orderly dispose of the public's business must be balanced against the right of members of the public to address their elected representatives, even if such right is exercised in a manner that may be offensive or impolite. A review of the above statutes, Resolutions and the current case law reveals that essentially all the action allowed has been taken by the Council. Certainly, the Council can assure that those who speak stick to the subject and are not repetitive but those are already provided for in the adopted rules.
