RE: Annexation Proposal (Agenda Item #23 )
This matter was discussed at the Agenda Briefing on January 7 and
the question was raised as to who was allowed to apeak at the
hearing.
Government Code 557051 provides that with respect to uninhabited
land (which this is ) any owner of the land to be annexed may file
a written protest. That certainly eliminates everyone but Ca1Mat.
However, Government Code §57050 provides that at the hearing, the
Mayor and Council "shall hear and receive any oral or written
protests, objections, or evidence which is made, presented, or
filed. " This is not limited to owners of the property. This
section, coupled with the Brown Act requirement that the public may
address the Mayor and Council on any item of interest before or
during the consideration of the item (Government Code 554954.3 ) ,
results in the conclusion that any interested member of the public
may speak and the hearing is not limited to input from only those
who own property within the area to be annexed or are registered
votes therein. However, only the protests of those within that

06-21-93 -- Resolution No. 93-205, making application to LAFCO, was approved.
09-07-93 -- Resolution No. 93-337, amending Resolution No. 93-205, was adopted
and Resolution No. 93-338, determining the amount of property tax
transfer, was adopted.
12-06-93 -- Resolution No. 93-442 was adopted initiating proceedings and setting
a public hearing relative to the proposed reorganization.
Recommended motion:
1. That the hearing relative to the reorganization of the territory generally
located Southwest of Cajon Boulevard, Southeast of Devore Road, be closed.

STAFF REPORT
Pursuant to a petition received by this office in December of 1989, the Director
of Public Works/City Engineer and the City Clerk were authorized to proceed with
the proposed annexation of the unincorporated area Southeasterly of Devore Road,
Southwesterly of Cajon Boulevard.
On June 21, 1993, Resolution No. 93-205 was approved, making application to the
Local Agency Formation Commission (LAFCO) for the proposed annexation and on
September 7, 1993 Resolution No. 93-337 was adopted, amending Resolution No. 93-
205, correcting the legal description. At that same hearing, Resolution No. 93-
338 was adopted, determining the amount of property tax to be transferred from
the County to the City if the proposal is approved.
On October 20, 1993, the Local Agency Formation Commission held a public hearing
regarding the proposed annexation and at that hearing adopted a resolution
approving the annexation.
On 12-06-93, Resolution No. 93-442 was adopted, setting a public hearing. All
Property owners in the affected territory and effected agencies and other
interested parties were given notice by mail and by publication of the hearing.
After the closing of the hearing, the attached Resolution must be adopted, in the
absence of a majority protest by property owners. Since the petitioner represents
a majority of the property owners (the others being utility companies and rail
road) , it is anticipated that no majority protest will be presented.

3 PROPERTY OWNERS OWNING LESS THAN FIFTY PERCENT (50%) OF THE ASSESSED VALUE
OF THE TERRITORY PROPOSED TO BE REORGANIZED HAVE BEEN FILED AND ORDERING
4 ANNEXATION NO. 343 (LAFCO 2758) FOR THE TERRITORY GENERALLY LOCATED
SOUTHWESTERLY OF CAJON BOULEVARD, SOUTHEASTERLY OF DEVORE ROAD AND
5 ANNEXATION TO THE SAN BERNARDINO ),'ALLEY MUNICIPAL WATER DISTRICT AND
DETACHMENTS FROM CENTRAL VALLEY FIRE PROTECTION DISTRICT AND CSA 38, CSA 38-

7 WHEREAS, pursuant to the provisions of the Cortese-Knox Local
8 Government Reorganization Act of 1985, Division 3, commencing with section
9 56000 of the California Government Code, proceedings were initiated by the
10 Common Council of the City of San Bernardino, for reorganization of certain
11 contiguous uninhabited territory hereinafter described; and
12 WHEREAS, a Landowner in the proposed reorganization has requested
13 annexation to the City of San Bernardino to receive extended urban services;
14 and
15 WHEREAS, the Local Agency Formation Commission has set forth the
16 following terms and conditions in its Resolution No. 2341:
17 "Condition No. 1 . The conducting authority for this
18 proceeding shall be the City of San Bernardino.
19 "Condition No. 2. The boundaries are approved as set forth
20 in Exhibits "A-1" , "A-2" , and "A-3" attached.
21 "Condition No. 3. The following distinctive short form
22 designation shall be used throughout this proceeding: LAFCO 2758.
23 "Condition No. 4. All previously authorized charges, fees,
24 assessments, and/or taxes currently in effect by the City of San Bernardino
25 and the San Bernardino Valley Municipal Water District (annexing agencies)
26 shall be assumed by the annexing territory in the same manner as provided in
27 the original authorization pursuant to Government Code Section 56844(c) .

"Condition No. 5. The City of San Bernardino, as the

initiator of this proposal , agrees to defend, indemnify, hold harmless, and
3
provide for reimbursement or assumption of all legal costs in connection
4
with approval of this proposal .
5
"Condition No. 6. The date of issuance of the Certificate
6
of Completion shall be the effective date of this reorganization. "

WHEREAS, a public hearing was set for the 10th day of January, 1994,
8
at the hour of 10:00 am in the Council Chambers of City Hall , 300 N. "D"
9
Street, San Bernardino, California, and the same was the day, hour and place
10
designated where any and all persons owning land within the territory
11
proposed for reorganization may file a. written protest with the City Clerk,
12
prior to the conclusion of said hearing; and
13
WHEREAS, all owners of land within the territory proposed for
14
15 reorganization, and all affected agencies were notified of said hearing by
mailing, publication and posting of a "Notice of Public Hearing" pursuant
16
to the provisions of California Government Code Section 57025.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
18 BERNARDINO AS FOLLOWS:
19 SECTION 1. That pursuant to Section 57050 of the California Government
20 Code, a hearing was held on the day, and at the time and place as set forth
21 hereinabove, and protests were filed and received by property owners owning
22 less than fifty percent (50%) of the total assessed value of the area
23 proposed for reorganization, by the conclusion of said hearing.
24 SECTION 2. A description of the boundaries for the reorganization are
25 more fully described in the attached Exhibit "A-1" (annexation to the City
26 of San Bernardino) , Exhibit "A-2" (annexation to the San Bernardino Valley
27 Municipal Water District) and Exhibit "A-3" (detachment from Central Valley
28 Fire Protection District) , attached hereto and incorporated by reference as
fully as though set forth in length.

2 SECTION 2. Said territory herein described in said Exhibit "A-1" ,
3 known as Annexation No. 343 designated as LAFCO 2758, is hereby annexed and
4 incorporated in and made a part of the City of San Bernardino.
5 SECTION 3. The area described as said Exhibit "A-2" is herebv annexed
6 into the San Bernardino Valley Municipal Water District and is subject to
7 all the normal fees and assessments of said district; and
8 SECTION 4. The above annexed territory described in said Exhibit "A-1"
9 will be subject to taxation equally with the property within such municipal
corporation.

11 SECTION 5. The regular County Assessment Roll is utilized by the City
12 of San Bernardino and San Bernardino Valley Municipal Water District.
13 SECTION 6. The property herein annexed to the City of San Bernardino
14 is declared to be a part of Ward 6 and the boundaries of Ward 6 are hereby
15 altered to include said annexed territory, and has a designated land use of
16 as set forth in Specific Plan 90-01, General Plan Amendment 91-18 and the
City's General Plan as it now exists.

SECTION 7. The area included in the above annexation is hereby

19 detached from County Service Area 38, Improvement Zone G of County Service
20 Area 38, County Service Area 70, Improvement Zone A of County Service Area
21 70, and detached from the Central Valley Fire Protection District, as
22 described in said Exhibit "A-3" , without split of assets or liability.
23 SECTION 8. The City Clerk shall cause a certified copy of this
24 Resolution to be forwarded to the Executive Officer of th Local Agency
Formation Commission.
