Descriotion) Finance: Council Notes: -- ---- Ananrla Itnen Met � �� CITY OF ,SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT To: Mayor and Common Council From: Rachel Clark, City Clerk Date: March 4 , 1993 San Bernardino Municipal Code Section 2 . 56. 110 provides that on the date of elections polls shall open at seven a.m. and close at sE�ven p.m. Therefore, for City-conducted elections the polls have always closed at 7 p.m. , one hour earlier than County- conducted elections. By having a different closing hour voters are often confused. For example, in the June and November elections, conducted by the County, polls closed at 8 p.m. On Tuesday, March 2nd, the County conducted an election for a Redlands school bond measure and their polling places closed at 8 p.m. ; however, our City polling places closed an hour earlier. To be consistent with all other elections and also taking into consideration that voters who commute from out of town may need more time to get to the polls, I request that the Mayor and Council approve the attached ordinance which changes the hour of closing for polls on City-conducted elections. In 1992 the voters approved a Charter change which will allow us to consolidate City elections with the County, beginning in 1995. A consolidated election, conducted by the County, would only apply to a primary election and the City would still be required tc conduct run-off elections on any special elections in the future. 75-0264 i 1 ORDINANCE NO. 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SAN BERNARDINO MUNICIPAL CODE 52. 56. 110A TO PROVIDE THAT POLLS IN CITY 3 ELECTIONS SHALL REMAIN OPEN UNTIL 8 :00 P.M. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 SECTION 1 . Subsection A of Section 2. 56 . 110 of the San 6 Bernardino Municipal Code is hereby amended to read as follows: 7 "A. The hour of seven a.m. on the date of elections is 8 fixed as the hour for opening the polls, and the hour of eight 9 p.m. of said date is fixed as the hour for closing the polls at 10 such elections; provided, however, that if at said hour of closing 11 there are any other voters in the polling places or in line at the 12 door thereof who are qualified to vote and who have not been able 13 to do so since appearing, the polls shall be kept open a 14 sufficient time to enable them to vote, but no one who arrives at 15 a polling place after eight p.m. shall be entitled to vote, 16 although the polls may be open when such person arrives. Primary 17 and general elections shall be held at the regularly designated 18 polling places in each precinct as designated in the resolution 19 setting forth the number of consolidated precincts and the 20 location of each polling place. The officers of election 21 appointed and the polling places designated for the primary 22 election shall be the officers and polling places of the general 23 election so far as possible. Such resolution shall also set forth 24 the list of the names of the election officers appointed. Each 25 precinct board shall consist of one inspector, one judge and two 26 clerks.
