12-07-92 -- Contact Change Order No. 3 approved, for installation
of street light, for increase in contract of $5 , 445 . 00;
from $3 , 568 , 987 . 30 to $3 , 574 , 432 . 30 .
Recommended motion:
That Change Order No. 5 to the contract with Brutoco Engineering &
Construction Co. , for the widening of South "E" Street Bridge, in
accordance with Plan No. 8347 , be approved; to authorize payment to
the Contractor for extra work, for an increase in the contract
price of $93 , 155 . 88 ; from $3 , 600 , 365 . 23 to $3 , 693 , 521 . 11 .

STAFF REPORT
All work in connection with widening the South "E" Street
Bridge over the Santa Ana River was satisfactorily completed as
of 3-15-93 .
During construction, the Contractor placed the City on
notice of certain claims. However, no specific quantities or
costs were provided with these notices .
Recently the Contractor submitted amounts for 12 items .
The two largest items are for the actual quantity of earthwork
being larger than the estimated amount in the contract documents .
The other item is for additional quantities of concrete rip rap
having to be placed, due to the fact that the existing rip rap
was not installed in accordance with the plans .
All claims by the Contractor are included in the amount of
$93 , 155 . 88 for Contract Change Order No. 5 . Therefore, approval
of this change order will settle all claims by the Contractor and
allow the project to be closed out.
We have reviewed the amounts listed on Change Order No. 5 ,
and feel they are fair and reasonable for the work involved.
Therefore, we recommend that Contract Change Order No. 5 be
approved to authorize additional payment of $93 , 155 . 88 , for an
increase in the contract price from $3 , 600 , 365 . 23 to
$3 , 693 , 521 . 11 . The additional payment to be authorized by Change
Order No. 5 represents about 3% of the contract price.
There is a current balance in contingencies of
$575 , 624 . 49 , which will be used to finance the cost of this extra
work.
URGENCY CLAUSE
The Contractor has agreed to the amount of $93 , 155 . 88 as payment
for all outstanding claims , contingent upon it being remitted by
4-15-93 , in order for them to be able to pay their sub-
contractors .

CONTRACT CHANGE ORDER NO. FIVE
TO: Brutoco Engineering & Construction, Inc.

Gentlemen:
You are hereby authorized and directed to perform the following
work:
1) Provide additional survey to establish centerline control, and
restaking of the curb & gutter on the south end of the bridge
approach, at a total cost of $4 , 311. 92 .
2) Compensation for the additional work required in construction of
revisions to Piers 6, 7 and 8 , and revision of the hinges at the
closure pour, at a total cost of $13 , 922 . 87 .
3) Raise an existing manhole approximately 4 feet above its present
height, located at station 24+90, at a total cost of $1,763 .78 .
4) Credit for the deletion of concrete and earthwork at the south-
east end of abutment No. 1, at a total credit of ($5, 885.90) .
5) Relocation of existing landscape and irrigation mainlines at
the north and south sides of the bridge, for a total cost of
$6, 302 . 78 .
6) Remove and dispose of existing asphalt, concrete curb & gutter
and buried man-made objects, located at in and around the north
bridge roadway approach. Install concrete Asphalt concrete berm
at the northwest and southeast County Flood Control access
roads, at a total cost of $4 , 592 . 42 .
7) Relocate the existing fencing and ornamental gate at the
entrance to the Subaru Dealership, to fit the raised elevations
of the street improvements at that location, at a total cost of
$3 , 400. 16.
8) Pursuant to Section 12-2 . 02 of the Standard Specifications of
the State of California, the contractor is entitled to be
compensated for 1/2 of the total cost of flagging, the total
cost of this compensation is $4 , 635. 27 .

9) Compensation for the deductible of the contractors insurance
policy covering the washout of the Rip-Rap at bridge
abutment No. 1, located at the south end of the bridge, at a
total cost of $10, 000. 00.
10) Compensate the contractor for 1, 485. 23 cubic yards of Imported
dirt, at the contract price of $2 . 50 per cubic yard, at a
total cost of $2 , 875. 00.
11) Compensate the contractor for 1, 206.21 cubic yards of
Embankment, at the contract price of $12 . 00 per cubic yard, at
a total cost of $14 , 474 . 52 .
12) Compensate the contractor for 444 . 5 Cubic Yards of additional
Concreted Rock Slope Protection, at the contract price of
$70. 00 per cubic yard, at a total cost of $31, 925. 00.
