A total of 4 bids were received, ranging from $357,925 to $503 , 100 . The low bid of $357 , 925 is 25 . 2% under the Engineer' s Estimate of $478 , 725 . Additive Alternates were included in the contract documents to allow maximum flexibility. It is recommended that these alternates be included in the contract award to the extent that funds are available. Location Amount Boys & Girls Club $ 227 , 150 Ruben Campos Center 175, 000 Lytle Creek Center 71 , 400 Nicholson Center 40 , 000 Senior Citizens Center 77, 000 Total Available Funds - $ 590 , 550 We recommend that a contract be awarded to the low bidder for the Base Bid plus all Additive Alternates . 3-30-93 I RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO KIRKLEY DEVELOPMENT, INC. , FOR GENERAL IMPROVEMENTS 3 TO THE BOYS AND GIRLS CLUB, RUBEN CAMPOS, LYTLE CREEK, NICHOLSON, AND SENIOR CITIZENS CENTERS . 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. Kirkley Development, Inc. , is the lowest 7 responsible bidder for: General Improvements to the Boys & Girls 8 Club, Ruben Campos , Lytle Creek, Nicholson and Senior Citizens 9 Centers, per Plan No. 8889 . A contract for the Base Bid and all 10 Additive Alternates, except for No. 7 at Ruben Campos Center and 11 No. 2 at Nicholson Center, is awarded accordingly to said bidder 12 for the total amount of $507, 594 . 00, but such award shall be 13 effective only upon the contract being fully executed by both 14 parties . All other bids, therefore, are hereby rejected. The 15 Mayor is hereby authorized and directed to execute said contract 16 on behalf of the City; a copy of the contract is on file in the 17 office of the City Clerk and incorporated herein by reference as 18 fully as though set forth at length. 19 SECTION 2 . This contract and any amendment or modifica- 20 tions thereto shall not take effect or become operative until 21 fully signed and executed by the parties and no party shall be 22 obligated hereunder until the time of such full execution. No 23 oral agreements , amendments, modifications or waivers are 24 intended or authorized and shall not be implied from any act or 25 course of conduct of any party. 26 SECTION 3 . This protest is based upon improper license classification of the apparent low bidder , Wyatt Construction, California State License Number 453858 . Wyatt Construction is licensed as a class "B" , General Building Contractor . I am quoting from Section 7057 of the California Contractors License Law and Reference Book, 1988 Edition page 113 - "A general building contractor is a contractor whose principal contracting business is in connection with any structure built , being built , or to be built , for support , shelter and enclosure of persons , animals , chattels or movable property of any kind, requiring in its construction the use of more than two unrelated building trades or crafts , or to do or superintend the whole or any part thereof . " Further quotation from detailed analysis section 834 , paragraph ( B ) , page 203 - "A licensee classified as a general building contractor , as defined in Section 7057 of the Code, shall not take a prime contract ( excluding framing or carpentry) unless it requires at least three unrelated building trades or crafts , or unless he/she holds the required specialty license(s ) . A general building contractor shall not take a subcontract ( excluding framing or carpentry) involving less then three unrelated trades or crafts unless he/she holds the required specialty license(s ) . " I am demanding a clarification from the Contractors State License Board before this contract is awarded to Wyatt Construction . I am further requesting written reply from the City of San Bernardino in regards to this protest . Further , I do not accept Mr . Gene Klatt as an authority on contract license law.
