STAFF REPORT
Proposed Contract No. 93-56 authorized a co-operative
project with the County of San Bernardino for rehabilitation of
the pavement on Pacific Street, from Perris Hill Road to Del Rosa
Drive.
The contract provides, in general, that the County will
act as lead agency, and finance 62 . 5% of the total cost.
Furthermore, that the rehabilitation will be designed in
accordance with the Caltrans Design Manual to provide a minimum
10-year service life. The City agrees to reimburse the County
for its proportionate share of the total cost, estimated to be
$105, 000.
An amount of $107 , 000 has been allocated, under Account
No. 129-309-57738 , to finance the City' s share of the cost.
We recommend that the contract be approved.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF STANDARD CONTRACT NO. 93-56 WITH THE COUNTY OF SAN
3 BERNARDINO RELATING TO THE REHABILITATION OF PAVEMENT ON PACIFIC
STREET, FROM PERRIS HILL ROAD TO DEL ROSA DRIVE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1 . The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute, on behalf of said
8 City, Standard Contract No. 93-56 with the County of San
9 Bernardino relative to rehabilitation of pavement on Pacific
10 Street, from Perris Hill Road to Del Rosa Drive, a copy of which
11 is attached hereto, marked Exhibit "A" and incorporated herein by
12 reference as fully as though set forth at length.

IT IS HEREBY AGREED AS FOLLOWS:

determination of satisfactory performance and cause for termination, other terms and conditions, and attach plans, specifications, and addenda, if any.)
W I T N E S S E T H
WHEREAS, the COUNTY OF SAN BERNARDINO (hereinafter referred to as COUNTY) and the
CITY OF SAN BERNARDiNo (hereinafter referred to as CITY; and
WHEREAS, CCXRM and CITY desire to cooperate and jointly participate in a project
to rehabilitate Pacific Street from Perris Hill Park Read to Del Rasa Drive (hereinafter
referred to as PR47ECT) ; and
WHEREAS, PROTECT is partially (approximately 62.5%) in the unincorporated area
of the COUNTY and partially within the incorporated area (approximately 37.5%) of the
CITY and will be of mutual benefit to the COUNTY and CITY; and
WHEREAS, it is anticipated that the funding for the construction phase of the
PROTECT will be from COUNTY Measure I funds and CITY local funds; and
WHEREAS, COUNTY and CITY desire to set forth responsibilities and obligations of
each as pertains to such participation and to the design, construction, and funding of
the proposed improvements.
NOW, THEREFORE, IT IS MUIUAIL,Y AGREED AS FOLIDIRS:
1.0 COUNTY AGREES TO:
1.1 Act as the Lead Agency in the design and construction of the PROTECT.
1.2 Provide plans and specifications and all necessary construction engineering
for the PROTECT.

1.3 Construct the PRa7DCI' by contract in accordance with the plans and
specifications of COUNTY and Caltrans Design Manual, 10 year life, to the
satisfaction of and subject to concurrence of the CITY.
1.4 Arrange for relocation of all utilities which interfere with construction
of the PROTECT within the unincorporated area.
1.5 Obtain a no-cost permit from CITY for work within the CI`I'Y's right of way.
1.6 Advertise, award, administer, and fund the construction of the PROTECT.
1.7 Require its contractors to maintain Workmen's Compensation Insurance on all
employees and a Public and Property Damage Liability Insurance Policy of
not less than $1,000,000 combined single limits liability coverage for bodily
injury and/or property damage which shall name the CI'T'Y OF SAN BERNARDINO
as an insured party.
1.8 Provide adequate inspection of all items of work performed under the
construction contract and maintain adequate records of inspection and
materials testing for review by CI'T'Y.
1.9 Accept responsibility for its proportionate share of the cost of construction
of the PROTECT, based on the COUNTY's determination of the actual cost of
work in the unincorporated area plus design, constriction engineering, and
overhead. Where feasible one ccuponent of the proportionate share shall
be based on actual quantities of unit price items. COUNTY Is estimated share
of design, construction and construction engineering cost is $175,000 to
be funded frotn the COUNTY's Measure I funds.
1.10 Submit to CI'T'Y an itemized accounting of the project cost and a statement
for CITY's share of the cost as provided herein.
1.11 After acceptance of the construction contract, maintain those portions of
PROTECT within the unincorporated area of the COUNTY.
2.0 CITY AGREES TO:
2.1 Accept responsibility for its proportionate share of the design, ccnstnx-ticn,
construction engineering, and overhead of the PROTECT based on the COUNTY's
determination of the actual costs in the incorporated area of the CITY.
Where feasible one component of the proportionate share shall be based on
actual quantities of unit price items. CITY's estimated share of the design,
motion and construction engineering cost including overhead is $105,000.
2.2 Reimburse COUNTY, within thirty (30) days after receipt of an itemized
statement as set forth in paragraph 1.10 of this amt setting forth
all cost of PROJECT to be borne by the CITY.
2.3 After acceptance of the construction contract work, maintain those portions
of the PROTECT within the incorporated area of the CITY.
2.4 Arrange for relocation of all utilities which interfere with construction
of the PROTECT within the incorporated area.

3.0 IT IS FUInliER AGREED THAT
3.1 The CITY agrees to indemnify, and hold harmless the COUNTY and their
authorized agents, officers, volunteers and employees against any and all
claims or actions arising frat CITY's negligent acts or omissions and for
any costs or expenses incurred by the COUNTY or CITY on account of any claim
therefore.
3.2 The COUNTY agrees to indemnify, and hold harmless the CITY and their
authorized agents, officers, volunteers and enployees against any and all
claims or actions arising frcxn COUNTY negligent acts or omissions and for
any costs or expenses incurred by the COUNTY or CITY on account of any claim
therefore.
3.3 After opening of bids, estimate of cost will be revised based on actual bid
prices.
3.4 After opening bids for the PRaTECI' and if bids indicate a cost overrun of
no more than 25% of the estimate will occur, COUNTY may award the contract.
3.5 If, upon opening of bids, it is found that a cost overrun exceeding 25% of
the estimate will occur, COUNTY and CITY shall endeavor to agree upon an
alternative course of action. If, after 30 days, an alternative course of
action is not agreed upon, this Agreement shall be deemed to be terminated
by mutual consent.
3.6 This agreement may be cancelled upon thirty (30) days written notice of
either party, however, costs incurred up to the effective date of cancellation
shall be shared in the manner provided heretofore.
3.7 This agreement shall terminate upon coanpletion of the project and payment
of final billing by the CITY for its share of the project.
THIS AGREEMENT shall inure to the benefit of and be binding upon the successors
and assigns of both parties.
IN WITNESS VhI MMF, the parties hereto have caused this agreement to be executed
by their respective officials thereunto duly authorized.
