Synopsis of Previous Council Action:
On April 6, 2015, the City Council approved the City's CDBG Action Plan ("CDBG
Budget") for the 2015/2016 Fiscal Year Budget. The total budget is $4,429,414.20,
including amendments and budget adjustments (Exhibit A)
Background:
Each year the City adopts a CDBG Budget which includes funding for a broad range of
city projects and priorities. Each project approved by Council is tracked by the Housing
Division of the City Manager's Office to ensure the funds are spent in a timely manner.
It is typical for program staff to analyze the spending patterns and trends of departments
carrying out projects funded entirely or in part with CDBG funds to determine whether
those projects will complete within the specified timeline. The primary purpose of
tracking funded projects is to determine whether funding should be reallocated from
stagnant projects to shovel ready projects.
Each City receiving CDBG funds is required to show its intent to expend in a timely
manner by committing not less than 1.5 times its annual allocation amount to projects.
Each year, the timeliness test is applied by May 02. As an example, if the City received
$1,000,000 per year on average in CDBG funds, then the City could not maintain

$1,500,000 in its credit line by May 02. If it were anticipated that on or after May 02 that
$1,600,000 would be the credit line balance then staff would prepare a substantial
amendment to allocate $100,000 to additional projects.
Unfortunately, spending patterns suggest that department expenditures will not cause
the City to meet the timeliness test. The total amount of funded projects for this fiscal
year, $4,429,414.20, is still $1,439,963 less than the amount necessary to ensure the
city's timely expenditure of CDBG funds. (Exhibit B) In order to meet the expenditure
goal, staff is recommending allocating CDBG funds to eligible projects already in the
City's Public Works' Department pipeline, particularly in the areas of Americans with
Disabilities Act (ADA), and pipeline projects in Parks and Recreation, particularly in the
areas of playground mobility improvements.
Analysis:
Currently, $4,429,414.20 of CDBG funds is programmed into the current fiscal year
budget as shown in Exhibit A. Of that amount, $1,608,956.80 has been spent by on
program and projects and of those expenditures, a total of $1,350,566.39 has been
reimbursed.
Statement of the Issue
Changes to the CDBG Budget can only be made through the City's adopted Substantial
Amendment/Citizen Participation Process (Exhibit B), which requires:
1. The entire text of the proposed amendment be made available for reasonable
public review and comment period; and
2. Following the public comment period a public hearing is held to consider the
proposed changes to the Annual Action Plan; and
3. At the conclusion of the public hearing, the proposed changes may be adopted
by the Mayor and Common Council as part of the Annual Action Plan.
Federal regulation requires that HUD be notified of all changes to the City's Action Plan.
An updated Plan and/or activity listing will be forwarded to HUD upon final approval by
the City Council.
Substantial Amendment Process:
The project proposed is a roof replacement of the City's main Public Library, Feldheym
Central Library, located at 555 West 6th Street (Exhibit C). According to the Project
Proposal provided by the Department of Public Works the total roof replacement cost for
the Feldheym Central Library would be $650,000. The City of San Bernardino
Engineering Division estimates that this project will be complete by September 1, 2016.
It is anticipated that a recommendation for award of contract with a construction
company will be presented to the Mayor and Common Council on May 2, 2016.

All expenses would be covered with Community Development Block Grant (CDBG)
funds, there is no impact to the General Fund.
Citizen Participation Process
In accordance with federal regulations the Draft Substantial Amendment to the One-
Year Action Plan will be available for public review for a thirty (30) day period, at the
following locations:

The San Bernardino City Council will hold a Public Hearing to solicit public comment
from interested citizens, non-profit public service organizations and other public
agencies. The Public Hearing will be held on March 7, 2016, 5:30 p.m. at San
Bernardino City Council Chambers, located at 300 North "D" Street, San Bernardino
92418.
The City of San Bernardino encourages citizen participation in the CDBG process. If

I. INTRODUCTION AND POLICY STATEMENT a

It is the policy of the City of San Bernardino to provide for community involvement in the planning, N
development, implementation, monitoring and evaluation of programs funded under the Housing and
Community Development Acts of 1974 and 1977, as amended, and the Cranston-Gonzales Act of 1990. N

The Citizen Participation Plan("Plan") sets forth the procedures and guidelines to be implemented by the o
City to provide for the continuing participation by the citizens of San Bernardino. While the City desires CA
and recognizes the need for citizen involvement and has appointed the Community Development Citizen
Advisory Committee (CDCAC) to provide citizen input, it is the City Council which has final as
determination and responsibility for all aspects of the City's housing, community development and

homeless programs. This Plan, originally adopted in 1975, may be amended from time to time by the
Common Council and shall remain in effect until superseded by a new Plan or until the City no longer Q
participates in the Community Development Block Grant Program, Home Investment Partnership M
Program and Emergency Shelter Grant Program, or other programs that pertain to the consolidated r_
planning process as required by 24 CFR parts 91, et. al.

A summary of the primary objectives of the Plan are provided below: (1) Ensure that citizens are
informed of the amount of funds available under the Plan, the range of activities that may be undertaken,
as well as the various program requirements; (2) Provide for public hearings on community development t0

and housing needs; (3) Provide citizens with adequate opportunities to participate in the development of =
the Consolidated Plan with any required changes, revisions, or amendments to the plan; (4) Provide 2
technical assistance to citizens in developing specific proposals for funding consideration; (5) Provide an a
on-going process for citizens likely to be effected by program activities, to articulate needs, express
preferences about proposed activities, assist in selecting priorities, and participate in the overall a
development of the Consolidated Plan; (6) Provide a process through which citizens may participate in =
the monitoring and evaluation of community development and housing activities; and (7) Provide a N
process whereby citizens may comment with respect to any aspect of the City's housing and community v
development performance and be assured that oral and written comments will be considered and o0
responded to in accordance with federal regulations.
III. STANDARDS OF PARTICIPATION w
All aspects of the City's citizen participation efforts shall be conducted in an open manner with freedom m
of access to all interested parties. The City encourages the involvement of all income groups,particularly E
those living in blighted areas, and in areas where CDBG funds are proposed to be used including non-
English speaking persons, as well as persons with mobility, visual or hearing impairments, members of a
minority groups, the elderly, the disabled, the business community, civic groups and the community at
large.

While this Plan describes a specific citizen's organization as the mechanism to receive citizen input
C, (CDCAC), it is not intended to exclude any individual citizen input. All the citizens of San Bernardino
are encouraged to participate in every public meeting and to contact the Redevelopment Agency, Housing
and Community Development Division with any questions concerning the process and the programs
pertaining to the Plan including the Community Development Block Grant Program, Home Investment
Partnership Program, Emergency Shelter Grant Program, or any other applicable future programs.

To help facilitate citizen input, the City's Redevelopment Agency, Housing and Community CO

Citizen Advisory Committee as well as to groups representing low and moderate income residents who N
may require such assistance in developing proposals for federal funding as required by federal
regulations. Technical assistance will be provided by telephone, meetings, and workshops throughout the

The summary of the proposed Plan will be published in one or more newspapers of general circulation in
compliance with 24 CFR 570.302 and 91.105 (b)(4),providing a 30-day oral and written comment period.
Under unforeseeable circumstances, a reasonable public notice and comment period is defined, as two Q
weeks (15-day). The summary will provide the contents and the purpose of the Plan and a list of
locations where copies of the entire proposed Plan will be available to the public. A summary of any oral
or written comments regarding the proposed Plan will be attached to the final Plan.

The City will utilize the CDCAC and other forums of public participation to reach out to the Community.
Letters of invitation to attend the public hearing to receive input on housing and non-housing community
development needs will be sent to community service organizations, business organizations, Chamber of
Commerce, religious organizations and any other applicable groups and affected parties showing an
interest in the Plan. The City will also coordinate its planning activities with the Housing Authority as
well as any other applicable inter-governmental jurisdictions impacted by the Plan.

The City will make every reasonable effort to provide written responses to complaints within 15 working cao
days in compliance with 24 CFR 91.105(i). A copy of each written citizen comment or complaint N
regarding the City's housing and community development performance under the Plan, the City's

will be kept on file as a public record.
XII. PUBLIC MEETINGS AND PUBLIC HEARINGS

The City will conduct public meetings and public hearings during various phases of the Plan process each
program year. All public meetings and public hearings shall be open to the public. Meetings will be held E
at times and at locations in the City that are convenient and acceptable to potential and actual
beneficiaries. Special accommodations shall be made for persons with disabilities upon advance notice QE
and as necessary. In cases where a significant number of non-English speaking residents are reasonably
expected to participate,an interpreter will be provided by the City upon advance notice.
The CDCAC will meet, confer and hold public meetings as needed, to review issues related to the Plan
and plan performances, etc. Moreover, the Common.Council shall conduct a total of two (2) public vi
hearings during the program year. A first public hearing will be held to obtain views on the proposed
Plan prior to its review and adoption by the Common Council. A second public hearing will be held to

structural fluted metal roof deck. The age of the existing roof appears to

penthouse roof areas. The combined roof areas total approximately
46,000 square feet.

The skylight located on the northeast section of the roof was observed to

be beyond its useful life. Large sections of the skylight have deteriorated T
and need replacement. The age of the existing skylight appears to be in

The overall condition of all roof areas is very poor. Significant deterioration
has occurred with the age and exposure that has occurred over the life E
span of the roof. Numerous repairs have been made over the years to
