(See Attached) MOTION: That the appointments of Sam Frisby and Robert Hampton to the Parks and Recreation Commission, as requested by Council Members Devlin and Anderson, be approved. 3. PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA: A three- minute limitation shall apply to each member of the public who wishes to address the Mayor and Common Council/Community Development Commission on a matter not on the agenda. CONSENT CALENDAR MOTION: That the motions indicated by consent calendar items 6 through 15, be adopted except for , and 3 8/3/1998 6. Waive full reading of resolutions and ordinances. MOTION: That full reading of the resolutions and ordinances on the regular, supplemental and addendum to the supplemental agendas of the Mayor and Common Council/Community Development Commission, be waived. 7. Council Minutes. MOTION: That the minutes of the following meeting of the Mayor and Common Council of the City of San Bernardino be approved as submitted in typewritten form: June 23, 1998 (Distributed on 7/30/98) 8. Claims and Payroll. (See Attached) MOTION: That the claims and payroll and the authorization to issue warrants as listed on the memorandum dated July 29, 1998, from Barbara Pachon, Director of Finance, be approved. 9. Personnel Actions. (See Attached) MOTION: That the personnel actions as submitted by the Chief Examiner, dated July 22, 1998, in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. City Attorney's Office 10. Ordinance of the City of San Bernardino amending portions of Titles 2, 3, 5, 8, 9, 10, 12, 13, 15 and 16 of the San Bernardino Municipal Code relating to the consolidation of the Personnel Department and Risk Management and the Departments of Planning and Building Services and Public Works. FIRST READING (See Attached) MOTION: That said ordinance be laid over for final adoption. 4 8/3/1998 Development Services 11. Resolution of the City of San Bernardino noticing a public hearing relative to the formation of Underground Utility District No. 26, generally located along portions of Mill Street, between Lena Road and Tippecanoe Avenue, Lena Road between Mill Street and Tennis Court Lane and Tippecanoe Avenue between Central Avenue and Benedict Road. (See Attached) (No cost to the City) Ward 1 MOTION #1: That the Director of Development Services and the City Clerk be authorized to proceed with the establishment of Underground Utility District No. 26 located along portions of Mill Street between Lena Road and Tippecanoe Avenue, Lena Road between Mill Street and Tennis Court Lane and Tippecanoe Avenue between Central Avenue and Benedict Road; and MOTION#2: That said resolution be adopted. 12. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of Program Supplement No. 001-M of Local Agency Federal-Aid Projects, between said City and the State of California, acting by and through its Department of Transportation relating to construction of barrier rails on Rialto Avenue at BNSF Railroad Bridge 54C-0378 and on Highland Avenue at Del Rosa Channel Bridge No. 54C-0227. (See Attached) (Cost to the City -- $223,200 from the Street Construction Fund [to be reimbursed from Federal Aid].) Wards 3 & 4 MOTION: That said resolution be adopted. 13. Authorize installation of directional kiosk signs in street right-of- way in Inland Center Drive and "I" Street. (See Attached) (No cost to the City.) MOTION: That the Mayor and Common Council approve in concept the request to install directional kiosk signs in the street right-of-way of Inland Center Drive and "I" Street; that the City Attorney be directed to prepare a license agreement to authorize encroachment within the right-of-way subject to the conditions contained in Attachment 6, and that the Mayor be authorized to execute the agreement. Police 14. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of two (2) separate amendments to contracts 95-1062 and 95-282 between the County of San Bernardino and the City of San Bernardino for (1) equipment and user access into the National Law Enforcement and California Law Enforcement Telecommunication Systems (NLETS 8v CLETS); and (2) equipment and user access into the Sheriff's Department Central Name Index (CNI). (See Attached) (Cost to the City -- $29,353.80 from the General Fund.) MOTION: That said resolution be adopted. 15. A resolution of the City Council of the City of San Bernardino, California, supporting the construction and operation of a Criminal Justice Center, containing adult and juvenile detention facilities, in the High Desert by the San Bernardino County Sheriff's Department and Sheriff Gary Penrod. (See Attached) MOTION: That said resolution be adopted. END OF CONSENT CALENDAR 6 8/3/1998 vivo COMMITTEE CONSENT CALENDAR Recommended for approval by the Ways and Means Committee on July 22, 1998 - Council Members Present: Schnetz, Devlin, and Anderson City Administrator's Office 16. A resolution of the City of San Bernardino authorizing an agreement with the San Bernardino and Western Regional Little League Baseball for financial assistance from the Civic and Promotion Fund for FY 1998-99. (See Attached) (Cost to the City -- $18,000 [ $5,000 in direct costs, and $13,000 in indirect costs ] from the General Fund.) (Resolution and agreement not available at time of printing.) MOTION#1: That said resolution be adopted; and MOTION #2: That direct funding from the FY 1998/99 civic and promotion fund in the amount of $5,000 and indirect funding for departmental costs in an amount not to exceed $13,000 be authorized to assist the San Bernardino Western Regional Little League in the 1998/99 season. Resolution of the Mayor and Common Council of the City of San Bernardino amending Resolution No. 655 entitled, in part, "A resolution...designating certain streets, or portions thereof, as through highways...;" and authorizing the installation of a four- way stop at the intersection of Medical Center Drive and Sixteenth Street. (See Attached) (Cost to the City -- $800 from the General Fund.) Ward 6 MOTION: That said resolution be adopted. 7 8/3/1998 18. Resolution of the Mayor and Common Council of the City of San Bernardino amending Resolution No. 3985 entitled, in part, "A resolution...prohibiting parking upon certain designated streets or portions thereof..." to establish No Parking from Six P.M. to Six A.M. Zone on the north side of Esperanza Street from Arrowhead Avenue to Mt. View Avenue, and a No Parking Anytime Zone on the south side of Esperanza Street between Arrowhead Avenue and Mt. View Avenue. (See Attached) (Cost to the City -- $800 from the General Fund.) Ward 3 MOTION: That said resolution be adopted END OF STAFF REPORTS 8 8/3/1998 *WAW MAYOR AND COMMON COUNCIL AND THE COMMUNITY DEVELOPMENT COMMISSION CITY OF SAN BERNARDINO RECONVENE MEETING COMMUNITY DEVELOPMENT COMMISSION MONDAY, AUGUST 3, 1998 - 2:00 P.M. PRESENT: ABSENT: R19. Approve Emergency Shelter Grant Program funding awards, and authorize execution of the agreements. (See Attached) (No cost to the City -- $152,000 from Federal Emergency Shelter Grant funding.) MOTION: That the Mayor and Common Council approve the designation of The Salvation Army, Mary's Mercy Center, Frazee Community Center and Option House, Inc., as FY 1998/99 Emergency Shelter Grant Program recipients and authorize execution of agreements. R20. Economic Development Agency Budget - Fiscal Year 1998-99. (See Attached) A. Resolution of the Community Development Commission of the City of San Bernardino, California, amending Resolution No. 5277, as amended, to delete positions in the Economic Development Agency. B. Resolution of the Community Development Commission of the City of San Bernardino, California, amending Resolution No. 5282, as amended, pertaining to Economic Development Agency Management and Confidential Employee Compensation and Benefits Plan. Resolution of the Community Development Commission of the City of San Bernardino, California, amending Resolution No. 5279, as amended, pertaining to personnel policies and procedures for the Economic Development Agency, General Unit Employees and Personnel Policies and Procedures for the Economic Development Agency Mid-Managers. D. Resolution of the Community Development Commission of the City of San Bernardino, California, amending Resolution No. 5280, as amended, pertaining to salaries for certain employees of the Economic Development Agency. MOTION #1: That the Community Development Commission adopt the Economic Development Agency's budget for Fiscal Year 1998-99. MOTION #2: That said resolutions A-D, be adopted. R21. Set public hearing - 2:00 p.m., August 17, 1998 - regarding the possible disposition of eight fourplex residential units in Sunrise Village (Arden-Guthrie). (See Attached) Ward 7 MOTION: That the Mayor and Common Council and the Community Development Commission set a joint public hearing for 2:00 p.m., Monday, August 17, 1998 in the Council Chambers regarding the possible disposition of eight fourplex residential units in Sunrise Village (Arden-Guthrie). R22. Arrow Vista - Disposition and Development Agreement. (See Attached) Ward 6 MOTION: That the Community Development Commission conceptually approve the land use and design concepts of the development proposed by Southern California Housing Development Corporation/Inco Homes for the remaining vacant land of the Arrow Vista housing project; and that staff be instructed to negotiate provisions of a disposition and development agreement for further consideration by the Community Development Commission and the Mayor and Common Council. 10 8/3/1998 23. Adjournment. MOTION: That the meeting be adjourned. NOTE: The next joint regular meeting is scheduled to be held at 8:00 a.m., Monday, August 17, 1998, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. 11 8/3/1998 NOTICE: Any member of the public may address this meeting of the Mayor and Common Council/Community Development Commission on any item appearing on the agenda by approaching the microphone in the Council Chambers when the item about which the member desires to speak is called and by asking to be recognized. Any member of the public desiring to speak to the Mayor and Common Council/Community Development Commission concerning any matter not on the agenda but which is within the subject matter jurisdiction of the Mayor and Common Council/Community Development Commission, may address the body at the beginning of the meeting, during the period reserved for public comments. Said total period for public comments shall not exceed forty-five (45) minutes, unless such time limit is extended by the Mayor and Common Council/Community Development Commission. A three minute limitation shall apply to each member of the public, unless such time limit is extended by the Mayor and Common Council/Community Development Commission. No member of the public shall be permitted to "share" his/her three minutes with any other member of the public. The Mayor and Common Council/Community Development Commission may refer any item raised by the public to staff, or to any commission, board, bureau, or committee for appropriate action or have the item placed on the next agenda of the Mayor and Common Council/Community Development Commission. However, no other action shall be taken nor discussion held by the Mayor and Common Council/Community Development Commission on any item which does not appear on the agenda unless the action is otherwise authorized in accordance with the provisions of subdivision (b) of Section 54954.2 of the Government Code.
